HomeMy WebLinkAbout5/2/2001 - STAFF REPORTS (12) DATE: May 2, 2001 TO: City Council FROM: Director of Planning and Building CASE NO. 5.0862 -APPEAL TO THE CITY COUNCIL OF THE PLANNING COMMISSION'S DECISION TO RECOMMEND AGAINST AN AMENDMENT TO THE ZONING MAP SO AS TO REZONE A 6.38 ACRE PARCEL LOCATED ON THE SOUTH SIDE OF THE WEST END OF MESQUITE ROAD AND FURTHER IDENTIFIED BY ASSESSOR'S PARCEL NUMBER 513-300- 026 FROM "R-MHP" RESIDENTIAL MOBILEHOME PARK ZONE TO "R-3" MULTIPLE- FAMILY RESIDENTIAL & HOTEL ZONE. APPEAL:The applicant,Marshall hunms Design Group Architects,has appealed a decision by the Planning Commission to recommend against an amendment to the Zoning Map. The request is to rezone a 6.38 acre parcel located on the south side ofthe west end of Mesquite Road and further identified by Assessor's Parcel Number 513-300-026 from"R-MHP"Residential Mobilehome Park Zone to"R-3"Multiple Family Residential & Hotel Zone. RECOMMENDATION: That the City Council conduct a public hearing to consider an appeal of the Planning Commission's recommendation to not amend the zoning map as request, and to direct staff to prepare a resolution reflecting the decision of City Council. The City Council may uphold, modify, or overrule the recommendation of the Planning Commission. BACKGROUND: The subject property is located on the south side of the west end of Mesquite Road,just before the entrance to the Tahquitz Canyon Visitors Center. The 6.38 acre vacant site is fairly flat with slopes ranging from two to nine percent. Uses and zoning abutting the site are as follows: Use Zone North Single Family Home R-3 South Vacant 0-20 East Mobile Home Park R-MHP West Vacant(mountain) 0-20 Detailed development plans have not been submitted as part of this application. If the zoning map is amended, future land use and proposed development plans would need to be consistent with the R-3 zoning district requirements and limitations. /1 Case 5,0862: Appeal of the Planning Commission's Decision Re: Zoning Map Amendment May 2, 2001 Page 2 GENERAL PLAN CONSISTENCY: The zoning map is one ofmany tools utilized to implement of goals and objectives ofthe General Plan. The zoning map should only be amended if such amendment in consistent with the General Plan and firthers the goals and objectives outlined in the General Plan. The General Plan designation for the subject property is H43/21 (High Density Residential). Land designated in the General Plan for High Density Residential is proposed, as noted in the General Plan, to be developed with hotels and high-density multifamily residential uses. In accordance with Objective 3.8 of the General Plan,the High Density Residential designation ofH43/21 provides for the development of threshold of fifteen(15)and a maximum of21 dwelling units per acre. Hotels and similar types ofresort housing are allowed in this designations with a threshold of 30 and a maximum density of 43 dwelling units per acre. The proposed R-3 zoning designation is consistent with the General Plan designation. The"R-MHP" Residential Mobilehome Park Zone allows for amaxnnum density that is less than the minimum threshold noted in the General Plan. The Planing Commission determined that this is consistent with the General Plan. Staff recommended approval of the zoning map amendment to the Planning Commission. ANALYSIS In reviewing the subject request,the Planning Conunission did not object to the concept ofmultifamily development at this site. The Planning Commission expressed concern that the building height and the allowable density ofthe R-3 zoning district are not appropriate for this particular piece of land,particularly given the proximity of Parkview Mobilehome Park. The Commission recorrinended that the zoning map not be amended and that the applicant instead develop the land as aPlanned Development. The Planned Development would give the applicant the opportunity to design a multifamily residential development with some flexibility with respect to the property development standards(setbacks,density,etc.). Additionally, a Planned Development would give the Planning Corission and the City Council more design oversight with respect to what is constructed on this piece of land at the foot of the mountain. In the R-3 zoning district,atwo story building with a maximum height of24 feet is allowed by right ofzone. The building setback by right of zone is a minimum often feet,except any building in excess of 12 feet would have to have a minimum setback equal to the building height. High rise buildings are allowed in the R-3 zoning district subject to the issuance of a Conditional Use Permit. In the"R-MHP"Residential Mobilehome Park Zone,atwo story building with a maximurn height of24 feet is also allowed by right of zone. In terns of density,in the"R-MIT"Residential Mobilehome Park Zone,there shall be a minimum of five thousand(5,000)square feet of gross lot area for each mobilehome space and dwelling unit provided in « A a. Case #5.0862: Appeal May 2, 2001 Page 3 the mobile home park. This translates into a maximum density of approximately eight units