RECOMMENDATION:
The Planning Commission recommends that the City Council approve Case No. 5.0864, a
Conditional Use Permit for a 4,006 square foot trade school/business college with 1,808 square
feet of ancillary office space. The project site is on a 4.61 acre parcel containing three existing
buildings totaling 58,523 square feet located at the northeast corner of Farrell Drive and Ramon
Road (490 South Farrell Drive), P Zone, Section 13. The applicant is Desert Career College, and
Charles Dunn is the President/CEO.
SUMMARY:
On March 28, 2001, the Planning Commission conducted a public hearing and voted 5-0
(Commissioner Raya abstaining and Commissioner Caffery absent) to recommend that the City
Council approve, subject to conditions, a Conditional Use Permit for a 4,006 square foot trade
school/business college, including 1,808 square feet of ancillary office space within an existing
office building located at 490 South Farrell Drive.
BACKGROUND:
Pursuant to Zoning Ordinance Section 94.02.00 (Conditional Use Permit), Desert Career College
has submitted an application for a Conditional Use Permit to allow a 4,006 square foot trade
school/business college with 1,808 square feet of ancillary office space within an existing office
complex located at 490 South Farrell Drive. The existing office facility is comprised of three
buildings totaling 58,523 square feet, and the applicant seeks to operate out of Suite 200 of
Building C, which has a total of 19,508 square feet. Zoning Ordinance Section 94.02.00 allows
private educational institutions on major thoroughfares via approval by the Planning Commission
and City Council of a Conditional Use Permit.

Desert Career College's proposed hours of operation are Mondaythrough Thursdayfrom 8:30 a.m.
to 8:30 p.m, and Friday from 9:00 a.m. to 5:00 p.m. Classes are held in three sessions per day
8:30 a.m. to 12:30 p.m.; 1:00 p.m. to 5:00 p.m.; and 5:30 p.m. to 8:30 p.m. The applicant indicates
that the maximum number of students and employees that would be on the premises at one given
time would be approximately 35, and the student attendance at the three sessions averages 20 for
the morning session and 12 for the afternoon and evening sessions. Desert Career College
provides vocational/professional training, i.e., medical assistant, dental assistant, travel agent and
computer programs, and the total number of employees is eight.
Of the total 4,006 square foot space the applicant intends to occupy, 1808 square feet will be used
to house six offices, with the remainder of the leased space to be occupied by five classrooms and
two restrooms to serve the classroom area. Two additional restrooms located in the common area
of the second floor will serve the office area.
The property owner has submitted a parking analysis specifying the various types of uses, i.e.,
medical offices and non-medical offices, as well as the proposed trade school/business college
use, the amount of space associated with each type of use, and the number of parking spaces
provided on site. Based on the current uses and the addition of the proposed trade
school/business college, a total of 314 parking spaces would be required. The site currently has
a total of 311 parking spaces. Zoning Ordinance Section 93.06.00.A.7. (Joint Use of Off-Street
Parking Facilities) indicates that parking credit may be given in the case of uses which operate at
hours not coincident with adjacent uses if sufficient evidence is presented to the Director of
Planning and Building which demonstrates that no substantial conflict in the principal hours or
periods of peak demand of the structures or uses for which the joint use is proposed will exist. The
applicant indicates that other business on the site do not operate during evening hours. Staff has
conducted several site inspections and determined that there are sufficient parking spaces
available to accommodate the addition of the proposed use. The site is served by public transit.
At its public hearing of March 28, 2001, the Planning Commission expressed concern regarding
parking to accommodate the proposed use as well as the existing uses. After considerable
discussion, the Planning Commission recommended that the City Council approve the request,
subject to the conditions contained in Exhibit A, as well as an additional condition that a student
parking area to be designated within the existing parking lot. The additional condition has been
incorporated into Exhibit A of the attached resolution (Condition No. 4.)
ENVIRONMENTAL ANALYSIS AND NOTIFICATION:
This application is categorically exempt from environmental assessment per Section 15301
(Existing Facilities) of the California Environmental Quality Act (CEQA).
All property owners within 400 feet of the project site have been notified of the public hearing. As
of the writing of this report, no public inquiries or correspondence have been submitted to staff.

CONCLUSION:
The Planning Commission recommends that the City Council approve Case No. 5.0864, a
Conditional Use Permit for a 4,006 square foot trade school/business college with 1,808 square
feet of ancillary office space, subject to the conditions set forth in Exhibit A of the attached
resolution.

