CITY COUNCIL MINUTES
JULY 31, 2002
An Adjourned Regular Meeting of the City Council of the City of Palm Springs, California,
was called to order by Mayor Kleindienst, in the Large Conference Room, 3200 Tahquitz
Canyon Way, on Wednesday, July 31, 2002, at 5:30 p.m., at which time, the City Attorney
announced items to be discussed in Closed Session, and at 7:00 p.m., the meeting was
convened in open session.
ROLL CALL: Present Councilmembers Hodges, Mills, Oden, Reller-Spurgin, and
Mayor Kleindienst
Absent: None
The meeting was opened with the Salute to the Flag, and a Moment of Silence.
REPORT OF POSTING OF AGENDA: City Clerk reported that the agenda was posted in
accordance with Council procedures on July 25, 2002.
REPORT OF CITY ATTORNEY ON MATTERS DISCUSSED IN CLOSED SESSION

PUBLIC COMMENTS: None.
APPROVAL OF CONSENT AGENDA: Items 1 thru 6.
It was moved by Reller-Spurgin, seconded by Oden, and unanimously carried,
that Items 1 thru 6, Hodges voting No on item 6 and Mills abstaining on item 6,
be adopted.
Review by City Manager of Consent Items to be clarified.
1. MO 7130 approving Amendment 2 to A4244 with DuPont Flooring Systems for
carpet maintenance at the airport for a term of July 1, 2002 through June 20,
2003 for $31,836.
2 MO 7131 approving Amendment 1 to A4361 with Conrad &Associates to provide
GASB 34 related infrastructure evaluation services for $43,900.
3. MO 7132 approving Supplement 010-M to A1459 with CalTrans for the Tahquitz
Canyon Way Traffic Signal Interconnect Project, total project $716,000. Federal
Grant of $599,000 and Measure A match of $156,303. No General Funds are
required for the project. CP2000-05
' 4. MO 7133 approving Supplement 762 to A4216 with CalTrans for the Sunrise
Way Traffic Signal Interconnect Project, total project $160,000. State grant of
$120.000 and Measure A match and STIP grant of $40,000. No General Funds
are required for the project. CP2001-14.

5. Res 20425 approving time extension from October 18, 2002 to October 18, 2003 '
with Mainiero, Smith and Associates for Edith Armstrong Toor for Tentative Tract
Map 28668, Case 5.0757 to subdivide 4.48 acres of land into a 6-lot single family
residential subdivision for property located west of Rose Avenue, north of
Stevens Road. R-1-A zone, Section 10.
6. Res 20426 approving time extension from May 21, 2002 to May 21, 2003 with
Christopher S. Mills for Stanley Broxmeyer for Planned Development District
246, Tentative Tract Map 28507, Case 5.0741 for a 514 recreational vehicle
space resort, thirty-six single family residential lots, 10-hole executive golf
course, clubhouse, four tennis courts, convenience market and support facilities
on 83.8 acres located at the northeast corner of Highway 111 and Gateway
Drive. R-1-C zone, Section 34. Mills abstain, Hodges No.

COUNCIL COMMENTS/ANNOUNCEMENTS/INTERAGENCY REPORTS:
Councilmembers reported on various civic and community organizational
meetings and events which they attended, subsequent to the last regular
meeting, and announced upcoming events of community interest.
LEGISLATIVE ACTION: '
7. ANNUAL RESERVATION OF UNAPPROPRIATED FUND BALANCES
Recommendation: That the Council appropriate into reserves the
unappropriated fund balances in designated City Operating and Capital Project
Funds for future operations or projects.
Director of Finance & Treasurer reviewed the staff report, no further report was
given.
Resolution 20427 as recommended was presented; after which, it was moved by
Hodges, seconded by Reller-Spurgin and unanimously carried, that R20427 be
adopted.
8. 2002-03 APPROPRIATION LIMIT
Recommendation: That the Council approve establishment of an appropriation
limit for the 2002-03 fiscal year in accordance with Article X111 B of the California
Constitution.
Director of Finance & Treasurer reviewed the staff report, no further report was
given.
Resolution 20428 as recommended was presented; after which, it was moved by '
Reller-Spurgin, seconded by Oden and unanimously carried, that R20428 be
adopted.

