THE CITY COUNCIL. OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE '
AS FOLLOWS:
Section1. A Final Environmental Impact Report (FEIR) has been completed in
compliance with CEQA, the State CEQA Guidelines, and the City's CEQA
Guidelines. The City Council found that with the incorporation of proposed
mitigation measures, potentially significant environmental impacts resulting from
this project will be reduced to a level of insignificance. The City Council
independently reviewed and considered the information contained in the FEIR
prior to its review of this Project and the FOR reflects the City Council's
independent judgment and analysis.
Section 2. Pursuant to Section 94.03.00 of the Palm Springs Zoning Code, the City
Council makes the following findings:
a. The proposed planned development is consistent and in conformity with the
general plan pursuant to Sections 94.07.00 (A)(1) and 94.02.00 (A)(4) of the
Palm Springs Zoning Code.
The proposed planned development is consistent with the General Plan, which
includes special provisions for the Central Business District. The project will bring
revitalization to the Downtown area, and introduce a permanent population as
well as new retail commercial space. '
b. The subject property is suitable for the uses permitted in the proposed planned
development district, in terms of access, size of parcel, relationship to similar or
related uses, and other relevant considerations.
The project, as conditioned, is consistent with the Downtown Design Guidelines,
and the vision of the area for the future. The site is physically suitable for the
proposed project, and provides sufficient access points for all uses proposed.
C. The proposed establishment of the planned development district is necessary
and proper, and is not likely to be detrimental to adjacent property or residents.
The Planned Development District modifies height and open space requirements
in a manner which is conducive with the urban development sought for the site in
the future. The inclusion of a redevelopment project in this area of the City will
increase vitality and activity in the Downtown.