Commissioner Raya abstained due to a conflict of interest.
Associate Planner Kim Chafin reported that this school proposes to have three sessions of
classes per day— 8:30 a.m. to 12:30 p.m., 1:00 p.m. to 5:00 p.m., and 5:30 p.m. until 8:30 p.m.
She reported that the applicant indicates that there are eight employees, the student
attendance averages 20 for the morning session and 12 each for the afternoon and evening
sessions, and that they offer vocational/professional training (medical assistant, dental
assistant, travel agent, and computer programs). She reported that, based on the current uses
and the addition of the proposed use, 314 parking spaces are required and that there are
currently 311 parking spaces. She stated that parking credit may be given in the case of uses
which operate at hours not coincident with adjacent uses. She stated that staff has also done
several site inspections and determined that there are sufficient parking spaces available to
accommodate the proposed use. She also noted that the site is served by public transit and
that installation of a bike rack has been included in the Conditions of Approval. She confirmed
that approximately 5,000 sq.ft. of the building is currently vacant and that other tenant uses of
the building are professional offices. She reported that Conditions of Approval require careful
monitoring of parking facilities.
Chairman Mills opened the Public Hearing.
Mr. Earl Truax, property manager for Abby Co., addressed the Planning Commission to state
that the applicant has done a careful analysis of the use and parking prior to considering this
tenant. He urged the Planning Commission to approve the application.
Mr. Charles Dunn, president of Desert Career College, addressed the Planning Commission to
review numbers of students and classes for the Planning Commission and stated that classes
are one year or shorter in term and that four classes could be run concurrently during each day.
There being no further appearances, the Public Hearing was closed.
Commissioner Matthews commended the applicant for the excellent use of this site. He also
noted that students of the College may likely use Sun Line public bus or other transit options

(rideshare, bicycle, etc.)
Commissioner Klatchko also gave his support, stating that the use is consistent with the high
school and adult education located immediately across the street.
Chairman Mills stated that he supported the use at this site, but felt the potential 48 student
vehicles per day would have a definite impact on parking in the future.
Commissioner Shoenberger stated that he is in favor of the use; however, does have concerns
regarding parking.
Director stated that the property owner has been meeting with tenants and is considering
assigning student parking at the rear of the parking lot.

Approval in staff report and that property owner shall develop and submit a student parking
plan for staff approval.
Case 5.0760-A, PD 249 —Application by Eric Hemstreet for a six-month time extension for
major construction on PD 249, Belardo Gardens, at the northwest corner of Belardo Road and
Sunny Dunes Road, PD Zone, Section 22.
Director reviewed exhibits and reported that, although it was seriously considered for grant
funding, the nearby planned Belardo Road Bridge did not rank high enough to receive State
funding this year. He reported that this 140-unit (two buildings of 70 units each) assisted living
facility would have a 142 ft. wide strip of landscape for buffer and screening, one main entrance
at Belardo Road, and a secondary ingress/egress at the rear of the property.
Director confirmed that the applicant had been notified of this meeting and, because he is not in
attendance, recommended continuing this time extension request to the next meeting.

CONDITIONS OF APPROVAL
1. The applicant/owner shall notify the Director of Planning and Building in writing 30 days in
advance of any changes in the operation of business.
2. The property owner shall be required to monitor leasing of the property and parking demand
to ensure that adequate parking is available on site for all employees and customers. Failure
to monitor use of the property in a way that results in off-site parking impacts may be cause
to revoke this Conditional Use Permit or modify the conditions of approval, including, but not
limited to, reducing the amount of medical office space available on site, change the use of
the building to non-medical office uses or other means to reduce or eliminate off-site parking
impacts.
3. Bicycle racks to accommodate six to eight bicycles shall be provided on site. Applicant shall
submit location and details for review and approval by the Director of Planning and Building.
4. The property owner shall designate a student parking area within the existing parking lot.
Applicant shall submit location for review and approval by the Director of Planning and
Building prior to issuance of a Certificate of Occupancy.

College for a trade school/business college within a 4.61 acre parcel containing three buildings
totaling 58,523 square feet at the northeast corner of Farrell Drive and Ramon Road, P Zone,
Section 13. The proposed project includes 4,006 square feet of classroom space and 1,808
square feet of accessory office space.
This action is categorically exempt from the provisions of the California Environmental Quality Act
(CEQA) per Section 15301 (Existing Facilities).
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearing described in this notice or in written correspondence at or prior
to the Planning Commission hearing.

