APPROVE AWARD OF CONTRACT FOR CITY PROJECT 2000-30, AIP 27 & 29,
RESIDENTIAL SOUND INSULATION PROGRAM
RECOMMENDATION:
It is recommended that the City Council award bid, subject to Federal Aviation
Administration approval, for City Project 00-30 Residential Sound Insulation
Program (RSIP) Phase III for 116 homes to T & M Construction, Garden Grove,
California in the amount of$2,217,888.
SUMMARY:
The contract award would allow for the third phase of the Airport's Noise Insulation
Program to proceed for 116 more homes.
BACKGROUND:
The purpose of Palm Springs International Airport(PSP) RSIP is to mitigate aircraft
noise as stipulated in the Airport's FAA Part 150 Noise Compatibility Program. To
date the Airport has completed the insulation of forty-eight (48) homes.
With FAA approval, staff selected a two step process for developing the contract for
the Phase III work. Step I was a "Request for Qualifications and Information,"
detailing the qualifications of the Offerors for the general construction of Phase III.
A Review Panel evaluated the Offerors' qualifications and ability to perform the
work. No pricing information was submitted nor required for Step I of this two step
process. On March 7, 2001, City Council adopted Resolution No. 19995 approving
a list of pre-qualified general contractors eligible to participate in Step II of CP 2000-
30, RSIP Phase III.
On April 19, 2001,five out of five pre-qualified contractors submitted bids for(PSP)
RSIP Phase III. Step II bids were evaluated on a standard competitive sealed bid
basis. All Step II bids were reviewed and analyzed by City staff and project
consultants for compliance with the Invitations for Proposal/Bid Specifications and
acceptable engineering standards. The contractor and bid amounts were as
follows:

The bid results indicated that T&M Construction was the lowest, responsive bidder.
Per staff review and consultant reference checks, this company is well qualified and
experienced in sound insulation construction having completed 38 homes in (PSP)
RSIP Phase II. In addition, they have performed various phases of work for
residents at Los Angeles International Airport (LAX) and other locations.
The contractor has familiarized himself with the nature and extent of the contract
documents, the work, the site, the locality where the work is to be performed, the
legal requirements, and the conditions affecting the cost, progress or performance
of the work and has made other such independent investigations as necessary.
The project construction schedule is estimated at two hundred and ten days (210)
upon receiving a Notice to Proceed.
The FAA has appropriated $2,000,000 under Airport Improvement Program (AIP)
Project No. 3-06-0181-27 and $2,000,000 under Airport Improvement Program
(AIP) Project No. 3-06-0181-29 for a total of $4,000,000 for PSP's Residential
Sound Insulation Programs. Phase III RSIP is 90% funded by the FAA with the
remaining 10% funded from the Airport.
Funds are available in federal grant accounts 415-6600-56039 and 415-6600-
56047; no general fund monies are impacted.

NOTICE IS HEREBY GIVEN that sealed bids will be received from qualified Step 1 General
Contractors at the office of Harold E. Good, CPPO, Procurement Manager of the City of Palm
Springs, California, for the Residential Sound Insulation Program, Phase III, and all appurtenant
work, in strict accordance with the Contract Documents on file at the Office of the Procurement
Manager of the City of Palm Springs. Bids will only be accepted from General Contractors
previously pre-qualified under Step 1 - Request for Statement of Qualifications and
Information.

DATE OF OPENING BIDS-Bids will be received at the Office of the Procurement Manager of the
City of Palm Springs, California, until 2:00 P.M., Local Time on Tuesday, April 17, 2001, at
which time they will be opened publicly and read aloud.
DESCRIPTION OF THE WORK - The purpose of the Residential Sound Program is to mitigate
aircraft noise. The work, which is divided into phases, consists of insulating single-family
residential homes within the proximity of the Palm Springs International Airport. The work to be
done consists of, but is not limited to, sound insulating approximately 118 single-family residential

