ORDINANCE NO. 372
I AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF
A SPECIAL ELECTION TO BE HELD IN THE CITY OF PALM SPRINGS
ON THE 29TII DAY OF APRIL, 1958, FOR THE PURPOSE OF SUB-
MITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION
TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN
MUNICIPAL IMPROVEMENT
WHEREAS, the City Council of the City of Palm Springs, California,
did on the 11th day of February, 1958, by a vote of more than two-thirds
of the members of said City Council, adopt Resolution No, 5007, entitled
"Resolution of the City Council of the City of Palm Springs, California,
determining that the public interest and necessity demand the acquisition
and construction of a certain municipal improvement, and making findings
relating thereto, " which said resolution was duly signed and approved by
the Mayor of said city and attested and certified by the City Clerk of
said City;
NOW, THEREFORE, the City Council of the City of Palm Springs, California,
DOES ORDAIN as follows:
Section 1. That a special election be held, and the same is hereby
called to be held, in the City of Palm Springs, California, on the 29th
day of April, 1958, for the purpose of submitting to the qualified voters
of said city a proposition of incurring indebtedness and issuing bonds
of said city therefor, in the amount hereinafter set forth, and for the
object and purpose set forth in said resolution and hereinafter stated.
Section 2. That the object and purpose for which said indebtedness
is to be incurred and bonds issued therefor is as follows:
The acquisition and construction by the City of Palm Springs of
a certain municipal improvement, to wit: additions to the sanitary
sewage collection, treatment and disposal system of said city, con-
sisting of interceptor, collection and trunk sewers, pumping stations
and sewage treatment plant and effluent discharge line , and Including
for the foregoing appurtenances and appurtenant work and the acquisition
of all land, easements, pipe, pumps, machinery and other property
necessary therefore.
Section 3. That the estimated cost of said municipal improvement
is the sum of $1,550,000 and that the amount of the principal of the I
indebtedness to be incurred therefor is the sum of $1,550,000. The
estimated cost of said municipal improvement includes any and all of
the following: (a) legal or other fees incidental to or connected
with the authorization, issuance and sale of bonds, and (b) the costs
of printing the bonds and other costs and expenses incidental to or
connected with the issuance and sale of the bonds.
Section 4. That the maximum rate of interest to be paid on the
indebtedness incurred for the purpose stated in this ordinance shall
not exceed the maximum rate permitted by lair, to wit, six per cent
(6%) per annum, payable annually for the first year and Semi-annually
thereafter, the actual rate or rates of interest on said bonds to be
determined at or prior to the time of the sale or sales thereof.
Section 5. That if the proposition for the incurring of bonded
indebtedness so submitted receives the requisite number of votes,
to wit, two-thirds of the votes of the qualified electors voting on
said proposition, bonds of said city in not exceeding the principal
amount stated in said proposition shall be issued and sold for the
object and purpose set forth in said proposition.
Section 6. That.the polls for said election shall be opened
at seven o' clock A.M. , of the day of said election and shall remain
open continuously from said time until seven o'clock P.M. , of the
same day, when said polls shall be closed, except as provided in I
Section 5734 of the Elections Code of the State of California.
Section 7. That on the ballots to be used at said special
election, in addition to any other matters required by law, there
shall be printed substantially the following:
MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH
PIN OR PENCIL.
(ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INI{ OR PENCIL.)
INSTRUCTIONS TO VOTERS
To vote on any measure, stamp a cross (+) in the voting
square after the word "YES" or after the word "NO". All
marks,except the cross (+) are forbidden. All distinguishing
marks or erasures are forbidden and make the ballot void.
If you wrongly stamp, tear or deface this ballot, return
it to the inspector of election and obtain another.
On absent voter ballots mark a cross (+) with pen or pencil.
BOND PROPOSITION: Shall the City I
of Palm Springs incur a bonded indebtedness
in the principal sum of $1,550,000 for the
acquisition and construction by said city
of a certain municipal improvement, to wit: YES

1 Section 8. A cross (+) placed in the voting square after the
word °YES" in the manner hereinbefore provided shall be counted in
favor of the adoption of the proposition. A cross (+) placed in the
voting square after the word '!NO" in the manner hereinbefore provided
shall be counted against the adoption of the proposition.
Section 9. That for the purpose of holding said special election
there shall be and are hereby established sir. (6) voting precincts
designated as hereinafter stated. Each such voting precinct shall
consist of a consolidation of regular election precincts in the City
of Palm Springs (of the numbers hereinafter stated) established for
the holding of state and County elections, as said regular election
precincts exist on the date of adoption of this ordinance. That the
polling places for the respective precincts shall be the places here-
inafter designated; and that the persons hereinafter named, being
competent and qualified electors and residents of said city and of
their respective voting precincts, are hereby appointed officers of
election for their respective voting precincts and they shall hold
said election and make return thereof in the manner provided by law.
Voting precinct 1 shall consist of regular election precincts
3, 4 and 10.

Section 11. That the City Council of said city shall meet at its
usual place of meeting in the City Hall on Tuesday, the 6th day of May, 1958,
at 8:00 o'clock p.m. , of said day, and proceed to canvass the election
returns and declare the result of said election.
Section 12. That the City Clerk shall certify to the passage and
adoption of this ordinance by a vote of more than two-thirds of all of
the members of the City Council of said city, and shall cause this
ordinance to be published on,cea week for two (2) weeks in the DESERT SUN,
a newspaper of general circulation, printed and published less than
six (6) days a week in said city. No other notice of such election need I
be given.
Section 13. This ordinance shall take effect upon its adoption.

1 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ANNEXING INHABITED TERRITORY PURSUANT TO "ANNEXATION
ACT OF 191311, SECTIONS 35100 et seq, OF THE GOVERNMENT
CODE OF THE STATE OF CALIFORNIA, AND SPECIFICALLY
DESCRIBED IN THE BODY OF THIS ORDINANCE; PROVIDING A
COMPLETION DATE OF THE ANNEXATION PROCEEDINGS; PROVIDING
THAT THE PROPERTY WITHIN TILE TERRITORY ANNEXED SHALL BE
SUBJECT TO TAXATION EQUALLY WITH PROPERTY WITHIN THE
EXISTING CITY OF PALM SPRINGS, THE SAID ANNEXED PROPERTY
TO PAY ITS PRO RATA PORTION, BASED UPON ASSESSED VALUA-

WHEREAS the City Council of the City of Palm Springs, California,
did receive a written petition in proper form from residents,
registered and qualified electors, asking that certain inhabited
territory contiguous to the City be annexed to said City; and
WHEREAS pursuant to the proceedings for the annexation of inhabited
territory, "Annexation Act of 191311, Sections 35100 et seq. , of the
Government Code of the State of California, it was determined that:
a) The petition was properly signed by not less
than one-fourth of the qualified electors residing
within the territory to be annexed and described
in the petition;
b) That the territory was directly contiguous to
the Southeasterly boundaries of the City and was
not a portion of another city;
c) That more than twelve qualified electors did
reside within the boundaries of the territory
and therefore that the said territory was
"inhabited" within the meaning of the Government
Code of this State; and
WHEREAS the City Council did adopt its Resolution No. 4821 declaring
its intention to call a special election after hearing of protests; and
WHEREAS on the 27th day of November, 1957, the City Council did hear
all written protests, and said protests being insufficient did overrule I
same at an adjourned meeting held December 11, 1957; and
WHEREAS thereafter the City Council did adopt Resolution No. 4959
calling a special election on the subject of whether the herein-
after described territory should be annexed to said City; said
resolution describing in particular the proceedings up to the date
of passage; and
WHEREAS the City Council did provide for the conduct of an election
on February 18, 1958, at a polling place within the said territory,
all in accordance with the applicable provisions of the Government
Code and the Elections Code of this State; and
WHEREAS on February 25, 1958, the City Council did canvass the ballot
of the Annexation Election, and did determine that there were 43 "Yes"
votes, 7 "No" votes, total voting - 50; total registered - 64; no
absentee ballots; and did therefore declare the election by the voters
within the territory to be annexed to have been passed;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. The territory annexed by this ordinance, and pursuant
to the proceedings referred to hereinabove in the !'WHEREAS" clauses,
is described as follows:
Section Thirty (30), Township Four (4) South, Range Five (5)
East, S.B.B.& M. , in the County of Riverside, State of California,
more particularly described as follows:
Commencing at the Southeast corner of Section Nineteen (19), Town-
ship Four (4) South, Range Five (5) East, S.B.B.& M. , thence Easterly
along the Southerly section line of said Section 19 a distance of
one (1) mile, more or less, to the Southeast corner of said Section
19; thence Southerly along the Westerly section line of Section
Twenty-Nine (29), Township Four (4) South, Range Five (3) East,
S.B.B.& M. , a distance of one (1) mile more or less, to the South-
east corner of said Section 29; thence Westerly along the Northerly
section. line of Section Thirty-One (31), Township Four (4) South,
Range Five (5) East, S.B.B.& M. , a distance of one (1)
mile, more or less, to the Northwest corner of said Section
31; thence Northerly a distance of one (1) mile, more or
less, to the point of beginning.
SECTION 2. The annexation proceedings for the hereinabove
described section of land shall be complete upon the filing of a
certified copy of this ordinance in the office of the Secretary of
State of the State of California; and, upon the effective date of
I this ordinance, the City Clerk is directed to file a certified copy
of same with the said Secretary of State.
SECTION 3. The territory described herein shall, upon the
effective date provided in the last section, be subject to taxation
equally with property within the presently existing City of Palm
Springs, to pay its pro rata portion, based upon assessed valuation,
of all of the bonded indebtedness of the City, together with the
bonded indebtedness heretofore authorized at the date of the first
publication of the Notice of Election, said date of the first pub-
lication being December 16, 1957.
SECTION 4. City Councilmanic District No. 1, comprised and
made up of a combination of County Precincts numbered 1,8,12,13,
14,15 and 17, is hereby opened to permit the inclusion of the
lands described herein for the purpose of jurisdiction of the City
and voting qualification of the qualified voters in the said
described and annexed territory.
SECTION 5. The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance, and to cause the same
to be published once in The Desert Sun, a daily newspaper of general
circulation, printed, published and circulated in the City of Palm
Springs, California.
This ordinance shall be in full force and effect thirty (30) days
after passage.

ANNEXING UNINHABITED TERRITORY PURSUANT TO THE
"ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939"7
SECTIONS 35300, ET SEQ. , OF THE GOVERNMENT CODE OF
THE STATE OF CALIFORNIA; SAID LANDS BEING GENERALLY
DESCRIBED AS SECTIONS 34 AND 35, TOWNSHIP 4 SOUTH,
RANGE 4 EAST, S.B.B.& M. , IN THE COUNTY OF RIVERSIDE,
STATE OF CALIFORNIA, AND MORE FULLY HEREINAFTER
DESCRIBED.
WHEREAS the "Annexation of Uninhabited Territory Act of 193911,
Sections 35300, et seq. , of the Government Code of the State of
California, provides for the alteration of boundaries of incor-
porated towns or cities by the annexation of uninhabited territory
thereto, and for the incorporation of such annexed territory into
and as a part of the annexing city, and for the opening of council-
manic districts for the purpose of inclusion of the lands annexed;
and
WHEREAS the City Council of the City of Palm Springs on the llth day
of February, 1958, by Resolution 5005 initiated proceedings on its
own motion and pursuant to the said above referred to Annexation Act,
to alter the boundaries of said City and to incorporate and include
in said City uninhabited territory within the boundaries of said
City hereinafter specifically described; and
WHEREAS the said territory was determined to be uninhabited terri-
tory under the provisions of the referred to State Annexation Act,
and pursuant to the affidavits of the County Elections Clerk that
there are no registered voters residing within the entire annexa-
tion area; and
WHEREAS in Resolution No. 5005, the City Council commenced the
proceedings for annexation, it did set forth the reasons for annex-
ation, the same being:
1. A metropolitan area is developing outside the present
limits of the City, and the people in these areas are
using City facilities without contributing to the cost
or maintenance of City facilities;
2. It is likely that uninhabited territory hereinafter
described Trill develop and the City will be in a posi-
tion to offer municipal services such as police, fire,
waste disposal, building regulation and planning ser-
vices to the territory, thus assuring a proper growth
to the territory to the mutual benefit of both the
territory and the City; and
WHEREAS the said Resolution No. 5005 set forth the time and place
for the purpose of hearing and determining written protests filed
with the City Council prior to the hour set forth In said resolution;
and
WHEREAS pursuant to the applicable provisions of the Government Code,
the City Clerk did publish notice and provide written notice to all
property owners in accordance with the law; and
WHEREAS on the 26th day of March, 1958, at the hour of 8:15 o'clock
P.M. , in the City Council Chambers, 3200 McCallum Way in the City of
Palm Springs, California, being the time and place fixed for the
hearing and determining of written protests, said hearing and deter-
mination was had, evidence both written and oral received, objections
of all persons owning property within the annexation area noted and
accepted and passed upon; and pursuant to Resolution No. 5041 said
protests were found to be insufficient; and
WHEREAS all proceedings required by the "Annexation of Uninhabited I
Territory Act of 1939" were had and taken as prescribed by said Act,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Pursuant to the "Annexation of Uninhabited Territory
Act of 193911, Section 35300, et seq. , of the Government Code of the
State of California, the boundaries of the City of Palm Springs shall
be and hereby are altered, and the uninhabited territory hereinafter
described is hereby annexed to and incorporated within and included in
the City of Palm Springs:
Sections Thirty-Four (34) and Thirty-Five (35), Township Four (4) South,
Range Four (4) East, S.B.B.& M. , in the County of Riverside, State of
California, more particularly described as:
Beginning at the Southwest corner of Section 27, T4S, R4E, SBB&M;
thence Easterly along the South section line of Sections 27 and
26, T4S, R4E3 SBB&M, a distance of two (2) miles, more or less,
to the Northwest corner of Section 36, T4S, R4E, SBB&M; thence
Southerly along the West section line of said Section 36 a dis-
tance of one (1) mile, more or less, to the Southwest corner of
said Section 36; thence Westerly along the South township line
of Township 4 South, Range 4 East, SBB&M, a distance of two
(2) miles, more or less, to the Southeast corner of Section 33,
T4S, R4E, SBB&M; thence Northerly along the East section line of
said Section 33 a distance of one (1) mile, more or less, to the
point of beginning.
SECTION 2. The annexation proceedings for the hereinabove
described land shall be complete upon the filing of a certified
copy of this ordinance in the Office of the Secretary of State of
the State of California; and upon the effective date of this ordin-
ance the City Clerk is directed to file a certified copy of same
with the Secretary of State at Sacramento, California.
SECTION 3. City Counci]manic District No. 1, comprised and
made up of a combination of County precincts numbered 1, 8, 12,
137 14, 15 and 17, is hereby opened to permit the inclusion of the
lands described herein for the purpose of jurisdiction of the City
and the voting qualification of the qualified electors in the said
described and annexed territory.
SECTION 4. The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance and to cause the same to
be published once in The Desert Sun, a daily newspaper of general
circulation, printed, published and circulated in the City of
Palm Springs, California.

