HomeMy WebLinkAbout5/2/2001 - STAFF REPORTS (19) DATE: May 2, 2001 TO: City Council FROM: City Engineer FARRELL DRIVE RIGHT-OF-WAY VACATION RECOMMENDATION: That the City Council adopt a resolution to summarily vacate portions of right-of- way dedicated for the public street named Farrell Drive, in Section 12, Township 4 South, Range 4 East; File R-00-003. SUMMARY: The Streets & Highways Code of the State of California allows for the City to summarily vacate excess right-of-way of a street or highway not required for street or highway purposes. As a result of the relocation of Farrell Drive, several portions of right-of-way of the original alignment have been superseded and are not required for public use. BACKGROUND: On April 4, 2001, the City Council adopted Resolution 20020 to vacate and close to public use eight parcels of right-of-way dedicated for Farrell Drive. These parcels were all portions of right-of-way dedicated by Tract Map or Parcel Map from fee-interest land within Section 12 as part of the development process of those properties. The three parcels of right-of-way proposed for vacation at this time are portions of the original alignment of Farrell Drive that was dedicated to the City from the Bureau of Indian Affairs (BIA) on March 12, 1968, on behalf of several allottees within Section 12. Subsequently, on September 21, 1976, the BIA sold one allotment where portions of Farrell Drive right-of-way is located(Allotment 584-26C) into fee status. This action ceased the BIA's jurisdiction over the City's interest in the three subject parcels of Farrell Drive right-of-way, allowing the City to perform the actions for consideration. All remaining excess portions of Farrell Drive right-of- way are under BIA jurisdiction, and will be vacated pursuant to their policy. Additionally, the Streets & Highways Code authorizes the City to convey by deed its interest in the street or highway vacated to the owners of the lands adjacent to or fronting on the street or highway in such manner as it deems that equity requires. Vacating the portion of right-of-way identified as Parcel 1 requires that the City quitclaim its interest in the right-of-way to properties adjacent to the west side of Farrell Drive in a configuration that would not have occurred if disposition of the right-of-way were delegated to the Riverside County Assessor's Office. Staff has prepared the necessary documents to facilitate conveyance of the right-of-way to the affected property owners. WHEREAS, the City Council of the City of.Palm Springs, California, is authorized by Chapter 4, Part 3, Division 9, of the Streets and Highways Code of the State of California, to summarily vacate and close to public use streets, or parts of streets, within the City of Palm Springs; and WHEREAS, the City of Palm Springs has completed the relocation of Farrell Drive within Section 12, Township 4 South, Range 4 East, to facilitate expansion of the City of Palm Springs International Airport; and WHEREAS,said relocation has created several parcels of excess right-of-way not required for street or highway purposes; and WHEREAS, Section 8334 of Chapter 4, Part 3, Division 9, of the Streets and Highways Code of the State of California authorizes local agencies to summarily vacate excess right- of-way that has been superceded by relocation; and WHEREAS, Section 8356 of Chapter 6, Part 3, Division 9, of the Streets and Highways Code of the State of California authorizes local agencies to convey by deed their interest in a public street or highway vacated to the owners of land adjacent to or fronting the street in any manner required by the local agency. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That the City Council does hereby summarily vacate and abandon all the City's right, title, and interest in those portions of the right-of- way dedication for the public street named Farrell Drive, as described in and shown on Exhibits "A", "B", "C", "D", "E", and "F", attached hereto and made a part hereof. Section 2. That the City Manager is hereby directed to execute and process Quitclaim Deeds necessary to convey the City's interest in the portion of right-of-way identified as Parcel 1, as described in and shown on Exhibits "A" and "B", to the owners of land adjacent to Parcel 1, in the manner required by the City Engineer. Section 3. That the City Clerk is hereby directed to cause a certified copy of this Resolution, attested to her under the seal of the City, to be recorded in the Office of the County Recorder of Riverside County. Section 4.