9. TENNIS CENTER LEASE
Recommendation: That the Council approve leasing the northern undeveloped
portion of the Palm Springs Tennis Center to the Palm Springs Tennis Club
Owners Association for a period of 8 years and 3 months for $150.00 per year
for property located at 1300 East Baristo Road. A-----.
City Manager withdrew the item.
10. OPTION AGREEMENT 9.52 ACRES, SUITT & BLOCK
Recommendation: That the Council approve an Option Agreement with Noah
Thomas Suitt, Jacqueline Suitt, Arthur Block and Kathleen Block for property
located at the southeast corner of Amado Road and Avenida Caballeros to
provide for the expansion of the Convention Center, Good Faith Deposit by City
for $35,000, term of six months with options, in a form approved by the City
Attorney. A-----.
City Manager withdrew the item.
11. 2002 PALM SPRINGS ROCKTOBERFEST WEEKEND
2002-03 BUDGET AMENDMENT
Recommendation: That the Council consider temporarily suspending certain
regulatory Ordinances to facilitate the 2002 Palm Springs Rocktoberfest
Weekend for the period of October 11 — 13, 2002.
Director of Tourism reviewed the staff report, no further report was given.
Resolution 20429 as revised, deleting parking restrictions, and Resolution 20430
amending the budget were presented; after which, it was moved by Reller-
Spurgin, seconded Mills and unanimously carried, that R20429 and R20430 be
adopted.
12. MUNICIPAL CODE AMENDMENT—TIME LIMITS FOR CLAIMS
Recommendation: That the Council amend the Municipal Code to define time
limit of 100 days for filing of claims for injury or death to a person and one-year
time limit for all other claims, consistent with State Law regarding claims for
money and damages and for claims for various types of refunds.

City Clerk read Title of Ordinance as follows:
AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AMENDING SECTION 3.16.010 — CLAIMS FOR MONEY OR DAMAGES AND
ADDING NEW SECTIONS 3.16.015 AND 3.16.018 AND AMENDING
SECTIONS 3.26.160 AND 3.32.210 OF THE PALM SPRINGS MUNICIPAL
CODE
After which; it was moved by Reller-Spurgin, seconded by Oden and
unanimously carried, that further reading be waived and the Ordinance be
introduced for first reading.
13. MUNICIPAL CODE AMENDMENT - LITTERING
Recommendation: That the Council amend the Municipal Code by repealing
certain sections and amending certain sections regarding the distribution of
Handbills and regulating littering.
City Clerk read Title of Ordinance as follows:
AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
REPEALING SECTIONS 5.20.060, 5.20.090, 5.20.100, 5.20.110, 5.20.120,
5.20.130, 5.20.140, 5.20.150, AND5.20.160 AND AMENDING SECTIONS '
5.20.010, 5,20.020, 5.20.030, 5.20.040, 5.20.050, 5.20.070 AND 5.20.080 OF
THE PALM SPRINGS MUNICIPAL CODE REGULATING LITTERING.
After which; it was moved by Reller-Spurgin, seconded by Mills and unanimously
carried, that further reading be waived and the Ordinance be introduced for first
reading.
14. INDIAN CANYON DRIVE AND ALEJO ROAD REIMBURSEMENT AGREEMENT
Recommendation: That the Council approve a reimbursement agreement with
The Heavenstone Collections, LLC and amend Resolution 20417 authorizing the
City Manager to award construction contracts for the project up to $700,000,
subject to ratification by the Council. CP00-35. A4543.
Director of Public Works/City Engineer reviewed the staff report.
Minute Order 7134 and Resolution 20431 as recommended were presented;
after which, it was moved by Hodges, seconded by Reller-Spurgin and
unanimously carried that MO7134 and R20431 be adopted.