THE AMOUNT OF MONEY TO BE RAISED BY TAXATION FOR
THE FISCAL YEAR BEGINNING JULY 1, 1958
The City Council of the City of Palm Springs does hereby ordain as

Section 1. The amount of money necessary to be raised by taxation
upon the taxable property within the City of Palm Springs as a revenue
to carry on the various departments of such City and to pay the bonded
and other indebtedness of the City for the fiscal year beginning
July 1, 1958 is hereby fixed as follows:
a) For the carrying on the various departments of the City
other than 'therein stated, the sum of Four Hundred Forty
Four Thousand One Hundred Twenty Three Dollars ($444,123) .
b) For the maintenance and operation of Park facilities of
the City of Palm Springs, said maintenance and operation not
otherwise being provided for, the sum of Seventeen Thousand
Seven Hundred Forty Four Dollars ($17,744) .
c) For the purpose of providing and maintaining parks and
music and for advertising purposes, to be used and expended
for such purposes in accordance with Ordinance No. 192 of
the City of Palm Springs, the sum of Sixty Four Thousand
One Hundred Sixty Dollars ($64,160) .
d) For the maintenance and support and purchase of property
I necessary for the public library, known as the Welwood Murray
Memorial Library of the City of Palm Springs, the maintenance
of said public library not being otherwise provided for, the
sum of Fifty Five Thousand and Nine Dollars ($55,009) .
e) As concerns the bonds, issuance of which was authorized at
the special election held April 29, 1958 for the purpose of
paying annual interest thereon as same became due and also the
principal as same shall become due, the sum of Ninety One
Thousand, Nine Hundred and Nine Dollars ($91,909) .
f) As concerns the bonds, issuance of which was authorized at
the special election held April 26, 1949 for the purpose of
paying the annual interest thereon as the same became due,
and also the principal as same shall become due, the stun of
Fifty Eight Thousand, Six Hundred Forty Six Dollars ($58,646) .
g) For the purpose of financing the City's share of the employees
retirement plan for the current fiscal year, the sum of Sixty
Six Thousand, Five Hundred Ninety Six Dollars ($66,596) .
Section 2. This is an ordinance fixing the amounts of money to be
raised by taxation. The City Council therefore determines and declares
that the same shall be effective immediately by authority of Section 36937
of the Govermnent Code of the State of California.
Section 3. The City Clerk is hereby ordered and directed to certify
to the passage of this ordinance and to cause the same to be published
once in the Desert Sun, a newspaper of general circulation, printed,