homes. The work shall include generally the replacement of windows, exterior doors (with
hardware), providing attic insulation, gable vent baffles, chimney dampers and miscellaneous
HVAC acoustic modifications.
LOCATION OF THE WORK - The work to be performed hereunder is located within the City of
Palm Springs. Specifically, the work is located in an area generally bounded by Racquet Club
Road, Sunrise Way, Vista Chino, Viminal Road and San Juan Road.
COMPLETION OF WORK - Time is of the essence. The work must be completed within two
hundred and ten (210) calendar days after the commencement date stated in the Notice to
Proceed, and liquidated damages will be assessed for failure to complete the project on time, as
set forth in the Agreement. The anticipated Notice to Proceed will be given within a period of 30-60
calendar days from the Notice of Award, subject to be shorter with the approval of all parties. Prior
to the issuance of a Notice to Proceed, a pre-construction conference with the successful General
Contractor must be conducted.
OBTAINING OR INSPECTING CONTRACT DOCUMENTS - (a)A full set of Contract documents
is available for inspection, without charge, at the office of Christopher S. Mills (see below); (b)

ADDRESS AND MARKING OF BIDS - The envelope enclosing the Bid shall be sealed and
addressed to the City of Palm Springs,and shall be hand delivered to: Procurement Manager,3200
East Tahquitz Canyon Way,Palm Springs,California,92262. The envelope shall be plainly marked
in the upper left-hand corner with the name and address of the Bidder and shall bear the words:
"Residential Sound Insulation Program, Step 2,CP2000-30"and the date and hour of opening Bids.

CONTRACTOR'S LICENSE CLASSIFICATION - In accordance with the provisions of California
Public Contract Code Section 3300, the City has determined that the Contractor shall possess a
valid Class B-1 Contractor's License at the time that the Contract is awarded. Failure to possess
the specific license shall render the bid as non-responsive and shall act as a bar to award of the
Contract to any bidder not possessing said license at the time of award.
The successful General Contractor must be licensed to do business in the City of Palm Springs in
accordance with the provisions of Chapter 9, Division 3, of the Business and Professions Code,
and will be required to obtain a City Construction Permit(No Fee)from the Public Works Inspection
Supervisor, City Hall, Palm Springs, California.
WAGE REQUIREMENTS:
(A) State - In accordance with the provisions of California Labor Code Section 1770, 1773,
1773.1, 1773.6 and 173.7, as amended, the Director of the Department of Industrial
Relations has determined the general prevailing rate of per diem wages in accordance with
the standard set forth in Section 1773 for the locality in which the Work is to be performed.
A copy of said wage rates is on file at the Department of Building and Safety, City Hall,
Palm Springs, California. It shall be mandatory upon the Contractor to pay not less than
said specified rates to all workers employed by them in the execution of the Work, and shall
post a copy of said wage rates at the project site.
(B) Federal -The general prevailing rate of wages, as determined by the Secretary of Labor,
are included hereinafter as part of the Contract Documents; provided, that if there is any
difference between the State or Federal wage rate for any given craft or mechanic needed
to execute the work, it shall be mandatory upon the Contractor and any sub-contractors to
pay the higher of the two rates.
All labor on the project shall be paid no less than the minimum wage rates established by the U.
S. Secretary of Labor.
RETAINAGE FROM PAYMENTS -The Contractor may elect to receive 100 percent of payments
due under the Contract from time-to-time, without retention of any portion of the payment by the
City, by depositing securities of equivalent value with the City in accordance with the provisions of
Section 22300 of the Public Contract Code. The value of such securities, if deposited by the
Contractor, shall be as determined by the City, whose decision on valuation of the securities shall
be final. Securities eligible for investment hereunder shall be limited to those listed in Section
16430 of the Government Code, or bank or savings and loan certificates of deposit.
TRADE RESTRICTIONS-All solicitations, contracts and documents resulting from project funded
under the AIP must contain the foreign trade restriction required by 49 CFR Part 30, Denial of
Public Works Contracts to Suppliers of Goods and Services of Countries that Deny Procurement
Market Access to U. S. Contractors.
The Aviation Safety and Capacity Expansion Act of 1990 provides that preference be given to steel
and manufactured projects produced in the Unite States when funds are expended pursuant to a
grant issued under the Airport Improvement Program.