per acre. In the"R-3"zoning district,the maximum allowable density for multifamily residential development is approximately 21 units per acre. Ifthe"R-3"zoning district is developed as ahotel,the allowable density is higher (43 units per acre). As noted,the Planning Commission expressed concern about the proposed R-3 zone and the effects of such a development on the adjacent property. The Plarming Commission determined that a Planned Development would allow greater neighborhood input during the project design and approval process. CEQA Ii accordance with Section 15177 ofCEQA,the project is consistent with the Palm Springs General Plan and is within the scope ofthe Master Environmental Impact Report prepared for the Palm Springs General Plan. He confirmed that no signs would be installed on the stacks. He stated that three of the benefits to the City of the project are that it 1) will add to the tax base, 2) there will be street upgrades, and 3) that it may help to avoid blackouts this summer. Mr. Fred Noble addressed the Planning Commission to state that the easternmost stack is within 200 +/- of his closest windmill and that it presents no interference to the operation of the wind farm. Commissioners discussed the future growth of the plant and considered 200 megawatts an acceptable limit which would allow for conversion from a simple cycle to a combined cycle plant. M/S/C (Raya/Caffery 7-0) to adopt resolution recommending that the City Council amend the zoning ordinance to allow natural gas powered electric generation plants that do not exceed 200 megawatts in the M2 zoning district subject to a Conditional Use Permit. Case 5.0862 Application by Marshall Ininns for an amendment to the zoning map to rezone a �38 acre parcel located on the south side of the west end of Mesquite Avenue from 'RMHP" Residential Mobile Home Park zone to "RY Multiple Family Residential Zone, Section 22. Principal Planner Hope Sullivan reported that this property is just before the entrance to the Tahquitz Canyon Visitor's Center and that surrounding uses are Open Space, R-3, and a mobile home park. She explained that the General Plan calls for high density residential in this area and that the request is consistent with the General Plan and surrounding zoning. She stated that, at the time of proposed development, Fire, Building, and Engineering would review street design and work cooperatively with the Agua Caliente Band of Cahuilla Indians to improve as appropriate at that time. She reported that maximum building height would be 24 ft. (two-story) in the R-3 zone. Chairman Mills opened the Public Hearing. Mr. Marshall Innins, applicant, addressed the Planning Commission to state that he would like to develop the area with apartments or condominiums and that he has discussed feasibility with the Water District, Sewer District, and California Fish and Game and has been told that his proposed development would have no impact on their services. There being no further appearances, the Public Hearing was closed. Chairman Mills conveyed his concern that layout of a project could be problematic and asked that a Planned Development application be considered; rather than the requested zone change. Commissioner Caffery stated that he is concerned about the possible impact to the /2#4 7 Page 5 of 8 _ Planning Commission Minutes April 11, 2001 neighboring mobile home owners 150 ft. away. Commissioners stated that they approve of a project at this site; however, due to the sensitivity of the site, would prefer to review a specific plan, rather than allow development by right-of-zone. M/S/C (Shoenberger/Jurasky 7-0) to recommend that the City Council deny the request to amend the zoning map. Case 5.0869—Application by Desert Charities for a Conditional Use Permit for a thrift shop operated by a charitable organization at 425 South Sunrise Way, C1 Zone, Section 14. Commissioner Raya abstained due to a conflict of interest. Principal Planner Hope Sullivan reported that the proposed location for the thrift shop is in the Ralph's Shopping Center where the Cheeky Monkey was located and that the applicant understands that the lease may be short-term due to the uncertainty of future development at that site. She stated that the thrift shop discourages drop-offs during off-hours and accepts donations at the back door; however, prefers to send drivers to collect donations. She reported that no extensive improvements to the property are planned and that operating hours would be from 9:00 a.m. until 4:00 p.m. daily. Chairman Mills opened the Public Hearing. There being no appearances, the Public Hearing was closed. Commissioner Jurasky expressed his concerns about after-hours drop offs and the upkeep of the site. Commissioner Caffery expressed his opinion that this is not the appropriate site for this type of business because it is at the corner of two major City streets. Because the applicant was not present at this time, the Planning Commission tabled the discussion. Case 3.2012—Application by Mario Berardi for a new warehouse building, located at 3425 North Indian Canyon Drive, Zone C-M, Section 34. Commissioner Klatchko abstained due to a conflict of interest. Assistant Planner Michele Rambo reviewed elevations and exhibits for the Planning Commission, stating that there is a zero setback requirement on San Raphael Place because it is a private street. She stated that the parcel is currently vacant and that surrounding land is CM and M-1. She reported that parking conforms to requirements and that there is no parking curbside. 