DATE: May 16, 2001 TO: City Council FROM: Director of Planning & Building CASE 5.0869-CUP - CITY COUNCIL REVIEW OF THE PLANNING COMMISSION'S DECISION TO DENYA REQUEST BY DESERT CHARITIES FORA CONDITIONAL USE PERMIT FOR ATHRIFT SHOP OPERATED BY ACHARITABLE ORGANIZATION AT425 SOUTH SUNRISE WAY, C-1 ZONE, SECTION 14. APPEAL: A City Council member has requested that a public hearing be scheduled to consider an appeal of a decision by the Planning Commission to deny a request by Desert Charities fora Conditional Use Permitfor a Thrift Shop operated by charitable organization at425 South Sunrise Way,C-1 Zone,Section 14. Section 9410 of the Palm Springs Zoning Ordinance authorizes any member of the City Council of the City of Palm Springs to initiate a review of any planning or zoning decision of the Planning Commission. Such notice of review shall be deemed the equivalent of the filing of an appeal. RECOMMENDATION: That the City Council conduct a public hearing to consider an appeal of the Planning Commission's decision to deny a request for a Conditional Use Permit, and to direct staff to prepare a resolution reflecting the decision of the City Council. The City Council may uphold, modify, or overrule the action of the Planning Commission. SUMMARY: During its meeting of April 11, 2001, the Planning Commission considered a request by Desert Charities for a Conditional Use Permit to allow for the operation of a thrift shop at 425 South Sunrise Way. This tenant space is that formerly occupied by the Cheeky Monkey. Desert Charities is proposing to operate the thrift shop. The subject property is zoned C-1 (Retail Business Zone). In the C-1 zoning district, a thrift shop Operated by a Charitable Organization is permitted subject to the issuance of a Type I Conditional Use Permit. The Planning Commission is authorized to issue a Conditional Use Permit. A denial by the Planning Commission is final unless appealed to the City Council, BACKGROUND: In accordance with Section 9212.01.D.21 of the Palm Springs Zoning Ordinance, a Thrift shop operated by charitable organizations is permitted in the C1 zoning district subject to the issuance of a conditional use permit by the Planning Commission. The thrift shop use is proposed to be established in the existing Ralph's shopping center on the northwest corner of the intersection of Ramon Road and Sunrise Way. The proposed thrift shop will utilize a 3500 square foot unit within the existing shopping center. The space will be divided into two areas, a processing area where donations are sorted, cleaned and priced, and the retail display area. The customer entrance will be on the east side of the building while donations will be accepted at the entrance on the south side of the building. In addition to accepting donations at the store, the applicant will also operate a "pick up" service where goods are picked up at people's homes. Case 5.0869: Review of the Planning Commission's Decision May 16, 2001 Page 2 The applicant proposes to utilize paid staff to gather items from the property that may have been dropped off while the business is closed. Regular site inspections will also be made by employees to ensure that the storefront is kept clean and free of any trash, debris, or items that may be inadvertently dropped off. This is meant to prevent the accumulation of goods outside the building and around the parking lot. Proposed hours of operation at from 9:00 AM to 4:00 PM, Monday through Saturday. The applicant is not proposing any exterior improvements to the properties. PLANNING COMMISSION ACTION In reviewing the subject request,the Planning Commission expressed concern thatthe use is not an appropriate one for this very visible location. Of primary concern to the Planning Commission was that items would be dropped off at the site when the business was not open. The drop-off point is proposed to be located in the front of the building ratherthan out of public view, such as in a loading area behind a building. This particular tenant space does not have access to a loading area. Planning Commission is concerned that the proposed use would result in the accumulation of items in this very visible parking lot, located at the intersection of two primary thoroughfares, particularly given the tenant space not having access to a loading area. The Planning Commission, at its meeting of April 11, 2001, by 6-0, 1 abstention voted to deny the subject application based upon the findings described above. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15301. All property owners within four hundred(400)feet of the subject site have been notified. As of the writing of this report, staff has not received any correspondence from adjacent property owners. Page 5 of 8 Planning Commission Minutes April 11, 2001 Case 5.0869 —Application by Desert Charities for a Conditional Use Permit for a thrift shop operated by a charitable organization at 425 South Sunrise Way, C1 Zone, Section 14. Commissioner Raya abstained due to a conflict of interest. Principal Planner Hope Sullivan reported that the proposed location for the thrift shop is in the Ralph's Shopping Center where the Cheeky Monkey was located and that the applicant understands that the lease may be short-term due to the uncertainty of future development at that site. She stated that the thrift shop discourages drop-offs during off-hours and accepts donations at the back door; however, prefers to send drivers to collect donations. She reported that no extensive improvements to the property are planned and that operating hours would be from 9:00 a.m. until 4:00 p.m. daily. Chairman Mills opened the Public Hearing. There being no appearances, the Public Hearing was closed. Commissioner Jurasky expressed his concerns about after-hours drop offs and the upkeep of the site. Commissioner Caffery expressed his opinion that this is not the appropriate site for this type of business because it is at the corner of two major City streets. Because the applicant was not present at this time, the Planning Commission tabled the discussion. Commissioner Raya again abstained due to a conflict of interest. Having been notified that the applicant was now present, the Planning Commission continued consideration of this application. Ms. Theresa Howell, applicant, was called to the podium. She stated that the property owners were giving Desert Charities a price reduction on the short-term rental as the property's future is uncertain. She stated that she is the co-founder of Well in the Desert and that the thrift shop is intended to raise money for the homeless in Palm Springs and that Well in the Desert coordinates efforts with local churches and synagogues. She stated that donations will be picked up and dropped off primarily during business hours only. Commission discussion included concerns regarding the visibility and upkeep of the dropped off donations, the fact that the site was inappropriate for the use due to its location at two major City arterials, and that the expense and work the applicant would go to in order to ready the /5:A/� Page 8 of 8 Planning Commission Minutes April 11, 2001 location for business would be wasted as the business would likely close in the immediate future. The Commission supported the effort and the value to the City and urged the applicant to consider an alternate location.
