CONSTRUCTION CHANGE ORDER NO. 3 TO E.L.YEAGER CONSTRUCTION
RECOMMENDATION:
That the City Council approve Construction Change Order No. 3 to
E.L.Yeager Construction, for an increase of $85,212.00 for the East Palm
Canyon / Gene Autry Trail Widening, for a total contract amount of $1,292,254.83
City Project No. 92-36.
SUMMARY:
Install additional irrigation, landscape and hydro-seed areas, remove additional
roadway excavation and compensate for traffic control delays.
BACKGROUND:
On May 17, 2000, City Council awarded E.L.Yeager Construction the contract for
the East Palm Canyon / Gene Autry Trail Widening project.
This proposed change order covers the following items:
Increase to Contract Items (New):
Item I is proposed to be added at the recommendation of Park Maintenance
Supervisor. Approximately 700 ft. west of Gene Autry Trail, north side of East
Palm Canyon, the parkway area required regrading in order to adequately
maintain it. This required additional irrigation and hydro seeding .
Item J is proposed to be added at the recommendation of the Landscape
Architect. During the construction of the storm drain pipe Lines A and B, outlet
structure and the re-aligning of the curb return at N.E. corner of Broadmoor and
East Palm Canyon, all existing irrigation and landscape were destroyed. There
were no provisions for any irrigation and landscape to be reconstructed.
Reconstruction of all irrigation and landscape is required in this area in order for
this not to have a "bare spot" at this corner, in relation to the existing area. A
partial credit is given under Item 34 for maintenance repair.
Item K is proposed to be added at the recommendation of Park Maintenance
Supervisor. The existing irrigation water main from 723 ft. west to 203 ft. west of
Gene Autry Trail is now under the new street section. For maintenance purposes,
it is proposed to re-install a new irrigation water main in the re-aligned landscape
area behind the new curb.
Item L was added due to changes in the street section required by the State of
California for their portion of East Palm Canyon. The street section changed from
4 in. AC over 8 in. Class II Base to 6 in. AC over 8 in. Class II Base. This change
was mandated by Caltrans. All work was done under force account at Caltrans'
direction.
Item M is proposed to be added due to delays as a result of the following:
City special event for Veterans Day Parade. Staff instructed the contractor not to
install storm drain across Gene Autry Trail at East Palm Canyon until after the
parade. (7 days)

Caltrans reviewed process to approved traffic control plan submitted by the
contractor. (6 days)
Construction staking for the 24 in. RCP storm drain pipe. (6 days)
Storm drain design change from 18 in. RCP to 2 ea, 12 in. RCP, due to conflict
with existing SCE conduit at Gene Autry Trail and East Palm Canyon. Design
change was reviewed by both the City and Caltrans and was constructed. (11
days)
Street section change on Caltrans's portion of East Palm Canyon from 4 in. AC
over 8 in. Cl II Base to 6 in. AC over 8 in. Cl II Base, including grading out
additional 2 inches of dirt and compaction. (12 days)
Re-design of signal pole base at SE corner of East Palm Canyon and Gene Autry
Trail, including the construction of the re-design and review and approval process
by both the City and Caltrans. (19 days)
Construction scheduling conflicts with the contractor's prior construction schedule
commitments. (17 days)
The total delay days are 78.
Because of these delays, the contractor was required to have the traffic control
system in place. Traffic control system included K-rail rental, arrow boards, crash
cushions, signs and additional materials related to road closures, in compliance
with Caltrans standards. Original completion date was Nov. 8, 2000. All traffic
control devices were removed by the contractor on Jan. 23, 2001. Total days
between Nov. 8 through Jan. 23 is 76. Cost for traffic control for Items I through K
will be provided by the contractor and is included in this cost.
Decrease to Contract Item:
Item 34 is a lump sum bid. On Plan Sheet No. P-4, Plant Legend, the contractor
shall provide $1,500.00 to be used for plant material not listed on the legend. The
City deleted this portion of the work and will receive credit from the contractor.
Additional working days (61) will be added per the following:
10 days for Items I through K.
2 days for Item L
49 days for coordinating and scheduling the above work
Funds are available in Measure A local share account number 4498-50174 (E.
Palm Canyon / Gene Autry Trail Widening) and Measure A Regional share
account number 4497-50174 (E. Palm Canyon / Gene Autry Trail Widening)

C. REASON FOR CHANGE:
