CITY COUNCIL MINUTES
NOVEMBER 10, 1993
An Adjourned Regular Meeting of the City Council of the City of Palm Springs, was called to order by
Mayor Maryanov,in the Large Conference Room,City Hall, 3200 Tahquitz Canyon Way, on Wednesday,
November 10, at 7:30 p.m.
ROLL CALL: Present: Cotmcilmembers Hodges, Reller-Spurgin, Schlendorf and Mayor
Maryanov
Absent: Councilmember Lyons
The meeting was opened with the Salute to the Flag and a moment of silence.
REPORT OF POSTING OF AGENDA: City Clerk reported that the agenda was posted in accordance with
Council procedures on November 5, 1993.
INTERAGENCY REPORTS: None
PUBLIC COMMENTS:
a) Comments re Item 2:
Dennis Miller,Chairman of the Morongo Band of Mission Indians, stated that they would
like to participate in V illagefest, and asked to allow staff to work it out, and it they are
not welcomed, they will leave. He extended invitation to visit the facilities, and learn
how it is integrated with the Palm Springs community.
Ira Englander, President of E-C Investments,and general mmager of Casino Morongo
management company,stated that Casino Morongo has a relatli�onship with the community (0 50-
in that 100 people who work for the casino also live in Palm Springs; that he agreed with 018)
Chairman Miller's position, adding that if they are denied the permit, it may appear to
be a public policy against gaming which is legitimate under State law; and that they feel
entwined with Palm,Springs, and part of the community.
John Connell, member of the VillageFest review committee, stated he felt it would be a
great idea to have Casino Morongo at VillageFest, under demonstrations, which could
also be offered to different organization; that they are neighbors; that people come from
all over to sell products, and taxes are not paid, and this would at least reach out to a
neighbor.
Tolfe Lee Albert, Director of Marketing for Casino Morongo, stated that gaining is not
being suggested at VillageFest,rather a demonstration of two,games; that there would not
be any money gambled; that no one under 18 would be allowed to approach the table,
and there would not be any money exchanged; that participants will receive a coupon and
free gift redeemable at the Casino; and that no T-shirts would be dispensed at
VillageFest.
Eric Meeks, Broadmoor, formally requested that the Council allow the sales of all non-
pornographic reading material at VillageFest.
b) Other comments on matters not on the agenda:
Steve Grasha commented on the cost of keeping the Swim Center open during;January,
and suggested that alternatives be explored, e.g., a solar cover on the pool.
Mayor asked for a report on the safety and legality of covering the pool.
LEGISLATIVE ACTION:
1. FIRE SERVICES CONSOLIDATION
City Manager highlighted the proposed process,outlining the makeup of the committee,and noted
that two councilmembers from each city is a change, in that one was suggested before; and a two
members at-large is a new. He stated that he has been informed that the Cathedral City Council
approved the makeup of the committee, and has started formation of its appointments. (087-

Mayor and Councilmember Schlendorf volunteered to serve as Council appointees. Normal
process for citizen involvement to be followed. City manager asked to schedule appointments on
next available agenda.

It was moved by Schlendorf, seconded by Reller-Spurgin,and unanimously carried, Lyons absent,
that the committee make-up as presented be approved, and the formal appointment of
Councilmember Schlendorf and the Mayor as Council representatives be scheduled and the City
Manager obtain names for other representations, and the citizen at-large appointment to follow
normal process, within 10 days.
2. VILLAGEFEST
Consideration of Casino Morongo's request to bean on-site sponsor at Vi➢lagcFest;and discussion
regarding the operation and direction of VillageFest.
City Manager stated he was concerned about how the program has been=_raged; that its import
is reflect in the high level of Council concern,and that it was initially started by the Council, and
it should not be relegated to any department; that a process either thro^ng.i a Council appointed
board or commission could be looked at.
Director of Parks&Golf Course stated that the proposed rules were revievicd by the Commission
during July and August; that "arts and crafts fair" was eliminated, and he did not know how that
compared to the original set of rules.
Mayor stated that the issues are administration of the event in the fii0ire, and the rules and
regulations and specific request by Casino Morongo.
Councilmember Schlendorf stated that a group of volunteers have worked hard and made it a
success and have been given conflicting messages, that she feels it has Leen distorted and it was
not necessary, and there was no choice but to set a special meeting of the Council to make a firm
decision that will be less biased Chan what has been provided, or by couti,ping with the old rules.

Councihnember Hodges stated that in the old rules there was no hmiCation ns to age of books, and 018
questioned how it was categorized.
Director of Parks sc Recreation stated that originally there was a hook ce.tegory.
Mayor asked for a redline copy to determine the difference betuveen the cots of roles, as well as
a mission statement for VillageFest.
Motion by Schlendorf, seconded by II-lodges, to create a separate VillageFest commission and for
staff to bring back a and➢ine version of the rules, was subsequently withdrawn following
discussion as to whether it shoold fall Co the Parks 8-, Recreation Comnii—ton. Councilmember
Roller-Spurgin stated that she felt it was adding another level of bureaucracy and delay,and that
the original committee worked hard and achieved something that was successful.
Re: Casino Morongo. Tribal Council position is that 1t is a decision of the City Council,
Mayor noted that the Casino is not an established retail business in Palm Springs; and although
other vendors may also not be local merchants,in this case, the purpose is to invite locals to an
out of town business.
Councilmember Hodges stated that she would also like to continue this nm,c2 ,r, and that is not an
issue of gaming, rather an issue of appropriateness for VillageFest and of what is trying to be
accomplished with it.
It was moved by Rel➢er-Spurgin,seconded by Schlendorf,and unanimously ca,tied,Lyons absent,
that the entire subject be continued Co November 17, and that staff provide a redline copy by
November 15, including Casino Morongo and possible formation separate entity to regulate it;
staff to provide adopted rules, new rules, redline set November 15.

3. GENERAL UNIT MOU - 1993-94
Consideration of approve Memorandum of Understanding for employees in the Genend Unit, for
1993-94; and related Personnel Rule amendments.
City Manager recommended approval of the memorandum of understanding, stating that it will
result in reduced cost for health and hospitalization, and is a good contract, and has been (110--
confirmed by the unit.

Resolution 18225 as recommended, was presented; after which, it was moved by Hodges,
seconded by Schlendorf, and unanimously tamed, Lyons absent, that R18225 be adapted.
4. ADDITIONAL LEGISLATIVE ITEMS: None
COMMISSION APPOINTMENTS:
a) Board of Appeals. Mayor announced his appointment of Norm Brown, no I:erm limit,
to succeed Wayne Schicke, after which,it was moved by Schlendorf,seconded by Reller- (060-
Spurgin, and unanimously carried, that said appointment be approved. 003),
