hereby certify that the foregoing Ordinance, being Ordinance No. 452,
of the City of Palm Springs, was adopted as an urgency measure at
a meeting of said City Council held on the 27th day of January, 1960,
after having been read in full. Said Ordinance shall become effective
immediately and was so adopted by the following vote:

ORDINANCE NO. 460
AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, PROVIDING FOR THE ISSUANCE OF
SEWER BONDS OF SAID CITY IN THE AMOUNT OF
$1,550,000
WHEREAS, pursuant to Ordinance No. 372, of the City of Palm
Springs, California, a special municipal election was duly and
regularly held in said city on the 29th day of April, 1955, at
which election there was submitted to the qualified voters of
said city the following bond proposition, to wit:
BOND PROPOSITION: Shall the City of
Palm Springs incur a bonded indebtedness
in the principal sum of $1,550,000 for
the acquisition and construction by said
city of a certain municipal improvement,
to wit: additions to the sanitary sewage
' collection, treatment and disposal system
of said city, consisting of interceptor,
collection and 'trunk sewers, pumping
stations and sewage treatment plant and
effluent discharge line, and including
for the foregoing appurtenances and
appurtenant work and the acquisition of
all land, easements, pipe, pumps,
machinery and other property necessary
therefor?
and
WHEREAS, said proposition received the affirmative vote and
assent of more than two-thirds of all of the qualified voters of
said city voting on said proposition, and said city is now aulh orized
to issue bonds in the amount and for the purpose set forth in said
proposition:
NOW TBEREFORE, the City Council of the Gity of Palm Springs,
California, DOES ORDAIN as follows:
Section 1. That bonds of the City of Palm Springs, California,
in the principal sum of $1,550,000 be issued and sold for the
purpose set forth in the bond proposition in the recitals hereof.
Said bonds shall be designated
SEWER BONDS, 1960,
shall be one thousand five hundred fifty in number, numbered 1 to
1,550 both inclusive, and shall be of the denomination of $1,000
each. Said bonds shall be dated May 1, 1960, and shall be payable
in consecutive numerical order $40,000 on May 1 in each of the
years 1961 to 1970, both inclusive, $50,000 on May 1 in each of the
years 1971 to 1975, both inclusive, and $60,000 on May 1 in each

of the years 1976 to 1990, both inclusive.
Said bonds shall bear interest at a rate or rates to be hereafter
fixed by resolution, but not to, exceed six per cent (6%) perannum,
payable annually the first year and semiannually thereafter. Said
bonds and the interest thereon shall be payable in lawful money of
the United States of America at the office of the City Treasurer
of the City of Palm Springs, California, in said city, or at any
fiscal agency of the City of Palm Springs in Los Angeles, California, I
at the option of the holder thereof.
Section 2. That the Mayor and the City Treasurer of said city
are hereby authorized and directed to sign all of said bonds by their
printed, lithographed or engraved facsimile signatures, and the City
Clerk of said city is hereby authorized and directed to countersign
said bonds and to affix thereto the corporate seal of said city, and
the City Treasurer of said city is hereby authorized and directed to
sign the interest coupons of said bonds by his printed, lighographed
or engraved facsimile signature, and to number said interest coupons
of each of said bonds consecutively.
Section 3. That the proceeds of the sale of said bonds (except
premium, if any, and accrued interest) shall forthwith be turned over
to and placed in the municipal treasury of the City of Palm Springs
to the credit of a fund hereby created and designated
"SEWER BONDS, 1960, CONSTRUCTION FUND"
and the moneys in said fund shall be applied exclusively to the
acquisition and construction of the municipal improvement described
in the bond proposition in the recitals hereof, except as provided
in Section 43628 of the Government Code.
Section 4. That any premium or accrued interest received from '
the sale of said bonds shall forthwith be turned over to and placed
in said treasury in the interest and redemption fund hereinafter
created. That for the purpose of paying the principal and interest
of said bonds, the City Council of the City of Palm Springs shall at
the time of fixing the general tax levy, and annually thereafter
until said bonds are paid or until there is a sum in the treasury
of said city set apart for .that purpose sufficient to meet all
payments of principal and interest on said bonds as they become due,
levy and collect a tax sufficient to pay the interest on said bonds
as it falls due and such part of the principal thereof as will become
due before the proceeds of a tax levied at the next general tax levy
will be available. Said tax shall be in addition to all other taxes
levied for municipal purposes and shall be levied and collected as
other city taxes, and shall forthwith be turned over and paid into
a fund of the City to be known as
"SEWER BONDS, 1960, INTEREST AND REDEMPTION FUND. "
Said fund shall be used for no other purpose than the payment of said
bonds and interest thereon until said bonds and interest are fully
paid.
Section 5. That said bonds and the coupons for the interest
thereon shall be issued in substantially the following form:

The CITY OF PALM SPRINGS, a municipal corporation situated
in the County of Riverside, State of California, FOR VALUE RECEIVED,
hereby acknowledges its indebtedness and promises to pay to the
bearer hereof the sum of ONE THOUSAND DOLLARD ($1,000) on the
first day of May, 19 , with interest thereon at the rate of - per
cent ( %) per annsm, interest for the first year payable aTthe
end of said year and interest thereafter payable semiannually on the
first days of November and May of each and every year from the date
hereof until this bond is paid, on presentation and surrender of the
respective inter st coupons hereto attached. Both principal and
interest are payable in lawful money of the United States of America
at the office of the City Treasurer of the City of Palm Springs,
California, in said city, or at any fiscal agency of the City of
Palm Springs in Los Angeles, California, at the option of the holder
hereof.
This bond is issued by the City of Palm Springs under and in
pursuance of and in conformity with the provisions of Article 1,
Chapter 4, Division 4, Title 4 of the Government Code of the State
of California, and acts supplementary thereto, and in pursuance
of the laws and Constitution of the State of California, and is
authorized by a vote of more than two-thirds of all the qualified
voters of said City of Palm Springs voting at an election duly and
legally called, held and conducted in said City on the 29th day of
I April, 1958.
IT IS HEREBY CERTIFIED, RECITED AND DECLARED that all acts,
conditions and things required by law to exist, happen and be performed
precendent to and in the issuance of this bond have existed, happened
and been performed in due time, form and manner as required by law,
and that the amount of this bond, together with all other indebtedness
of said city, does not exceed any debt limit prescribed by the laws
or Constitution of the State of California.
IT WITNESS WHEREOF, said City of Palm Springs has caused this
bond to be signed by the Mayor and the City Treasurer of said City
by their facsimile signatures, countersigned by the City Clerk of
said city and sealed with the corporate seal of said city and the
interest coupons hereto attached to by signed by the City Treasurer
by his facsimile signature, and has caused this bond to be dated
the first day of May, 1960.

THE COUNTY OF RIVERSIDE SHALL RECEIVE FIVE PER CENT (5%)
OF THE ONE PER CENT (1%) TAX COLLECTED ON ALL RETAIL SALES
IN THE CITY, BY AMENDING SECTIONS 2(c) , 4(a) (1) AND 5(a)
OF SAID ORDINANCE NO. 351, AND RECITING A NEW SECTION
FOUR OF THIS ORDINANCE TO PROVIDE AN EFFECTIVE. TIME.
THIS ORDINANCE SHALL TAKE EFFECT JULY 1, 1960, AN AN I
URGENCY MEASURE. ORDINANCE NO. 441 IS HEREBY REPEALED
EFFECTIVE JULY 1, 1960.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS:
SECTION ONE. Section 2(c.) of Ordinance No. 351 of the
City of Palm Springs, is hereby amended to read as follows:
"SECTION 2. PURPOSE * * -
(c) To adopt a sales and use tax ordinance which imposes
a ninety-five/one hundredths of one per cent (.95%) tax,
and provides a measure therefor that can be administered
and collected by the State Board of Equalization in a
manner that adapts itself as fully as practical to., and
requires the least possible deviation from, the existing
statutory and administrative procedures followed by the
State Board of Equalization in administering and collect-
ing the California State Sales and Use Taxes".