04/26/2001 14: 48 9493769265 PAGE 02 MARSHALL ININNS DESIGN GROUP ARCHITECTS City Council City of Palm Springs 3200 East Tahquitz Canyon Way Palm Springs, CA 92263-2743 April 25, 2001 Project : Mesquite Villas West Mesquite Avenue Palm Springs, CA, Dear Council Person, I1have made application to rezone 6.34 acres of property at the end of West Mesquite Avenue, Palm Springs, California from RMHP,Residential Mobile Home Park,to R-3 residential. The plan is to build 120 condominiums, in 9 separate two story buildings, with extra amenities including an office, club house/exercise room and pool and spa. On April 11,20011 presented this project for rezoning to the P.S. Planning Commission, I was surprised by the denial by the Planning Commission to rezone the West Mesquite property, The Planning Commissioners desire a "Planned Development" application made p verses, the simple rezoning application. This is well and good, but,I have several problems with doing a planned development application: j a. I was lead to believe that rezoning this property was a simple matter since the P.S. ? General Plan allowed this R-3 use in this area of the city. b. Not only have I lost any city and consultant fees paid for the rezoning submittal. I have lost a lot of time in the process. C. I am in the process of obtaining HUD financing for this project and could lose this financing if the project is postponed. d, The surrounding property is owned by the Agua Caliente Band of-Cahuilla Indians. I have discussed this Project with Thomas I,Davis, AICP, Tribal Planning Director of the Agua Caliente Band of Cahuilla Indians. He had no objections to the development of 120 units on this piece of property. e. The adjacent mobile home park is in disrepair, the spaces are not filled and should not be affected by the new development. f I am not asking for any type of variance from the R-3 zoning requirements. DESIGN GROUP AnciuT>ECTS g, I am fearful of submitting a planned development and having to attend several Planing Commission meetings. Each mecting requiring revised plans to meet all the conditions of the Planning Commissioners. Please keep in mind that I am on a time table with the HUD financing of this project. The financing is on a fast track and can easily be derailed if there are any delays. The demand for this type of financing is very high and if deadlines are not met, the financing will go to other out-of-area (Palm Springs) developers. Multiple meetings with the Planning Commission over several months will cause me to lose this 14UD financing. This site has sat vacant for years. The Indian Cultural Center is the first new development in this area of PS and along with my project it could bring new development to this entire area, including possibly the revitalization of the shopping mall several blocks away. I know the Planning Commission desires to participate in the design of'my project for the good of Palm Springs. I understand their desire for.quality development. I want well designed, successful, and desirable development project too. Financially speaking the design of the project must be appealing to as many people as possible so it can be fully rented out as soon as possible. Furthermore, the best tenants are long term tenants who stay in the development because of the maintained quality of the site and homes. HUD will also participate in the design to. insure their investment is not wasted on a development that does not meet their standards of quality. Finally, I want the development to reflect on my architectural reputation and to prosper my . financial success. All these motivating factors added together will guarantee a quality multi-family residential project. I would like to discuss this project with you prior to the May 2, 2001 meeting and answer any questions or concems you might have about this rezoning request. The loan will be coming from a private lender and will be guaranteed by HUD. This type of loan saves money in the conversion of the construction loan to a permanent first mortgage at the completion of the project. There are no requirements which regulate the design of the project. HUD does review the plans and will require good quality construction methods and materials. It is an investment for them too. HUD does not require this project to be regulated by their'Section g'. My incentive is to build the best project that will reap the most rent for what is the going rental market rate in Palm Springs. For example this same loan program is being used by developers to build 400 Class A rental units in Las Vegas. It is a great loan program. 1 appreciate your help in this matter.
