CITY COUNCIL MINUTES
FEBRUARY 26, 1991
An Adjourned Regular Meeting of the City Council of the City of
Palm Springs, California, was called to order by Mayor Bono in
the Large Conference Room, City Hall , 3200 Tahquitz Canyon Way,
on Tuesday, February 26, 1991, at 3 p.m.
ROLL CALL: Present: Councilmembers Broich, Hodges, Murawski
Neel and Mayor Bono
Absent: None
REPORT OF POSTING OF AGENDA:
Report of City Clerk: Agenda posted in accordance with
Council procedures on February 22, 1991.
PUBLIC COMMENTS:
a) Alan Bayrak read a prepared statement, a full copy
of which is on file with the City Clerk, as a self-
appointed advocate of tenant's rights, describing
what he considered to be prejudicial acts by the Rent
Review Commission and City Attorney, and not in the
best interests of the tenants. He stated that in
one instance, only the landlord was notified of a
hardship increase hearing; that the City Attorney's (085-
office gave advice to a landlord on the procedure 004)
for asking for and getting rent increases; that
more power should be given to the rent control admini-
strator to enforce the letter as well as the spirit
of the new Rent Control law; and that the Council
should appoint a new attorney. He also stated that
there should be a means whereby tenants can seek to
instigate rent reductions because of being overcharged,
or because of diminished service.
City Attorney to review Mr. Bayrak' s concerns and
report back to the Council .
LEGISLATIVE ACTION:
1. CONVENTION CENTER - ARCHITECT
Recommendation: That the Council approve agreement with
Ellerbe Becket Inc. , for architectural design, bidding,
and construction administration services for the Convention
Center expansion, for $394,338, plus reimbursables up
to $45,000, and an incentive fee of $21,000 for completion
of construction document phase on or before February 28, (139-
1991 - Agr 2959. 004)
Director of General Operations stated that the architect
has been working on the project, under a verbal arrangement,
while the contract was being worked through the City
Attorney.
Mayor stated that it appears the expansion project will
move forward, but urged that the Council focus on the
bigger picture of what it is trying to achieve; that he
feels it is more important to implement the total master
plan of the city so the product for the city is created,
which will justify expanding the convention center, and
under those circumstances it would be a welcomed addition;
and that without implementation of the master plan, the
task at hand will become more and more difficult,

Minute Order 4718, as recommended, was presented; after
which, it was moved by Broich, seconded by Neel , and
unanimously carried, that MO 4718 be adopted,.
2. CONVENTION CENTER - CHILLERS
Recommendation: That the Council award bid for direct-fired
chillers for the Convention Center expansion.
Purchasing Manager reported that this item is the second
of two items requiring long lead time; that no bids were
received by the bid deadline, and under provisions of
the Municipal Code., he negotiated with the two contractors
who were the only potential suppliers; and that the negoti-
ated price of $240,500 from York International , is below
budget estimate; that within 10 days from the date of
notice of award, shop drawings are to be delivered to
locations specified by the City; and the architect will
have 7 days in which to approve the drawings; and that
the completed chiller shall be delivered to the job site
by September 30, 1991.
In answer to question by Council , Director of General
Operations reported that concerning warranty„ the contractor
will be required to provide all repair within the first
twelve months; and that the question of proper operation
will always be an issue, whether warranty is provided
in this manner, or through battling with the manufacturer.
Minute Order 4719, awarding bid to York International
(Agr 2960) , as recommended, conditional upon negotiating
acceptable terms and conditions of the procurement contract
within fourteen days, was presented; after which, it was
moved by Broich, seconded by Neel , and unanimously carried,
that MO 4719 be adopted.
ADJOURNMENT
There being no further business, Mayor declared the meeting
adjourned.