"SECTION TWO. Section 4(a) (1) of Ordinance No. 351 of the I
City of Palm Springs, is hereby amended to read as follows:
"SECTION 4. SALES TAX.
(a) (1) For the privilege of selling tangible personal
property at retail a tax is hereby imposed upon all re-
tailers in the city at the rate of ninety-five/one hundredths
of one per cent (.95%) of the gross receipts of the retailer
from the sale of all tangible personal property sold at
retail in the City of Palm Springs on and after the opera-
tive date of this ordinance."
SECTION THREE. Section 5(a) of Ordinance No. 351 of the
City of Palm Springs is hereby amended to read as follows:
"SECTION 5. USE TAX.
(a) An excise tax is hereby imposed on the storage, use or
other consumption in the City of Palm Springs of tangible
personal property purchased from any retailer on or after
the operative date of this ordinance, for storage, use or
other consumption in the city at the rate of ninety-five/
one hundredths of one per cent. (.95%) of the sales price
of the property. The sales price shall include delivery
charges when such charges are subject to State Sales or
use tax regardless of the place to which delivery is made.
SECTION FOUR. EFFECTIVE TIME.
This ordinance shall become effective as of July 1, 1960,
and be controlling thereafter and until amendment or repeal by
the City Council of this City. This ordinance is enacted as an
urgency measure but the effect of its provisions, as stated, shall
not become effective until July 1, 1960. The reason for urgency
are as set forth in Section 5 of this ordinance.
SECTION FIVE, URGENCY.
This ordinance is enacted as an urgency measure for the
reason that if enacted as a regular thirty day measure, it would
not become effective until July 8, 1960, namely thirty days after
the second reading which would be on June 8 of this year. There-
fore the City Council, pursuant to the applicable provisions of
the Government Code of the: State of California does enact this
I measure as an urgency measure but to take effect as of July 1,
1960. The further reason for urgency enactment. -is that the City
has heretofore entered into an agreement with the County and
State for the collection of Sales and Use Tax pursuant to the

AN ORDINANCE OF THE CITY OF PALM SPRINGS FIXING THE
AMOUNT OF MONEY TO BE RAISED BY TAXATION FOR THE
FISCAL YEAR BEGINNING JULY 1, 1960.
The City Council of the City of Palm Springs does hereby ordain as
follows:
SECTION 1. The amount of money necessary to be raised by taxa-
tion upon the taxable property within the City of Palm Springs as a
revenue to carry on the various departments of said City and to pay
the bonded and other indebtedness of the City for the fiscal year
beginning July 1, 1960, is hereby fixed as follows:
a) For the carrying on of the various departments of the City
other than herein stated, the sum of Five Hundred Forty-
six Thousand.One Hundred. Sixty-six Dollars ($546,166.00)
(b) For the maintenance and operation of park and recreation
facilities of the City of Palm Springs, said maintenance
and operation not otherwise being provided for, the sum
of Sixty-one Thousand Seven Hundred Forty-eight Dollars
($61,748.00) .
(c) For the purpose of providing and maintaining parks and
music, and for advertising purposes, to be used and ex-
pended for such purposes in accordance with Ordinance
I No. 192 of the City of Palm Springs, the sum of Eighty
Thousand Dollars ($80,000.00) .
(d) For the maintenance, support and purchase of property
necessary for the public library, known as the Welwood
Murray Memorial Library of the City of Palm Springs,
the maintenance of said public library not being other-
wise provided for, the sum of Seventy-six Thousand Seven
Hundred Ninety-seven Dollars ($76,797.00) .
(e) For the maintenance and operation of the sewage disposal
system, the sum of Fifty-two Thousand Six Hundred Four
Dollars ($52,604.00) .
(f) Concerning the bonds, issuance of which was authorized at
the special election held February 14, 19561 for the muni-
cipal improvement consisting of street lights and trees,
for the purpose of paying annual interest thereon as same
became due, and also the principal as same shall become due,
the sum of Thirteen Thousand Nine Hundred Twenty-five Dollars
($13,925.00) .
(g) Concerning the bonds, issuance of which was authorized at
the special election held February 14, 1956, for the muni-
cipal street improvement of Tahquitz-McCallum, for the
purpose of paying annual interest thereon as same became
due and also the principal as shall become due, the sum
of Sixteen Thousand Three Hundred Seventy-five Dollars
($16,375.00) .
(h) Concerning the bonds, issuance of which was authorized at
the special election held April 26, 1949, for the purpose
of paying the annual interest thereon as the same became
due, and also the principal as same shall become due, the
sum of Fifty-nine Thousand Six Hundred Twenty-five Dollars
($59,625.00) .
(i) Concerning the bonds, issuance of which was authorized at
the special election held April 29, 1958, for the purpose of
paying annual interest thereon as the same shall become due,
and also the principal as shall become due, the sum of One
Hundred Eight Thousand Nine Hundred Fifty ($108,950.00) dollars.
(j) For the purpose of financing the City' s share of the employees'
retirement plan for the current fiscal year, the sum of One
Hundred Forty Thousand Three Hundred Dollars ($140,300.00) .
SECTION 2. The amount of money necessary to be raised by taxation
and as provided by this ordinance has been established pursuant to a
I budget prepared by the City Manager and approved by resolution of the
City Council, in accordance with the requirements of the "Palm Springs
Ordinance Code". Pursuant to the authority granted by the statutes of
the State of California, the budget referred to is hereby adopted and
items for purchase provided for by such budget may be purchased by the
Director of Finance prior to audit by the City Council.
SECTION 3. This is an ordinance fixing the amount of money
to be raised by taxation. The City Council therefore determines and
declares that the same shall be effective immediately by authority
of the provisions of Section 36937 of the Government Code of the
State of California.
SECTION 4. The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance and to cause the same to

using City Facilities without contributing to the cost
of maintenance of City facilities;
2. It is likely that the uninhabited territory herinafter
described will develop and the City will be in a position
to offer municipal services such as police, fire, waste
disposal, building regulation and planning services to
the territory, thus assuring a proper growth to the
territory to the mutual benefit of both the territory
and the City; and
WHEREAS the said Resolution No. 5935 set forth the time and place
for the purpose of hearing and determining written protests filed
with the City Council prior to the hour set forth in said resolu-
tion; and
WHEREAS pursuant to the applicable provisions of the Government
Code, the City Clerk did publish notice and provide written notice
to all property owners in accordance with the law; and
WHEREAS on the 28th day of September, 1960, at the hour of 8: 30
o' clock P.M. , in the City Council Chambers, 3200 McCallum Way in
the City of Palm Springs, California, being the time and place
fixed for the hearing and determining of written protests, said
hearing and determination was had, evidence both written and oral
received, objections of all persons owning property within the
annexation area noted and accepted and passed upon; and pursuant
to Resolution No., 5986 said protests were found to be insufficient;
and
WHEREAS all proceedings required by the "Annexation of Uninhabited
Territory Act of 1939" were had and taken as described by said Act,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Pursuant to the "Annexation of Uninhabited Territory
Act of 193911, Section 35300 et seq. , of the Government Code of the
State of California, the boundaries of the. City of Palm Springs
shall be and hereby are altered, and the uninhabited territory
hereinafter described is hereby annexed to and incorporated within
and included in the City of Palm Springs:
A portion of Section 36, Township 3 South, Range 4 East, San
Bernardino Base and Meridian, Riverside County, California,
said portion more particularly described as follows:
Commencing at the Southwest corner of said Section 36, said
Southwest Corner being the point of beginning:
Thence from said point of beginning Easterly along the South
line of said Section 36 a 'distance of 3808.08 feet; thence
North 46043/ 2511 West a distance of 2624.74 feet; then North
51030/ 55/1 West a distance of 1920.94 feet; thence North 63
36135" West a distance of 450.97 feet to the West line of said
section 36; thence Southerly along said West section line a
distance of 3202.00 feet to the point of beginning.
SECTION 2. The annexation proceedings for the hereinabove
described land shall be complete upon the filing of a certified I
copy of this ordinance in the Office of the Secretary of State
of the State of California; and upon the effective date of this
ordinance the City Clerk is directed to file a certified copy of
same with the Secretary of State at Sacramento, California.
SECTION 3. City Councilmanic District No. 4, comprised and made
up of a combination of County precincts numbered 4, 25 and 35, is
hereby opened to permit the inclusion of the lands described herein
for the purpose of jurisdiction of the City and the voting qualifi-
cation of the qualified electors in the said described and annexed
territory.
SECTION 4. The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance and to cause the same to
be published once in the Desert Sun, a daily newspaper of general
circulation, printed, published and circulated in the City of Palm
Springs, California.
SECTION 5. This ordinance shall be in force and effect thirty
(30) days after passage.

WHEREAS, the City Council of the City of Palm Springs, California,
did on the 23rd day of November, 1960, by a vote of more than two-
thirds of the members of said City Council, adopt Resolution No. 6050,
entitled "Resolution of the City Council of the City of Palm Springs,
California, determing that the public interest and necessity demand
the acquisition and construction of a certain municipal improvement-,
and making findings relating thereto," which said resolution was duly
signed and approved by the Mayor of said city and attested and certi-
fied by the City Clerk of said city;
NOW, THEREFORE, the City Council of the City of Palm Springs,
California, DOES ORDAIN, as follows:
Section 1. That a special election be held, and the
same is hereby called to be held in the City of Palm Springs, California,
on the 14th day of March, 1961, for the purpose of submitting to the
qualified voters of said city a proposition of incurring indebtedness
and issuing bonds of said city therefor, in the amount hereinafter set
forth, and for the object and purpose set forth in said resolution and
hereinafter stated.
Section 2. That the object and purpose for which said
indebtedness is to be incurred and bonds issued therefor is as follows: I
The acquisition and construction of a certain
municipal improvement, to wit: a municipal airport
including lands and easements (including avigation
easements) within Sections 12 and 18, Township 4
South, Range 5 East, S,B.B,M. (within which is
located the present Palm Springs Airport) therefor,
and improvements including buildings, hangers, runway
surfaces and other improvements for airport purposes
and including any facilities, machinery, equipment and
other property necessary therefor, and including any
property of the present Palm Springs Airport except
the terminal building.
Section 3. That the estimated cost of said municipal
improvement is the sum of $3,000,000 and that the amount of the princi-
pal of the indebtedness to be incurred therefor is the sum of $3,000,000.
The estimated cost of said municipal improvement includes any or all of
the following: (a) legal or other fees incidental to or connected with
the authorization, issuance and sale of the bonds, and (b) the costs of
printing the bonds and other costs and expenses incidental to or connected
with the issuance and sale of the bonds.
Section 4. That the maximum rate of interest to be paid I
on the indebtedness incurred for the purpose stated in this ordinance
shall not exceed the maximum rate permitted by law, to wit, six per cent
(67.) per annum, payable annually for the first year and semi-annually
thereafter, the actual rate or rates of interest on said bonds to be
determined at or prior to the time of the sale or sales thereof.
Section 5. That if the proposition for the incurring of
bonded indebtedness so submitted receives the requisite number of
votes, to-wit, two-thirds of the votes of the qualified electors
voting on said proposition, bonds of said city in not exceeding the
principal amount stated in said proposition shall be issued and sold
for the object and purpose set forth in said proposition.
Section 6. That the polls for said election shall be
opened at seven o'clock A.M. , of the day of said election and
I shall remain open continuously from said time until seven o'clock
P.M. , of the same day, when said polls shall be closed, except as
provided in Section 5734 of the Elections Code of the State of
California.
Section 7. That on the ballots to be used at said
special election, in addition to any other matters required by law,
there shall be printed substantially the following:
