HomeMy WebLinkAbout5/2/2001 - STAFF REPORTS (9) DATE: May 2, 2001 TO: City Council FROM: City Engineer SOUTH CAMINO REAL RIGHT-OF-WAY VACATION RECOMMENDATION: That the City Council adopt a resolution of intention to vacate a portion of the right- of-way dedicated for the public street named South Camino Real, in Section 23, Township 4 South, Range 4 East; File R-01-008, and setting the Public Hearing for June 6, 2001. SUMMARY: The Streets&Highways Code of the State of California prescribes the process that a City must follow to vacate public rights-of-way. This step initiates the process the Council must follow in considering the proposed public right-of-way vacation. BACKGROUND: The City has been petitioned by the owners of land adjacent to South Camino Real between San Lorenzo Road and Mesquite Avenue to vacate a portion of right-of- way adjacent to their properties. This street was dedicated to the City as Lot S of Tahquitz River Estates, recorded in Book 22 of Tract Maps, pages 69-71, on November 20, 1947. South Camino Real is dedicated with eighty feet (80') of right-of-way, however, its current classification is as a Collector Street on the City's Circulation Element. A Collector Street requires a right-of-way width of sixty feet (60'), and as such, there exists surplus right-of-way not necessary for public use. Additionally, this block of South Camino Real is offset ten feet(10)to the west, such that all surplus right-of- way is adjacent to the properties along the east side. It is for this reason that the total surplus right-of-way width of twenty feet (20') will be vacated along the east side of this portion of South Camino Real. The proposed right-of-way vacation was determined to be consistent with the General Plan and was approved by the Planning Commission at its April 11, 2001, meeting. If the City Council desires to consider the proposed right-of-way vacation, adoption of the attached Resolution of Intention will schedule a Public Hearing for June 6, 2001. DAVID J.
