HomeMy WebLinkAbout1992 - MINUTES - 9/25/1992 MINUTES OF CITY COUNCIL SEPTEMBER 25, 1992 An Adjourned Regular Meeting of the City Council of the City of Palm Springs, California, was called to order by Mayor Maryanov, in the Large Conference Room, 3200 Tahquitz Canyon Way, at 5 p.m. ROLL CALL: Present: Councilmembers Reller, Schlendorf and Mayor Maryanov Absent: Councilmembers Hodges and Lyons REPORT POSTING OF AGENDA: Report of Assistant City Clerk: Agenda posted in accordance with Council procedure Tuesday, September 22, 1992. Mayor stated that Councilmembers Hodges and Lyons would be present shortly. PUBLIC COMMENTS: a) Comments regarding Item 1: Dan Johnson, 801 E. Tahquitz, President of DBID, stated the Board of Directors of the DBID were available to answer any questions; and that a letter dated September 25, 1992 was sent to the Council addressing the concerns of the DBID; and that the service fee (133- to the City could be gained from delinquent accounts. 003) Ric Service, 222 S.P.C. , President Palm Springs' NOW, stated that Palm Springs NOW was just apprised of the assessment by the City for $10,000; that it is the desire of Palm Springs NOW that all assessments be collected; and he requested that the City collect the penalties in-lieu of the service fee, as submitted. LEGISLATIVE ACTION: 1. DBID - 1992-93 LEVY On September 22, 1992 the Council approved the annual report of the DBID and adjourned to September 25, 1992 to adopt Resolution of Intention 17955, setting hearing for October 7, 1992. Mayor clarified that the DBID Board has adopted a motion reciting that all penalties collected by the City, in (133- this year as well as in subsequent years, should be retained 003) by the City as consideration for the City's efforts. HERE COUNCILMEMBER HODGES ENTERED MEETING. Mayor reviewed previous discussion for Councilmember Hodges; and added that under Council Policies and Procedures the current meeting is adjourned from Tuesday, and therefore the motion concerning the acceptance of the DBID Annual Report could be reconsidered at this meeting. Assistant City Manager reviewed previous motion concerning the DBID as follows: That the Council accept the Annual Report with a budget totalling $158,500 submitted by the DBID for Fiscal Year 1992-93, including $10,000 payable to the City of Palm Springs for administrative services. C :':3 Council Minutes 9-25-92, Page 2 ' 1. DBID - 1992-93 LEVY (Cont'd) It was moved by Reller, seconded by Schlendorf, and unanimously carried, that the previous motion be reconsidered. Director of Finance stated that as the taxing authority, the penalties and the assessments go to the DBID, Councilmember Hodges stated that for the City to accept the penalties would be a good compromise; that no one seemed comfortable with the motion of the $10,000 administrative service fee to the DBID; and that she complimented the DBID for the recommendation. Minute Order 5091 accepting Annual Report with budget totalling $158,500 submitted by the Downtown Business Improvement District for Fiscal Year 1992-93, and providing that all penalties collected will be paid to the City of Palm Springs for administrative services, rescinding Minute Order 5090, was presented, after which; it was moved by Schlendorf, seconded by Reller, and unanimously carried, that M05091 be adopted. Assistant City Manager reviewed the background of the matter and added that from staff point of view, it is difficult to tabulate the assessment figures at the meeting, and that request would be made to continue the matter to October 27, 1992. Councilmember Schlendorf stated the method foi, determining the assessments should be reviewed. Mayor stated that it is not just the dollar amount of the assessment; but the dollar amount of protest; that the delinquent fees are mostly for businesses that one does not know the assessment value; and that an average is used for their assessment figure. Finance Director stated that the protests are counted at the dollar figure of the protest; that the method used is dependent on the size of the district; that the delinquent business assessment figures are based on the total amount of assessments and the total number of businesses; that the Mayor did request contact to made to both those for and against the DBID persons to more accurately reflect the dollar size of the district; that the delinquent assessment figure will be aU estimate; and that the division of Business License does not have the information needed to compile the individual assessments. Assistant City Manager stated that the numbers used to figure the assessments is constantly changing due to the fluctuating number of businesses; and that the total figure for the assessment district is $7,000 less this year, than last year. DBID - 1992-93 LEVY (Cont'd) Mayor stated that the businesses that pay the assessment are generally not questioned as to the assessed amounts; that the question arises when the assessment is delinquent; that if the business is assessed a certain figure, and that figure does not seem to coincide with the amount of business generated, the Finance Director would call the business to verify the amount; and that Ms. Gattuso has been contacted to explain the assessment figures and process; and that the proposal of the $10,000 administrative service fee, will be funded through delinquent fees. Resolution 17955 as recommended was presented, after which; it was moved by Reller, seconded by Hodges, and unanimously carried, Lyons absent, that R17955 be adopted.
