AMENDING ORDINANCE NO. 351 OF SAID CITY, TO PROVIDE
THAT THE COUNTY OF RIVERSIDE SIIALL RECEIVE FIVE PER
CENT (5n OF THE ONE PER CENT (1%) TAX COLLECTED ON
ALL RETAIL SALES IN THE CITY, BY AMENDING SECTIONS
2 (c) , 4(a) (1) , and 5(a) OF SAID ORDINANCE NO. 351.
THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY AS AN
URGENCY MEASURE. ORDINANCE NO. 406 OF SAID CITY IS
HEREBY REPEALED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS:
SECTION ONE. Section 2(c) of Ordinance No. 351 of the City of
Palm prings is hereby amended to read as follows:
"SECTION 2. PURPOSE :, ;: :, :,
(c) To adopt a sales and use tax ordinance which imposes a
ninety_five/one-hundredths of one percent (.95%) tax, and
I provides a measure therefor that can be administered and col-
lected by the State Board of Equalization in a manner that
adapts itself as fully as practical to, and requires the lease
possible deviation from, the existing statutory and administra-
tive procedures followed by the State Board of Equalization in
administering and collecting the California State Sales and Use
Taxes; "
SECTION TWO. Section 4(a) (1) of Ordinance No. 351 of the City
of Pam 8prings is hereby amended to read as follows:
"SECTION 4. SALES TAX.
(a) (1) For the privilege of selling tangible personal property
at retail a tax is hereby imposed upon all retailers in the city
at the rate of ninety-five/one hundredths of one percent (.95%)
of the gross receipts of the retailer from the sale of all tangible
personal property sold at retail in the City of Palm Springs on and I
after the operative date of this ordinance."
SECTION THREE. Section 5(a) of Ordinance No. 351 of the City of
Palm prsngsisTereby amended to read as follows:
"SECTION 5. USE TAX.
(a) An excise tax is hereby imposed on the storage, use, or other
consumption in the City of Palm Springs of tangible personal property
purchased from any retailer on or after the operative date of this
ordinance, for storage, use or other consumption in the city at the
rate of ninety-five/one hundredths of one percent. (.95%) of the
sales price of the property. The sales price shall include delivery
charges when such charges are subject to State sales or use tax re-
gardless of the place to which delivery is made. "
SECTION FOUR. EFFECTIVE TIME.
This ordinance shall become effective immediately and shall be
controlling through the period September 30, 1959; thereafter
the provisions of Ordinance No. 351, prior to amendment, shall
control the distribution of Sales and Use Tax receipts collected
by the State Board of Equalization, and provide a full one per
cent (1%) share to the City.
SECTION FIVE. URGENCY.
This or inance shall become effective immediately upon adoption,
after reading in full by the City Council as required by law, and
is adopted as an urgency revenue measure. The City has heretofore
entered into an agreement with the County and State for the col-
lection of Sales and Use Tax pursuant to the "Bradley-Burns Law."
In order to save the program, it is necessary for the City of
Palm Springs to reduce its share of the one percent (1%) Sales and
Use Tax authorized to ninety-five/one-hundredths of one percent
( .95n .
The City Clerk is hereby ordered and directed to certify to the
passage of this ordinance, and to cause the same to be published
once in The Desert Sun, a daily newspaper of general circulation,
printed, published and circulated in the City of Palm Springs,
California.
SECTION SIX. Ordinance No. 406 of said Cityis hereby repealed.

AUTHORIZING AND DIRECTING EXPENDITURE OF MONEY NOT TO
EXCEED $16,000 FOR THE EXCAVATION OF A WELL SITE AND
INSTALLATION OF WELL PUMPING EQUIPMENT IN THAT AREA
DEMARKED AS "AUTOMOBILE PARKING AREA" ON REVISED EX-
BIIL T "A-2" ATTACHED TO RESOLUTION NO. 5508; DECLARING
THE ORDINANCE AN URGENCY MATTER TO BECOME EFFECTIVE
IMMEDIATELY, AND STATING REASONS THEREFOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AS FOLLOWS:
SECTION 1. Heretofore and on March 4, 1959, the City of
Palm Springs did enter into an agreement with Westview Develop-
ment Corporation for the leasing with an option to purchase of
lands in Section 29, Township 4 South, Range 5 ,East, San Bernardino
Base and Meridian. Thereafter the said agreement was amended by
Resolution No. 5508, which said resolution had attached thereto
a revised' Exhibit A-2 showing, amongst other things, an area for
"automobile parking area." It is now necessary to drill a water
well and install pumping equipment on the said automobile parking
area heretofore referred to.
SECTION 2. The City Council of the City of Palm Springs,
California, does hereby expressly authorize the expenditure of
moneys not to exceed Sixteen Thousand Dollars ($16,000.00) for the
drilling of a water well and placement of pumping equipment pursuant
to plans and specifications developed by the Director of Public
Works. It is understood that the well site, together with speci-
fications for the pumping equipment and all other matters pertaining
thereto, shall be expressly under the direction of the Director of
Public Works. The City Manager is expressly authorized to sign a
contract, approved as to form by the City Attorney, to provide for
the well site construction.
SECTION 3. This ordinance is declared an urgency matter to
become effective immediately upon passage pursuant to the authority
of Government Code Section 36937. The leasehold interest of the
City consists of approximately 156 acres with a value in excess of
$170401000.00. It is absolutely necessary that the well be ex-
cavated and the pumping equipment installed in order to save the
golf course fairways and greens from destruction due to the hot
summner sun. .The general welfare of the people will not be served
by the loss of a major portion of the golf course turf for the
reason that the golf course would not by playable and the City
would suffer a severe loss of income from playing. For these
reasons, the ordinance is declared an urgency matter.
SECTION 4. This ordinance shall be effective immediately
upon reading and adoption by the majority of the City Council
required by law.
SECTION 5. The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the same
to be published once in THE DESERT SUN, a daily newspaper of
general circulation, printed, published and circulated in the

thoroughfares for the said Section 30, and all building permits and
construction permits shall adhere to and be in accordance with the
provisions of the referred to plat for Section 30 on file in the
Office of the Planning Director.
SECTION 2. URGDQCY ORDINANCE. This ordinance is declared to
be an urgency measure and shall become effective immediately upon
passage within the authority granted by Government Code Section 36937.
The reasons for urgency are that Section 30, Township 4 South, Range
5 East, S.B.B.& M. , has recently been annexed to the City of Palm
Springs. Pursuant to annexation the City Council has held hearings
and has imposed upon tIw said Section 30 zoning considered adequate
by the City Council. Adequate zoning, however, is not sufficient
in that proper setbacks from streets or thoroughfares cannot be
ascertained without the imposition of a street or thoroughfare plan
upon the section of land annexed. In order to assure a uniform
development of setbacks from street frontage and to provide for the
development of orderly ingress and egress and to provide an ultimate
proper width for State IIighway 111, this ordinance is adopted as an
urgency measure. Traffic safety within the annexed section is not
furthered nor enhanced by lengthy consideration of an immediate
pressing matter. Building permits have been applied for and the
' street plan is urgently needed at the present time.
SECTION 3. EFFECTIVE DATE. This ordinance shall be effective
immediately upon reading and adoption by the majority of the City
Council required by law.
SECTION 4. PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to cause
the same to be published once in TIE DESERT SUN, a daily newspaper

AN ORDINANCE OF THE CITY OF PALM SPRINGS FIXING
THE AMOUNT OF MONEY TO BE RAISED BY TAXATION FOR
THE FISCAL YEAR BEGINNING JULY 1, 1959
The City Council of the City of Palm Springs does hereby ordain,
as follows:
SECTION 1. The amount of money necessary to be raised by
taxation upon the taxable property within the City of Palm Springs as
a revenue to carry on the various departments of such City and to pay
the bonded and other indebtedness of the City for the fiscal year
beginning July 1, 1959, is hereby fixed as follows:
a) For the carrying on the various departments on the City
other than herein stated, the sum of Five Hundred Forty-two Thousand
Eight Hundred Forty-four Dollars ($542,844) .
b) For the maintenance and operation of park and recreation
facilities of the City of Palm Springs, said maintenance and operation
not otherwise being provided for, the sum of Seventy-two Thousand
Seven Hundred Forty-eight Dollars ($72,748) .
c) For the purpose of providing and maintaining parks and
music and for advertising purposes, to be used and expended for such
purposes in accordance with Ordinance No. 192 of the City of Palm
Springs, the sum of Seventy-four Thousand One Hundred Eight-five
Dollars ($74,185) .
d) For the maintenance and support and purchase of property
necessary for the public library, known as the Welwood Murray Memorial
Library of the City of Palm Springs, the maintenance of said public
library not being otherwise provided for, the sum of Sixty Thousand
Two Hundred Nineteen Dollars ($60,219) .
e) For the maintenance and operation of the sewage disposal
system, the sum of Nineteen Thousand Three Hundred and Five Dollars
($19,305) .
f) As concerns the bond, issuance of which was authorized at
the special election held February 14, 1956 for the municipal improve-
ment consisting of street lights and trees, for the purpose of paying
annual interest thereon as same became due, and also the principal
as same shall become due, the sum of Ten Thousand Five Hundred Twenty-
six Dollars ($10,526) .
g) As concerns the bond, issuance of which was authorized at
the special election held February 14, 1956 for the municipal street
improvement of McCallum-Tahquitz, for the purpose of paying annual
interest thereon as same became due and also the principal as shall
become due, the sum of Eleven Thousand Twenty-eight Dollars ($11,028) .
h) As concerns the bonds, issuance of which was authorized at
the special election held April 26, 1949 for the purpose of paying'
the annual interest thereon as the same became due , and also the
principal as same shall become due, the sum of Sixty Thousand One
Hundred Fifty-eight Dollars ($60,158) .
i) For the purpose of financeing the City' s share of the
employees retirement plan for the current fiscal year, the sum of
Sixty-three Thousand Three Hundred Eight Dollars ($63,308) .
SECTION 2. The amount of money necessary to be raised by
taxation and as provided by this ordinance has been established
pursuant to a budget prepared by the City Manager and approved by
resolutions of the City Council, in accordance with the require-
ments of the "Palm Springs Ordinance Code." Pursuant to the
authority granted by the statutes of the State of California, the
budget referred to is hereby adopted, and items for purchase pro-
? vided for by such budget may be purchased by the Director of
JFinance prior to audit by the City Council.
SECTION 3. This is an ordinance fixing the amounts of money
to be raised by taxation. The City Council therefore determines
and declares that the same shall be effective immediately by
authority of the provisions of Section 36937 of the Government
Code of the State of California.

'MUNICIPAL IMPROMIENT BONDS, 1959, CONSTRUCTION FUND,'
and the moneys in said fund shall be applied exclusively to the
acquisition and construction of the municipal improvement described
in the bond proposition in the recitals hereof, except as provided
in Section 43628 of the Government Code.
SECTION 4. That any premium or accrued interest received from
the sale of said bonds shall forthwith be turned over to and placed
in said treasury in the interest and redemption fund hereinafter
created. That for the purpose of paying the principal and interest
of said bonds, the City Council of the City of Palm Springs shall at
the time of fixing the general tax levy, and annually thereafter
until said bonds are paid or until there is a sum in the treasury
of said city set apart for that purpose sufficient to meet all
payments of principal and interest on said bonds as they become
due, levd and collect a tax sufficient to pay the interest on said
bonds as it falls due and such part of the principal thereof as
will become due before the proceeds of a tax levied at the next
general tax levy will be available. Said tax shall be in addition
to all other taxes levied for municipal purposes and shall be levied
and collected as other city taxes, and shall forthwith be turned
over and paid into a fund of the city to be known as
"MUNICIPAL IMPROVEMENT BONDS, 1959,
INTEREST AND REDEMPTION FUND. "
Said fund shall be used for no other purpose than the payment of

AMENDING ORDINANCE NO. 351 OF SAID CITY TO PROVIDE
THAT THE COUNTY OF RIVERSIDE SHALL RECEIVE FIVE PER
CENT (5%) OF THE ONE PER CENT (1%) TAX COLLECTED ON
ALL RETAIL SALES IN THE CITY, BY AMENDING SECTIONS

SECTION ONE. Section 2(c) of Ordinance No. 351 of the City of
Palm pri�'ngsiss hereby amended to read as follows:
"SECTION 2. PURPOSE:: a: ar
(c) To adopt a sales and use tax ordinance which imposes
a ninety-five/one-hundredths of one per cent ( .95%) tax,
and provides a measure therefor that can be administered
and collected by the State Board of Equalization in a
manner that adapts itself as fully as practical to, and
requires the lease possible deviation from, the existing
statutory and administrative procedures followed by the
State Board of Equalization in administering and collecting
the California State Sales and Use Taxes;"
SECTION TWO. Section 4 (a) (1) of Ordinance No. 351 of the
City of Palm Springs is hereby amended to read as follows:
I "SECTION 4. SALES TAX.
(a) (1) For the privilege of selling tangible personal
property at retail a tax is hereby imposed upon all re-
tailers in the city at the rate of ninety-five/one- hundredths
of one per cent ( .95°o of the gross receipts of the retailer
from the sale of all tangible personal property sold at
retail in the City of Palm Springs on and after the operative
date of this ordinance."
SECTION THREE. Section 5(a) of Ordinance No. 351 of the City of
Palm prin�"gs i-s hereby amended to read as follows:
"SECTION 5. USE TAX.
(a) An excise tax is hereby imposed on the storage, use or
other consumption in the City of Palm Springs of tangible
personal property purchased from any retailer on or after
the operative date of this ordinance, for storage use or
other consumption in the city at the rate of ninety-five/one-
hundredths of one per cent. ( .95%) of the sales price of the
property. The sales price shall include delivery charges
when such charges are subject to State sales or use tax
regardless of the place to which delivery is made."
SECTION FOUR. EFFECTIVE TIME.
This ordinance shall become effective immediately and shall be
controlling through the period June 30, 1960; thereafter the provisions
of Ordinance No. 351, prior to amendment and providing for a full one
per cent (1%) sales and use tax imposition, shall control the distribution
of Sales and Use Tax receipts collected by the State Board of Equalization.
SECTION FIVE. URGENCY.
This ordinance shall become effective immediately upon adoption,
after reading in full by the City Council as required by law, and is
adopted as an urgency revenue measure. The City has heretofore entered
into an agreement with the County and State for the collection of Sales
and Use Tax pursuant to the "Bradley-Burns Law." In order to safeguard
the program, it is necessary for the City of Palm Springs to reduce its
share of the one per cent (1%) Sales and Use Tax authorized to ninety-
five/one-hundredths of the one per cent ( .95%) .
The City Clerk is hereby ordered and directed to certify to the
passage of this ordinance, and to cause the same to be published once
in the Desert Sun, a daily newspaper of general circulation, printed,
published and ciruclated in the City of Palm Springs, California.
SECTION SIX. Ordinance No. 426 of said City is hereby repealed.

PURSUANT TO THE "ANNEXATION OF UNINILABITED
TERRITORY ACT OF 1939, " SECTIONS 35300 ET SEQ.
OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA;
SAID LANDS BEING GENERALLY DESCRIBED AS A PORTION
' OF SECTION 29 AND ALL OF SECTION 20, TOWNSHIP 4
SOUTH, RANGE 5 EAST, S.B.B.& M. , IN THE COUNTY

WHEREAS the "Annexation of Uninhabited Territory Act of 1939, "
Sections 35300 et seq. of the Government Code of the State of
California, provides for the alteration of boundaries of in-
corporated towns or cities by the annexation of uninhabited
territory thereto, and for the incorporation of such annexed
territory into and as a part of the annexing city, and for
the opening of councilmanic districts for the purpose of in-
clusion of the lands annexed; and
WHEREAS the City Council of the City of Palm Springs on the
13th day of May, 1959, by Resolution No. 5460, initiated pro-
ceedings on its own motion and pursuant to the said above re-
ferred to Annexation Act, to alter the boundaries of said City
and to incorporate and include in said City uninhabited territory
within the boundaries of said City hereinafter specifically de-
scribed; and
WHEREAS the said territory was determined to be uninhabited
territory under the provisions of the referred to State Annexation
Act, and pursuant to the affidavits of the County Elections Clerk
that there are no registered voters residing within the entire
annexation area; and
WHEREAS in Resolution No. 54602 the City Council commenced the
proceedings for annexation, it did set forth the reasons for
annexation, the same being:

1. The City has recently consummated a lease involving the
lands in Section Twenty-Nine (29) , Township Four (4)
South, Range Five (5) East, San Bernardino Base & Meridian,
to be annexed, and it is desirable that the City' s lease-
hold interest be within the corporate limits of the City.
2. Section Twenty (20) , Township Four (4) South, Range Five
(5) East, San Bernardino Base & Meridian , lies directly,
to the East of the City and abuts'Ramon Road, a major
thoroughfare. The orderly development of this section
requires annexation so that the said Section 20 will be
developed pursuant to the regulatory ordinances of the City.
WHEREAS the said Resolution No. 5460 set forth the time and place
for the purpose of hearing and determining written protests filed
with the City Council prior to the hour set forth in said resolution;
and
WHEREAS pursuant to the applicable provisions of the Government
Code, the City Clerk did publish notice and provide written notice
to all property owners in accordance with the law; and
WHEREAS on the 24th day of June , 1959, at the hour of 8:15 o' clock
P.M. , in the City Council Chambers., 3200 McCallum Way in the City of
Palm Springs, California, being the time and place fixed for the
hearing and determining of written protests, said hearing and
determination was had, evidence both written and oral received,
objections of all persons owning property within the annexation
area noted and accepted and passed upon; and pursuant tD Resolution
No. 5612, said protests were found to be insufficient; and
WHEREAS all proceedings required by the "Annexation of Uninhabited '
Territory Act of 1939" were had and taken as prescribed by said Act,
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Pursuant to the "Annexation of Uninhabited Territory
Act of 193911, Section 35300 et seq. of the Government Code of the State
of California, the boundaries of the City of Palm Springs shall be and
hereby are altered, and the uninhabited territory hereinafter described
is hereby annexed to and incorporated within and included in the City
of Palm Springs:
Section 20 and portion of Section 29, Township 4 South,
Range 5 East, San Bernardino Base & Meridian, more
particularly described as follows:
Beginning at the Northeast corner of Section 19; T4S,
R5E, thence Easterly along the South line of Section 17,
T4S, R5E, to the Northwest corner of Section 21, T4S,
R5E; thence Southerly along the West line of said
Section 21 to the Southwest corner of said Section 21;
thence Westerly along the North line of Section 29,
T4S, R5E, a distance of 661.55 feet, more or less,
to the Northwest corner of Crossley Tract, as recorded
in Map Book 32, page 44, Records of Riverside County;
thence Southerly along the West line of the Northeast
quarter of said Section 29; thence Westerly along the
South line of said Northeast Quarter to the Northwest
Corner of the Southeast quarter of said Section 29,
said corner being the center quarter corner; thence
Southerly along the West line of said Southeast quarter
to the Southerly right-of-way line of State Highway 111;
thence Northwesterly along said Southerly right-of-way
line to the East line of Section 30, Township 4 South,
Range 5 East; thence Northerly along said East line of

Township 4 South, Range 5 East, to the point of
beginning, excluding that portion of Lot 21, Palm
Valley Colony Lands as recorded in Map Book 14,
Page 652, records of San Diego County, State of

SECTION 2. The annexation proceedings for the hereinabove
described land shall be complete upon the filing of a certified
copy of this ordinance in the Office of the Secretary of State
of -the State of California; and upon the effective date of this
ordinance the City Clerk is directed to file a certified copy of
same with the Secretary of State at Sacramento, California.
SECTION 3. City Councilmanic District No. 1, comprised and
made up of a combination of County precincts numbered 1, 8, 12, 13,
14, L5, 17, 18, 19 and 20, is hereby opened to permit the inclusion
of the lands described herein for the purpose of jurisdiction of the
City and the voting qualification of the qualified electors in the
said described and annexed territory.
SECTION 4. ZONING. The City Council does hereby impose upon
the lands described in Section 1 above Guest Ranch zoning with the
rights and limitations pursuant thereto and as set forth in Division 9
of the "Palm Springs Ordinance Code" The Guest Ranch District zoning
provided by this Section is "temporary interim zoning" as provided for
by Section 65806 of the Government Code of the State of California.
SECTION 5. The City Clerk is hereby ordered and directed to
certiTy-77777passage of this ordinance and to cause the same to be
published once in The Desert Sun, a daily newspaper of general cir-
culation, printed, published and circulated in the City of Palm Springs,

AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ADDING SECTION 2289.01 TO DIVISION 2 OF THE "PALM
SPRINGS ORDINANCE CODE" TO PROVIDE FOR THE ISSUANCE
OF STAMPS OR LABELS FOR VENDING MACHINES; PROVIDING
THIS TO BE AN URGENCY ORDINANCE AND REASONS THEREFOR

I, the undersigned, City Clerk of the City of Palm Springs, California,
hereby certify that the foregoing Ordinance, being Ordinance No. 451, I
of the City of Palm Springs, was adopted as as urgency measure at a
meeting of the City Council of said City held on the 23rd day of
December, 1959, after having been read in full. Said Ordinance shall
become effective immediately and was so adopted by the following
vote:
