ORDINANCE NO. 513
AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, PROVIDING FOR THE ISSUANCE OF
AIRPORT BONDS OF SAID CITY IN THE AMOUNT
OF $3,000,000.
IWHEREAS, pursuant to Ordinance No. 493 of the City of Palm Springs,
California, a special municipal election was duly and regularly held in
said City on the 14th day of March, 1961, at which election there was
submitted to the qualified voters of said city the following bond
proposition, to-wit:
BOND PROPOSITION: Shall the City of Palm
Springs incur a bonded indebtedness in the prin-
cipal sum of $3,000,000. for the purpose of the
acquisition and construction of a certain muni-
cipal improvement, to�rwit: a municipal airport
including lands and easements (including avigation
easements) within Sections 12 and 18, Township 4
South, Range 5 East, S.B.B.&.M. (within which is
located the present Palm Springs Airport) therefor,
and improvements including buildings, hangars, run-
wayasurfaces and otherimprovements for airport
purpsoes, and including any facilities, machinery,
equipment and other property necessary therefor,
and including any property of the present Palm
Springs Airport except the terminal building?
and
I WHEREAS, said proposition received the affirmative vote and assent
of more than two-thirds of all of the qualified voters of said City
voting on said proposition, and said city is now authorized to issue
bonds in the amount and for the purpose set forth in said proposition;
NOW THEREFORE, the City Council of the City of Palm Springs, California,
DOES ORDAIN as follows:
Section 1. That bonds of the city of Palm Springs, California, in
the principal sum of $3,000,000 be issued and solf for the purpose set
forth in the bond proposition ain the recitals hereof, Said bonds shall
be designated
AIRPORT BONDS, 1961
shall be three thousand in number, numbered 1 to 3,000 both inclusive, and I
shall be of the denomination of $1,000 each. Said bonds shall be dated
June 1, 1961, and shall be payable in consecutive numerical order $70,000
on June 1, in each of the years 1962 to 1971, both inclusive, $110,000
on June 1 in each of the years 1972 to 1981, both inclusive, and $120,000
on June 1 in each of the years 1982 to 1991, both inclusive.
Said bonds shall bear interest at a rate of rates to be hereafter fixed
by resolution, but not to exceed five per cent (5%) per annum, payable
annually the first year and semiannually thereafter. Said bonds and
the interest thereon shall be payable in lawful money of the United
States of America at tie office of the City Treasurer of the City of
Palm Springs, California, in said c17ty, or at any fiscal agency of the
City of Palm Springs, in Los Angeles, California at the option of the
holder thereof.
Section 2. That the Mayor and the City Treasurer of said city are
hereby authorized and directed to sign all of said bonds by their printed,
lithographer or engraved facsimile signatures, and the City Clerk of said
City is hereby authorized and directed to countersign said bonds and to
affix thereto the corporateseal of said city, and the City Tfeasurer
of said city is hereby authorized and directed to sign the interest
coupons of said bonds by his printed, lithographer or engraved facsi-
mile signature, and to number said interest coupons of each said bonds
consecutively .
Section 3. That the proceeds of the sale of said bonds (except I
premium, if any, and accrued interest) shall forthwith be turned over
to and placed in the municipal treasury of the City of Palm Springs,
to the crddit,iof a fund hereby created and designated
AIRPORT BONDS, 1961, CONSTRUCTION FUND
and the moneys in said fund shall be applied exclusively to the acquisi-
tion and construction of the municipal improvement described in the bond
proposition in the recitals hereof, except as proved in Section 43628
of the Government Code.
Section 4. That any premium or accrued interest received from
the sale of said bonds shall forthwith be turned over to and placed
in said treasury in the interest and redemption fund hereinafter
created. That for the purpose of paying the principal and interest
of said bonds, the City Council of the City of Palm Springs shall at
the time of fixing the general tax levy, and annually thereafter until
said bonds are paid or until there is a sum in the treasury of said
City set apart for that purpose sufficient to meet all payments of
principal and interest on said bonds as they become due, levy and
collect a tax sufficient to pay the interest on said bonds as it falls
due and such part of the principal thereof as will become due before the
proceeds of a tax levied at the next general tax levy will be available.
Said tax shall be in addition to all other taxes levied for municipal I
purposes and shall be levied and collected as other city taxes, and

day of June, 19_, with interest thereon at the rate of per
cent ( %) per annum, interest for the first year payable at
the end of said year and interest thereafter payable semiannually
on the first days of June and December of each and every year from
the date hereof until this bond is paid, on presentation and sur-

principal and interest are payble in lawful money of the United

FIXING THE AMOUNT OF MONEY TO BE RAISED BY
TAXATION FOR THE FISCAL YEAR BEGINNING
JULY 1, 1961
The City Council of the City of Palm Springs does hereby ordain as
follows,
Section 1. The amount of money necessary to be raised by taxation
upon the taxable property within the City of Palm Springs as a revenue to
carry on the various departments of said City and to pay the bonded and
I other indebtedness of the City for the fiscal year beginning July 1, 1961,
is hereby fixed as follows :
a) For the carrying on of the various departments of the City other
than herein stated, the sum of Six Hundred Fifty Nine Thousand, One Hundred
Seventy Two Dollars ($659,172.00) .
b) For the Maintenance and operation of park and recreation facilities
of the City of Palm Springs, said maintenance and operation not otherwise be-
ing provided for, the sum of Eighty Three Thousand, Six Hundred Forty Four
Dollars ($83,644.00) .
c) For the purpose of providing and maintaining parks and music, and
for advertising purposes to be used and expended for such purposes in accord-
ance with Ordinance No. 192 of the City of Palm Springs, the sum of Ninety
Thousand Dollars ($90,000.00) .
d) For the maintenance, support and purchase of property necessary for
the public library, known as the Welwood Murray Memorial Library of the City'
of Palm Springs, the maintenance of said public library not being otherwise
provided for, the sum of Seventy Six Thousand, Three Hundred Seventy Nine
Dollars ($76,379.00) .
e) For the maintenance and operation of the sewage disposal system,
the sum of Sixty Seven Thousand,' Nine-'Hundred Fifty Six Dollars ($67,956.00) .
f) Concerning the bonds, issuance of which was authorized at the special
election held February 14, 1956, for the municipal improvement consisting of
street lights and trees, for the purpose of paying annual interest thereon as
same became due, and also the principal as same shall become due, the sum of
Thirteen Thousand, Five Hundred Fifty Dollars ($13,550. 00) .

election held February 14, 1956, for the municipal street improvement of
Tahquitz-McCallum, for the purpose of paying annual interest thereon as

h) Concerning the bonds, issuance of which was authorized at the
special election held April 26, 1949, for the purpose of paying the
annual interest thereon as the same became due, and also the principal
as same shall become due, the sum of Fifty Eight Thousand, Three Hundred
Seventy Five Dollars ($58,375.00) .
i) Concerning the bonds, issuance of which was authorized at the
special election held April 29, 1958, for the purpose of paying annual
interest thereon as the same shall become due, and also the principal
as shall become due, the sum of One Hundred Nine Thousand Five Hundred
Dollars ($109,500.00) .
j) For the purpose of financing the City's share of the employees '
retirement plan for the current fiscal year, the sum of One Hundred Thirty
Seven Thousand Dollars ($137,000.00) .
k) Concerning the Airport Acquisition Bonds authorized at the
special election held March 14, 1961, for the purpose of paying Annual
interest thereon as the same shall become due, and also the principal
as shall become due the sum of Two Hundred Twenty Thousand Dollars
($220,000.00) .
SECTION 2. The amount of money necessary to be raised by taxation and
as provided by this ordinance has been established pursuant to a budget pre-
pared by the City Manager and approved by resolutions of the City Council,
in accordance with the requirements of the "Palm Springs Ordinance Code. "
Pursuant to the authority granted by the statutes of the State of California,
the budget referred to is hereby adopted, and items for purchase provided for
by such budget may be purchased and paid by the Director of Finance prior to I
audit by the City Council.
SECTION 3. This is an ordinance fixing the amount of money to be
raised by taxation. The City Council therefore determines and declares
that the same shall be effective immediately by authority of the pro-
visions of Section 36937 of the Government Code of the State of California.
SECTION 4. The City Clerk is hereby ordered and directed to certify to—
the passage of this ordinance and to cause the same to be published once in
the Desert Sun, a newspaper of general circulation, printed, published, and
circulated in the City of Palm Springs.

SECTION 1. The City Council of the City of Palm Springs, California,
does declare its intention to call a special municipal election to consider
the plan for redistricting councilmanic districts within the City in accord-
ance with the districts hereinafter described.
SECTION 2 .' - The new councilmanic districts hereinafter described shall
come into force and effect only upon the approval of a majority of the
qualified electors, who vote , in a special election to be called solely
for the purpose of qualifying electors and candidates for the next- gen-
eral municipal election.
SECTION 3 . If the new seven councilmanic districts are approved
in the special election, and for the purposes provided for in Section
2 above, then at the conclusion of the canvass of the ballot- at the
next General Municipal Election, the new councilmanic districts shall
be effective for all purposes and the councilmen heretofore elected and
hereafter elected at the next General Municipal Election shall represent I
the, councilmanic districts described in this ordinance.
SECTION 4. The contemplated seven councilmanic districts to come
into effect for the purpose described in Section 2 hereinabove, and

AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ANNEXING UNINHABITED TERRITORY PURSUANT TO THE "ANNEXA-
TION OF UNINHABITED TERRITORY ACT OF 1939"SECTIONS 35300
ET SEQ. , OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA,
SAID LANDS BEING GENERALLY COMPRISED OF SEVEN AND ONE-HALF
ACRES OF LAND ABUTTING THE NORTH BOUNDARY OF THE CITY, AND
LOCATED IN SECTION 34, T3S, R4E, 'SBB&M, AND MORE FULLY
HEREINAFTER DESCRIBED.
WHEREAS, the "Annexation of Uninhabited Territory Act of 1939," Sections
' 35300 et seq: , of the Government Code of the State of California, provides
for the alteration of boundaries of incorporated towns or cities by the
annexation of uninhabited territory thereto, and for the incorporation of
such annexed territory into and as a part of the annexing city, and for the
opening of councilmanic districts for the purpose of inclusion of the lands
annexed; and
WHEREAS the City Council of the City of Palm Springs, on the 25th day of
September, 1961, by Resolution No. , 6576 initiated proceedings on its own
motion and pursuant to the said above referred to Annexation Act, to alter
the boundaries of said City and to incorporate and include in said City
uninhabited territory within the boundaries of said City hereinafter
specifically described; and
WHEREAS the said territory was determined to be uninhabited territory under
the provisions of the referred to State Annexation Act; and '
WHEREAS in Resolution No. , 6576, the City Council commenced the proceedings
for annexation, it did set forth the,reasons for annexation, the same being:
A. Real estate developments are contemplated pursuant to the
_ Federal Housing Authority for the purpose of providing low
cost housing for any and all persons desiring same, and at the
perimeter of the City.
B. It is desirable that the area to be developed be annexed to
to the City so that the residential development can be serviced
by the City's emergency departments.
WHEREAS said Resolution No. 6576 set forth the time and place for the purpose
of hearing and determing written protests filed with the City Council prior
to the hour set forth in said resolution; and
WHEREAS pursuant to the applicable provisions of the Government Code, the City
Cleric did publish notice and provide written notice to all property owners in
accordance with the law; and
WHEREAS on the 30th day of October, 1961, at the hour of 8:15 o'clock p.m. ,
in the City Council Chambers, 3200 McCallum Way, in the City of Palm Springs
California, being the time and place fixed for the hearing andldeterming
of written protests, said hearing and determination was had, evidence both '
written and oral received, objections of all persons ,owning property within
the annexation area noted and accepted and passed upon; and pursuant to
Resolution No. 6624 said protests were found to be insufficient; and
WHEREAS all proceedings required by the "Annexation of Uninhabited Territory
Act of 1939," were had and taken as prescribed by said Act,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES
ORDAIN AS FOLLOWS:

Act of 1939," Section 35300 et seq. , of the Government Code of the
State of California, the boundaries of the City of Palm Springs
shall be and hereby are altered, and the uninhabited territory
hereinafter described is hereby annexed to and incorporated within
and included in the City of Palm Springs, California:

ORDINANCE NO. 531
AN ORDINANCE TO AMEND THE UNIFORM LOCAL SALES AND USE
TAX ORDINANCE
The City Council of the City of Palm Springs does ordain as follows: '
SECTION 1. Section 2(e) of the Uniform Local Sales and Use Tax I
Ordinance (Ordinance No. 351) is repealed.
SECTION 2. Section 4 (a) (2) of said ordinance is amended to read:
4(a) (2), For the purposes of this ordinance, all retail sales are
consummated at the place of business of the retailer unless the
tangible personal property sold is delivered by the retailer or
his agent to an out-of-state destination or to a common carrier
for delivery to an out-of-state destination. The gross receipts
from such sales shall include delivery charges, when such charges
are subject to the State sales and use tax, regardless of the place
to which delivery is made. In the,--event a retailer has no permanent
place of business in the State or has more than one place of business,
the place or places at which the retail sales are consummated shall
be determined under rules and regulations to be prescribed and adop-
ted by the Board of Equalization.
SECTION 3. Section 4 (b) (4) (ii) of said ordinance is repealed.
SECTION 4. Section 4(b) (4) (iii) of said ordinance is renumbered
to 4 (b) (4) (ii) .
SECTION 5. Section 5 (b) (2) of said ordinance is amended to read:
5 (b) (2) Wherever, and to the extent that, in Part 1 of Division 2 I
of the said Revenue and Taxation Code the State of California is
named or referred to as the taxing agency, the name of this City
shall be substituted therefor. Nothing in this subdivision shall
be deemed to require the substitution of the name of this City for
the word "State" when that word is used as part of the title of
the State Controller, the State Treasurer, the State Board of
Control, the State Board of Equalization, or the name of the State
Treasury, or of the Constitution of the State of California: nor
shall the name of the City be substituted for that of the State
in any section when the result of that substitution would require
action to be taken by or against the City or any agency thereof
rather than by or against the State Board of Equalization in per-
forming the functions incident to the administration or opera-
tion of this ordinance; and neither shall the substitution be
deemed to have been made in those sections, including but not
necessarily limited to, sections referring to the exterior
boundaries of the State of California, where the result of the
substituti6niwould be to provide an exemption from this tax with
respect to certain storage, use or other consumption of tangible
personal property which would not otherwise be exempt from this
tax while such storage, use or other consumption remains subject
to tax by the State under the Provisions of Part 1 of Division 2
of the said Revenue and Taxation Code, or to impose this tax with'
respect to certain storage, use or other consumption of tangible
personal property which would not be subject to tax by the State
under the said provisions of that Code; and in addition, the name of .
the City shall hot be substituted for that of the State in Sections
6701, 6702 (except in the last sentence thereof) , 6711, 6715, 6737,
6797 and 6828 of the said Revedue and Taxation Code as adopted,
and the name of the City shall not be substituted for the word
"State" in the phrase "retailer engaged in business in this State"
in Section 6203 nor in the definition of that phrase in Section 6203
SECTION 6. Section 5 (b) (3) (ii) of said ordinance is amended
to read:
5 (b) (3) (ii) The storage, use or other consumption of tangible
personal property, the gross receipts from the sale of which has been sub-
ject to sales tax under a sales and use tax ordinance enacted in accord-
ance with Part 1.5 of Division 2 of the Revenue and Taxation Code by any
City and county, county, or city in this State.
I SECTION 7. This ordinance shall become operative on January 1,
1962.
SECTION 8. Publication. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to cause the same
to be published once in the Desert Sun, a daily newspaper of general circu-
lation, printed, published and circulated in the City of Palm Springs,