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold
a public hearing at its meeting of May 2, 2001. The public hearing will take place on or about 7:00
p.m., or as soon thereafter as possible, and will be held at the Council Chamber of the City Council
of the City of Palm Springs, 3200 East Tahquitz Canyon Way, Palm Springs, California 92262.
The purpose of the hearing is to consider a Conditional Use Permit application by Desert Career
College for a trade school/business college within a 4.61 acre parcel containing three buildings
totaling 58,523 square feet at the northeast corner of Farrell Drive and Ramon Road, P Zone,
Section 13. The proposed project includes 4,006 square feet of classroom space and 1,808
square feet of accessory office space.
This action is categorically exempt from the provisions of the California Environmental Quality Act
(CEQA) per Section 15301 (Existing Facilities).
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearing described in this notice or in written correspondence at or prior
to the City Council hearing.
An opportunity will be given at said hearing for all interested persons to be heard. Questions

CALIFORNIA, APPROVING CASE NO. 5.0864, A CONDITIONAL
USE PERMIT TO ALLOW A 4,006 SQUARE FOOT TRADE
SCHOOL/BUSINESS COLLEGE WITH 1,808 ANCILLARY OFFICE
SPACE WITHIN A 4.61 ACRE PARCEL CONTAINING EXISTING
THREE BUILDINGS TOTALING 58,523 SQUARE FEET AT THE
NORTHEAST CORNER OF FARRELL DRIVEAND RAMON ROAD
(490 SOUTH FARRELL DRIVE), P ZONE, SECTION 13, AND
MAKING FINDINGS IN SUPPORT THEREOF..

WHEREAS, Desert Career College ("Applicant") has filed an application with the City pursuant to
Section 94.02.00 of the Zoning Ordinance, Case 5.0864, for a Conditional Use Permit to allow a
4,006 square foot trade school/business college with 1,808 square feet of ancillary office space
within a 4.61 acre parcel containing three existing buildings totaling 58,523 square feet at the
northeast corner of Farrell Drive and Ramon Road (490 South Farrell Drive), P Zone, Section 13;
and
WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to
consider Applicant's application for Case No. 5.0864 was given in accordance with applicable law;
and
WHEREAS, on March 28, 2001, a public hearing on the application for Case Permit No. 5.0864
was held by the Planning Commission in accordance with applicable law; and
WHEREAS, a notice of public hearing of the City Council of the City of Palm Springs to consider
Applicant's application for Case 5.0864 was given in accordance with applicable law; and
WHEREAS, on May 2, 2001, a public hearing on the application for Case 5.0864 was held by the
City Council in accordance with applicable law; and
WHEREAS, the proposed project, (Case No. 5.0864), is categorically exempt from the provisions
of the California Environmental Quality Act(CEQA)pursuant to Section 15301 (Existing Facilities).
WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented
in connection with the hearing on the project, including, but not limited to, the staff report and all
written and oral testimony.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as follows:
This application is categorically exempt from environmental assessment per Section 15301
of the California Environmental Quality Act(CEQA)in that Section 15301 states that existing
facilities are exempt from CEQA.

Section 2: Pursuant to Section 94.02.00 of the Zoning Ordinance, the City Council
finds that:
a. The use applied for at the location set forth in the application is properly one for
which a Conditional Use Permit is authorized by the City's Zoning Ordinance.
Section 94.02.00 allows, via approval of a Conditional Use Permit by the Planning
Commission and City Council, private educational institutions on major thoroughfares.
b. The proposed use is consistent with the General Plan.
The subject property is designed P (Professional) on the City's General Plan Land Use
Map. The objective of the P General Plan designation is to provide areas for law,
insurance, financial, medical and similar office and institutional uses, and associated
support facilities. The proposed use fits within the range of uses allowed within the
Professional General Plan category.
C. The use applied foris necessary ordesirable forthe developmentof the community,
is in harmony with the various elements or objectives of the General Plan, and is not detrimental
to existing uses or future uses specifically permitted in the zone in which the proposed use is to be
located.
The proposed trade school/business college is in harmony with the various elements and
objectives of the City of Palm Springs General Plan and is not detrimental to existing uses
specifically permitted in the zone in which the proposed use is to be located.
d. The site for the intended use is adequate in size and shape to accommodate said
use, including yards, setbacks, walls or fences, landscaping and other features required in order
to adjust said use to those existing or permitted future uses of land in the neighborhood.
The existing office facilities and surrounding site improvements, including parking facilities,
are adequate to accommodate the proposed use, which includes 4,006 square feet of
classroom space and 1,808 square feet of ancillary office space.
e. The site for the proposed use related to streets and highways is properly designed
and improved to carry the type and quantity of traffic to be generated by the proposed use.
The existing facility is bounded on two sides by roadways, one of which is a major
thoroughfare (Ramon Road) and one of which is a secondary thoroughfare (Farrell Drive).
The vehicular circulation system will not be negatively impacted by trips generated from this
project.

NOW, THEREFORE, BE IT RESOLVED that based upon the foregoing, the City Council hereby
approves Case No. 5.0864, subject to those conditions set forth in Exhibit A on file in the
Department of Planning and Building, a Conditional Use Permit to allow a 4,006 square foot trade
school/business college with 1,808 square foot of ancillary office space at 490 South Farrell Drive.