AWARD OF CONTRACT - (a) The award of contract will be based on the lowest total bid,

Bid Conditions. The City reserves the right to award any or all parts of the Bid Schedule to the
lowest responsive, responsible bidder,and to reject all other bids,as it may best serve the interests

the various low bids from qualified contractor bid items. The City further reserves the right after
opening bids to reject any or all bids, or to waive any minor informality (non-responsiveness) in a
bid. The award of the contract is subject to the approval of the Federal Aviation Administration.
The Sponsor further reserves the right to negotiate changes with low bidder in the scope of project,
extent of the work, or to increase or decrease the size of the project, if so desired, all to the best
interests of the Owner, prior to award of contract. Additional information is included in Bid
Conditions.
(b)As a condition of award, the successful bidder will be required to submit bonds and insurance
prior to execution of the Agreement by the City. Failure to meet this requirement shall constitute

abandonment of the Bid by the Bidder and forfeiture of the Bid Bond. The contract will then be
awarded to the next lowest bidder.
BID SECURITY- Each Bid shall be accompanied by a certified or cashier's check or Bid Bond in
the amount of 10 per cent of the total bid price, payable to the City of Palm Springs, as a guarantee
that the Bidder, if its Bid is accepted,will promptly obtain the required bonds and insurance and will
prepare the required submittal documents and execute the Agreement. Bid bonds will be required

SEALED RESPONSES TO INVITATIONS TO SUBMIT "STATEMENTS OF QUALIFICATIONS
AND INFORMATION - STEP I" of a two-step Proposal/Bid process will be
received until (5:00 p.m. , (local time) February 26, 2001 at the Office
of the Purchasing Manager, 3200 E. Tahquitz Canyon Drive, Palm Springs,
California, after which time they will be publicly opened and the names
of all Offerors submitting proposals will be read aloud. Following
public opening, responses will be evaluated for qualifications to
perform the following work:
SCOPE OF WORK: The purpose of the Residential Sound
Insulation Program is to mitigate aircraft noise . The
work, which is divided into phases, consists of insulation
of single family residential homes within the proximity of
the Palm Springs International Airport.
Step II: The work consists of sound insulating approximately 120
single family residential homes. The work, shall include generally the
replacement of windows, exterior doors (with hardware) , providing attic
insulation, gable vent baffles, chimney dampers and miscellaneous HVAC
acoustic modifications.
LOCATION OF THE WORK: The work to be performed hereunder is located
within the City of Palms Springs. Specifically, the location of the
work is located in an area generally bounded by Racquet Club Road,
Sunrise Way, Vista Chino, Viminal Road and San Juan Road.
COMPLETION OF WORK: Time is of the essence. The work of Step II must
be completed within (Two Hundred Ten) , (210) calendar days after the
commencement date stated in the Notice to Proceed, and liquidated
damages will be assessed for failure to complete the project on time,
as set forth in the Agreement. The anticipated Notice to proceed will
be given within a period of 30 to 60 calendar days from the notice of
award, subject to be shorter with the approval of all parties. Prior
to the issuance of a Notice to Proceed, a pre-construction conference
with the successful General Contractor must be conducted.
TWO STEP PROPOSALS / BID PROCESS: The City of Palm Springs has
selected a two step process for developing the contract for this work.
Step I is a "Request for a Statement of Qualifications and
Information", detailing the qualifications of the offerors for the
general construction contractor specified above. A Qualification
Review panel will evaluate offeror' s qualifications and ability to
perform the work. No pricing information is required nor shall be
submitted for Step I of this two step process.
Only those Offerors submitting Step I proposals and found qualified by
the City will be invited to submit bids in Step II. Step II bids will
be evaluated on a standard competitive sealed bid basis. All Step II
bids will be reviewed and analyzed by City staff and project
consultants for compliance with the Invitation for proposal / bid and
acceptable engineering standards. Final award of the contract (if any)
will be made by the Palm Springs City Council based on the lowest
responsive and responsible bid. Step II will be bid and awarded
independently.
