HomeMy WebLinkAbout5/16/2001 - STAFF REPORTS (19) DATE: May 16, 2000 TO: City Council FROM: City Clerk PALM SPRINGS CITY COUNCIL RULES OF PROCEDURE Recommendation: That the Council amend the Palm Springs City Council Rules of Procedure to reflect the Fair Political Practice Commission Conflict of Interest Regulations amendment. BACKGROUND: The City Council adopted the Rules of Procedure Handbook by Resolution 18147 on July 21, 1993. From time to time amendments are made to the procedures. In February, 2001 the Fair Political Practice Commission amended its rules regarding Conflict of Interest. The amendment allows that an official with a disqualifying conflict of interest, and who is abstaining from a decision based on the conflict, is no longer required to declare the nature of the official's financial interest. However, if a member is required to vote despite a disqualifying conflict of interest, in order to achieve a quorum, the member shall state the reason which shall be recorded in the minutes. The City of Palm Springs Rules of Procedure states "A Councilmember who publicly abstains should state the reason for abstention.. and the reason shall be stated and recorded in the minutes..." In order to maintain a consistency with the State, it is recommended that the regulation be amended. t® PATRICIA A. SANDERS City Clerk APP OT/ER D City Manager Attachment: Resolution RESOLUTION NO. 20053 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 7.4 FAILURE TO VOTE, PURSUANT TO RESOLUTION 18147, AS AMENDED, CONCERNING RULES OF PROCEDURE FOR COUNCIL MEETINGS AND RELATED FUNCTIONS AND ACTIVITIES. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, amending Section 7.4 of the Rules of Procedure Handbook to state: 7.4 FAILURE TO VOTE: Every Councilmember should vote unless disqualified for cause. If a member is required to vote despite a disqualifying conflict of interest, in order to achieve a quorum, the member shall state the reason which shall be recorded in the minutes. When a vote is collectively taken by voice, any Councilmember not audibly and clearly responding "no" or "abstain" shall have his or her vote recorded as "aye." ADOPTED this 16th day of May 2001.
