SAID ORDINANCES WERE ADOPTED UNDER SECTION 65806 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA, AND ARE RENEWED AS URGENCY MEASURES FOR THE REASONS SET FORTH HEREIN. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AS FOLLOWS: I SECTION 1. RE-ENACTMENT. Pursuant to Section 65806 of the Government Code of the State of California, as amended by the State Legislature in the year 1961, the City Council of the City of Palm Springs does hereby renew the following ordinances, a public hearing having been held on these ordin- ances as required by the above referred to section of the Government Code. The ordinances are: 1. Ordinance No. 463, which ordinance rezoned Lots 21, 22, 23 and 24 in Section 29, Township 4 South, Range 5 East, San Bernardino Base & Meridian, within said city, from G-R Zone classification to R-3 Zone classification. The said ordinance accomplished the zone change by adding Section 9211.2999 to Division 9 of the "Palm Springs Ordinance Code;' wherein, a metes and bounds descfiption of the above referred to lots is set forth. M 2, Ordinance No. 477, which ordinate amended Section 9432 of Division 9 of the "Palm Springs Ordinance Code" to limit, by right, only R-1 Zone'District uses in the Guest-Ranch Zone Districts, and to require a conditional use permit in the said Guest Ranch Zone Districts for all other zone district uses. The conditional use permit procedure is as provided by Chapter 925 of Division 9 of the i1Palm Springs Ordinance Code. " 3. Ordinance No. 520, which ordinance added Section 9415.9 to Division 9 of the "Palm Springs Ordinance Code" to provide regulations and performance standards for accessory parking lots. Said Section 9415.9 required, in part, the approval by City Council of all public parking lots within fifty (50' ) feet of Palm Canyon Drive, Indian Avenue or Tahquitz-McCallum Way. SECTION 2. URGENCY. This ordinance is declared to be an urgency matter, to become effective immediately upon reading and adoption and pursuant to Section 65806 of the Government Code of the State of California, as amended by the Legislature in 1961, for the following reasons: 1. The above referred to ordinances numbered 463, 477 and 520 were adopted as urgency measures pursuant to the Government Code Section 65806 but prior to the 1961 amendment to such Government Code Section 65806. A reading of Government Code Section 65806, as amended in 1961, I indicates that urgency measures must be renewed annually with a limi- tation of two (2) renewals. It is not clear whether the section is to have a retroactive effect or just how the statute is to be applied; therefore it is necessary that the above ordiances be renewed as urgency matters so that they may be continued in effect. SECTION 3. EFFECTIVE DATE. This ordinance shall become effective immediately upon reading and adoption by the majority required by law. SECTION 4. PUBLICATION. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in THE DESERT SUN, a daily newspaper of general circulation, printed, published and circulated in the City of Palm Springs, California. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AS FOLLOWS: SECTION 1. REPEAL. Section 9211.2999-22 was added to Division 9 of the "Palm Springs Ordinance Code" by Ordinance No. 547, adopted February 19, 1962. By the provisions of said Section 9211.2999-22, the conditions incorporated by the Planning Commission in its Resolution No. 1047, adopted December 19, 1961, were adopted, which conditions provided that if construction had not been com- menced within nine (9) months of the effective date of the zoning, then the R-3 zoning grated by Ordinance No. 547 shall revert to the original R-2 zoning. The time for compliance having expired, Ordinance No. 547 is hereby repealed. SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 3. PUBLICATION.
