HomeMy WebLinkAbout1993 - MINUTES - 1/14/1993CITY OF PALM SPRINGS CITY COUNCIL MINUTES JANUARY 14, 1993 An Emergency Meeting of the City Council of the City of Palm Springs, California, was called to order by Mayor Maryanov in the Large Conference Room, 3200 Tahquitz Canyon Way, on January 14, 1993, at 4:30 p.m. ROLL CALL: Present: Members Lyons, Reller-Spurgin, Schlendorf, and Mayor Maryanov Absent: Member Hodges CITY MANAGER REPORT: Assistant City Manager stated that there are several ways to call an Emergency Meeting of the Council; that the City Attorney did concur that the reason for the meeting did fall within the guidelines specified by the Government Code; thathe guidelines set forth in the Government Code had been complied with; that a copy of the notification to all concerned parties is on file with the Office of the City Clerk; that the issue is public health and safety; that the flooding has endangered the citizens of Palm Springs; and that the Council can make the determination pursuant to the Government Code. Mayor stated that the Council needs to determine that an emergency exists within the City; and that with weather conditions continuing the damage will amass. Motion to call an emergency meeting pursuant to Section 54956.5 of the Government Code declaring an emergency situation related to a crippling disaster which severely impairs public health and safety was presented, after which; it was moved by Reller-Spurgin, seconded by Schlendorf, and unanimously carried, Hodges absent, that an emergency meeting be called. PUBLIC COMMENTS: None LEGISLATIVE ACTION DECLARATION OF LOCAL EMERGENCY Recommendation: That the Council adopt a resolution requesting the State Director Office of Emergency Services concurrence of local emergency. (88- Emergency Services Coordinator stated that major damage was 001) sustained by the City on January 7, 1993; that the City Manager did declare a local emergency on January 8, 1993; that the declaration is effective for seven days; that the Council can ratify the declaration to carry the action forward; that the Government Code does specify that the declaration be reviewed and sustained every fourteen days; that the estimates for the costs of repair were originally based on areas that were covered by flooding; that the water has receded, enabling staff to examine the areas thoroughly; that the amount of damage has been downgraded to $206,500; that the issue is whether to replace the roads to pre-existing conditions; that if improvements are to be made, the additional cost will borne by the City; that the matter before the Council is to determine and declare a state of emergency within titca City, and authorize staff to request State aid for repair of damages; that if the State determines that the situation is within the boundaries of the Natural Disaster Act, funding will be available from the State; that the funding formula is seventy-five percent State funding, and twenty-five percent City funding; that passage of the resolution requesting help does not guarantee the funding, only consideration. :Id. Council Minutes 1-14-93, Page 2 LEGISLATIVE ACTION: DECLARATION OF LOCAL EMERGENCY (Cont'd) City Manager stated that some question was raised as to the City of Palm Springs being the only Coachella Valley City declaring a state of local emergency; and that the City's exposures are greater with so many washes located within its boundaries. Greg Scott, Riverside County Chief of Emergency Services, stated that the County does support the City in its efforts (088- to protect the citizens of Palm Springs; that the responsibility 001) of Council is to protect the health and safety of its citizens; that the County responsibility is to assist the City in any way possible, with any resources that are available; that the County does agree with the declaration of local emergency; that the question will be if there are any funds available at the State level; that the declaration once accepted on the State level will trigger all resources available to the City; and that the County will continue to assist the City in every way possible. Mayor stated that the support is appreciated; that in the recent budget projections by the State, the City of Palm Springs will suffer the greatest loss of revenue of any City in the Coachella Valley; that coupled with the property tax loss last June, 1992, the repairs that are needed cannot be financially accomplished. Councilmember Re'ller-Spurgin stated that there is no greater responsibility as a Councilmember:, than to protect the citizens of Palm Springs. Resolution 18017 as recommended was presented, after which; it was moved by Schlendorf, seconded by Lyons, and unanimously carried, Hodges absent, that R18017 be adopted. Assistant City Manager noted that the matter will be need to be reviewed within fourteen days. ADJOURNMENT There being no further business, Mayor declared the meeting adjourned.
