O�pALM SpR iZ V N M Y °q<'F°��,,P CITY COUNCIL STAFF REPORT DATE: NOVEMBER 16, 2006 LEGISLATIVE SUBJECT: PROPOSED ORDINANCE MODIFYING THE MEMBERSHIP AND THE NUMBER OF MEMBERS ON THE PALM SPRINGS INTERNATIONAL AIRPORT COMMISSION FROM: David H. Ready, City Manager BY: James Thompson, City Clerk SUMMARY The City Council will consider an ordinance that increases the membership of the Palm Springs International Airport Commission from 15 to 19 members, eliminates rotational membership, and revises the appointment authority. RECOMMENDATION: 1. Waive the reading of the ordinance text in its entirety and read by title only. 2. Introduce on first reading Ordinance No. _, "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 2.16.010, 2.16.020, AND 2.16.030 OF THE PALM SPRINGS MUNICIPAL CODE, RELATING TO THE MEMBERSHIP OF THE PALM SPRINGS INTERNATIONAL AIRPORT COMMISSION. STAFF ANALYSIS: At it's meeting of September 20, 2006, Lhe City Council directed staff to prepare an ordinance modifying the number of members on the Palm Springs International Airport Commission and eliminate the rotational status of certain members from other Coachella Valley cities. The proposed ordinance increases the number of members on the Commission from 15 to 19. The number of appointees by the Palm Springs City Council increases from 8 to 10 members. The rotational membership for the cities of Indio, Desert Hot Springs and Coachella are eliminated. The remaining nine members are representatives of, and appointed by: ITEM NO. PROPOSED ORDINANCE TO MODIFY MUNICIPAL CODE CHAPTER 2,16, PALM SPRINGS INTERNATIONAL AIRPORT: City Manager Ready provided background information as outlined in the staff report dated September 20, 2006. Mayor Oden requested staff address the modified version as requested by the Airport Commission. Mayor Pro Tern Foat commented on the effects of the Airport to the City and requested staff address the history of other cities representation on the Airport Commission. Councilmember Pougnet stated he supports the voting status change, but stated the City of Palm Springs should have the majority of members on the Commission. Councilmember McCulloch stated the City of Palm Springs should have the majority, but the body is too large and should be further reviewed in the future. ACTION: Direct the City Attorney to prepare an ordinance modifying the rotational voting status of certain Airport Commissioners and adding two additional Commissioners appointed by the City of Palm Springs. Motion Councilmember Pougnet, seconded by Mayor Oden and unanimously carried on a roll call vote. FISCAL IMPACT: Immaterial amount of staff time and costs associated with advertising, maintaining membership records, and administration of the Conflict of Interest Code filings. /®mes Thompson, City Clerk David H. AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 2.16.010, 2.16.020, AND 2.16.030 OF THE PALM SPRINGS MUNICIPAL CODE, RELATING TO THE MEMBERSHIP OF THE PALM SPRINGS INTERNATIONAL AIRPORT COMMISSION, City Attorney's Summary This Ordinance increases the membership of the Palm Springs International Airport Commission from 15 to 19 members, eliminates rotational memberships, and revises the appointment authority accordingly. The City Council of the City of Palm Springs ordains: SECTION 1. Section 2.16.010 of the Palm Springs Municipal Code is amended to read: 2.16.010 Definitions. For the purpose of this chapter: "Commission" means the Palm Springs international airport commission. SECTION 2. Section 2.16.020 of the Palm Springs Municipal Code is amended to read: 2.16.020 Membership—Creation. There is created in the city an international airport commission, which shall consist of nineteen members. The nineteen members shall be appointed in the following manner: ten members, appointed in accordance with Section 2.04.060 of the Palm Springs Municipal Code; eight members, one appointed by each of the cities of Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, La Quinta, Palm Desert, and Rancho Mirage, in the manner which each city shall determine; and a member appointed by the Board of Supervisors of Riverside County. SECTION 3. Section 2.16.030 of the Palm Springs Municipal Code is amended to read: 2.16.030 Membership—Terms. The term of office for regular members shall be as provided in Section 2.06.010 of the Palm Springs Municipal Code for all appointees SECTION 4. The two new members appointed by the City of Palm Springs pursuant to Section 2 of this ordinance, shall serve for the initial term ending June 30, 2009. Ordinance No, Page 2 SECTION 5. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
