CITY OF PALM SPRINGS
CITY COUNCIL MINUTES
MARCH 26, 1997
An Adjourned Regular Meeting of the City Council of the City of Palm Springs, California, was
called to order by Mayor Kleindienst, in Studio B, City Hall, 3200 Ttdiquitz Canyons Way, on
Wednesday, March 26, 1997 at 5:30 p.m., at which time, die City Attorney announced items to be
discussed in Closed Session, and at 7:00 p.m., the meeting was convened in open session.
ROLL CALL: Present: Councilmembers Barnes, Hodges, Oden, Spurgin, and Mayor '
Kleindienst
Absent: None
The meeting was opened with the Salute to the Flag.
REPORT OF POSTING OF AGENDA: City Clerk reported that the agenda was posted in
accordance with Council procedures on March 21, 1997.
REPORT OF CITY ATTORNEY ON MATTERS DISCUSSED IN CLOSED SESSION (All Entities)
-See items on Page 2 of study session agenda this date.
PUBLIC COMMENTS:
a) Comments on matters not related to an agenda item:
Mr. Nixifat, owner 711 Store, North Sunrise Way, stated that a major grocery
store is good for his type of business, because he is in the:convenience business
and not tine grocery business; and that die median island has made the convenience
of his store impossible; that development has been slow in the area, and Ise did not
think it fair to make his business suffer while waiting for that to happen.
Liz Cervantes, 270 North Palm Canyon, stated she has been a VillageFest vendor ,
since its inception, and was "grandfathered" but has now been asked to leave
immediately; that while not made specifically by her, everything she sells is
handmade, and there are 3-10 vendors selling merchandise she competes with in
her sales; and dial she was advised that no special considerations was given to
merchants on Palm Canyon, yet others were given until July to cease.
Dick Sroda, resident, commented that a telephone survey was purported to be
taken by concerned citizens of Palm Springs, but he contended the callers were city
employees, although on their own time, which he did not think would result in an
unbiased survey.
Darrell Meeks, resident, also commented on the same survey, noting that while it
was on their own time, he felt the time would be better spent determining bow to
cut the budget. He also commented on adding items to the closed session agenda,
i.e., at the last meeting, and questioned whether a time sensitiveness of the issue
was publicly stated, discussed, and determination made as to meeting the criteria of
the Brown Act He stated that a clear example of meeting the Act was
demonstrated in the added item to the regular agenda for the same meeting.
Anna Meeks, Las Vegas, stated she was a visitor during the past week, took
offense at attitude that teenagers are discouraged from "hanging around"
VillageFest. '

LEGISLATIVE ACTION:
1. MOU - FIRE SAFETY
Recommendation: That the Council approve Memoranda of Understanding for employees
' in the fire safety unit. City Manager explained that the unit is the final employee unit to
settle
Resolution 19007 as reconnnended, was presented; after which, it was moved by Hodges, seconded
by Barnes, and unanimously carried, that Res 19007 be adopted.
ADJOURNED
There being no further business, Mayor declared the meeting adjourned.