CALIFORNIA, REPEALING ORDINANCE NO. 381
OF SAID CITY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AS FOLLOWS:
WHEREAS, heretofore the City Council did commence Uninhabited I
Territorial Annexation proceedings pursuant to Resolution No. 5034, to
annex as uninhabited territory the lands situate in the County of
Riverside, State of California, described as follows:
The Southeast one-quarter of Section 34, and the
West one-half of Section 35, Township 3 South,
Range 4 East, S.B.B.& M. , and
WHEREAS, the Superior Court of Riverside County has determined that
the area is inhabited in that there are more than twelve registered
voters residing in the hereinabove described territory,
WHEREAS, with twelve or more voters in the area for annexation it
is necessary that the people within the district initiate inhabited
territorial annexation proceedings,
NOW THEREFORE BE IT RESOLVED:
SECTION 1. That the City Council of the City of Palm Springs,
California, does hereby repeal Ordinance No. 381,
enacted for the purpose of uninhabited territorial
annexation.
SECTION 2. The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance, and to
cause the same to be published once in the DESERT
SUN, a newspaper of general circulation printed,
published and circulated in the City of Palm Springs,
California.
This ordinance shall b e effective thirty (30)

OF THE ONE PER CENT. (1%) TAX COLLECTED ON ALL RETAIL
SALES IN THE CITY, BE AMENDING SECTIONS 2(c) , 4(a) (1) ,
AND 5(a) OF SAID ORDINANCE NO. 351. THIS ORDINANCE SHALL
TAKE EFFECT AS AN URGENCYMEASURE AND BECOME EFFECTIVE
JANUARY 1, 1959.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AS FOLLOWS:
SECTION ONE. Section 2(c) of Ordinance No. 351 of the City of
Palm prangs is hereby amended to read as follows:
I "SECTION 2.
(c) To adopt a sales and use tax ordinance which
imposes a ninety-five/one-hundredths of one percent
(.95%) tax, and provides a measure therefor that
can be administered and collected by the State Board
of Equalization in a manner that adapts itself as
fully as practical to, and requires the least poss-
ible deviation from the existing statutory and

of Equalization in administering and collecting the
California State Sales and Use Taxes; "
SECTION WO. Section 4 (a) (1) of Ordinance No. 351 of the
City o Palm Springs is hereby amended to read as follows:
"SECTION 4. SALES TAX.
(a) (1) For the privilege of selling tangible
personal property at retail a tax is hereby imposed
upon all retailers in the city at the rate of ninety-
vie/one hundredths of one percent. ( .95%) of the gross
receipts of the retailer from the sale of all tangihle
personal property sold at retail in the City of Palm
Springs on and after the operative date of this
ordinance. "
SECTION THREE. Section 5(a) of Ordinance No. 351 of the City
of Pa prings is hereby amended to read as follows:
"SECTION 5. USE TAX.
(a) An excise tax is hereby imposed on the storage,
use, or other consumption in the City of Palm Springs
of tangible personal property purchased from any
retailer on or after the operative date of this
ordinance, for storage, use or other consumption in
the city at the rate of ninety-five/one hundredths of
one per cent. ( .95°, of the sales price of tkr_ property.
The sales price shall include delivery charges when
such charges are subject to State sales or use tax
regardless of the place to which delivery is made."
SECTION FOUR. Effective Time.
'IF s or finance s a e e ective from the period January 1, '
19592 to and including June 30, 1959; thereafter the provisions
of Ordinance No. 351, herein amended, shall control the distribu-
tion of Sales and Use Tax receipts collected by the State Board
of Equalization, and provide a full one per cent. (1%) share to
the City.
SECTION FIVE. Urgency.
This or finance s7iaTlTecome effective January 1, 1959,
after reading and adoption by the majority of the City Council
as required by law, and is adopted as an urgency revenue measure.
The City has heretofore held its budget hearings and adopted a
budget which contemplates the use of revenues collected from Sales
and Use Taxes to pay its ordinary and current expenses. The City
has also entered into an agreement with the County and State for
the collection of Sales and Use Tax under the "Bradley-Burns Law".
In order to save the program, it is necessary for the City of Palm
Springs to reduce its share of the 1% Sales and Use Tax collected
to .95%. This measure must become effective January 1, 1959, and
therefore is adopted as an urgency revenue measure.
The City Clerk is hereby ordered and directed to certify to
the passage of this ordinance, and to cuase the same to be published
once in the Desert Sun, a daily newspaper of general circulation,
printed, published and circulated in the City of Palm Springs,
