HomeMy WebLinkAbout1990 - MINUTES - 11/27/1990 CITY OF PALM SPRINGS CITY COUNCIL MINUTES NOVEMBER 27, 1990 An Adjourned Regular Meeting of the City Council was called to order by Mayor Bono in the Large Conference Room, City Hall , 3200 Tahquitz-McCallum Way, on Tuesday, November 27 , 1990, at 2 p.m. ROLL CALL: Present: Councilmembers Broich, Hodges, Murawski Neel and Mayor Bono Absent: None REPORT OF POSTING OF AGENDA: Report of City Clerk: Agenda posted in accordance with Council procedures on November 21, 1990. COMMUNITY REDEVELOPMENT AGENCY: Mayor declared the meeting adjourned for the purpose of convening as the Community Redevelopment Agency; after which, the Council reconvened. PUBLIC COMMENTS: None LEGISLATIVE ACTION: 1. FTM 25112 - BARCON Recommendation: That the Council approve final tract map 25112 for condominium purposes on the NW corner of Avenida Caballeros and Saturnino Road, in Section 14 - Barcon Development (Tentative Map approved January 3, 1990) . Memorandum highlighted by the Director of Community Development. Councilmember Hodges asked if the Tribal Council has commented on the recommendation. Director of Community Development stated that the comment was given at the time of the tentative tract map approval ; and that the tentative map is good for two years. (137- 067) City Attorney stated that the action to approve the final map is ministerial , once the City Engineer certifies that the conditions of the tentative map have been approved. It was moved by Hodges, seconded by Murawski , and unani- mously carried, that this matter be continued to December 5, 1990, in order to verify Tribal Council ' s input. HEARINGS: (Continued from November 21, 1990) 2. AA CASE 3.0769 - KRZYWON APPEAL On November 21, 1990 the Council continued hearing and consideration of appeal regarding addition to residence at 2495 Palermo. Mayor stated that he had not reviewed the November 21 proceedings; and City Attorney stated that he should not participate unless he has familiarized himself with the (lli- hearing. 001) Council Minutes 11-27-90 Page 2 2. AA 3,0769 (Continued) Councilmember Hodges stated that she has not had an opportunity to yet view the site, and suggested that this matter be placed on the December 5 agenda. Mayor inquired if anyone wished to be heard. Terry Rouche, architect for the project, stated that he has taken the environment and the neighbors concerns into consideration, and feels everything that has been required has been done; that a two-story addition will not block anyone' s view; that the house has been lowered 2% feet; that he is sympathetic with the neighbors but thinks the issue is with the City and not the Krzywons; that he has complied with the codes; and that the neighbors concerns are that the entire neighborhood will become two story. Ramona H. Case, 2424 Vista, stated that she has never been contacted by Mr. Rouche, although she tried to contact him; that she is not opposed to a split-level house; that after the Council 's action, the owner still came back with a two-story structure; that a lowering of 3 feet was mentioned at the Planning Commission meeting, and now Mr. Rouche states it will be 21-2 feet; that the owner can build to a view in four directions; that the existing residents are being affected by the desire of one owner; and that she has not had anyone sit in her house and experience what the two-story impact will look like. Minna Kanya, 2494 Vista, stated that from her viewpoint in her living room, the story pole indicates that one-half of her view will be lost; that the loss of the view results in a devaluation of property; and that she is concerned about two-story in this hillside area. Margaret Krzywon, 2495 Palermo, stated that there is a two-story house on her street that no one objected to; that her property is hard to build on; that she wants a two-story house; that Mrs. Kanya' s property is above her lot, and there is one other house to the south; that the roof line will not be higher than her chimney; that her sewer interferes with building on a part of her lot; that everyone she has spoken to likes the project; that she feels property values will increase; and that it is her dream house. Jim Case stated that the house Mrs. Krzywon referred to was not objected to because it did not block other people' s view; that the view from the Hortner property is considered an added value to the property; that two-story is not an added value, rather the overall size of the house; that a split level was approved, and that if this were a small matter, so many people would not be complaining. Mayor declared the hearing closed. Planning Director reported that greater heights in the hillside area are discretionary with the Planning Commission, and not automatic; that terrain, landscaping, and view are considered, but it is not mandatory that every view be taken into account; that in some instances field trips are necessary; that the Commission directive is to advise neighboring property owners immediately of proposals for two-story; that the directive was followed in this case; and neighbors were advised of the Commission ' s meeting. AA 3.0769 (Continued) Councilmember Murawski stated that some views would be lost; that the horizon view from the Kanyas would be preserved; that the owners have gone through the process; and that he hoped other Councilmember' s will also visit the site. It was moved by Bono, seconded by Neel , and unanimously carried, that this matter be continued to December 5, 1990. LEGISLATIVE ACTION: 3. SIGN ORDINANCE COMMITTEE - COUNCIL LIAISON It was moved by Broich, seconded by Murawski , and unani- mously carried, that the appointment of Councilmembers Broich and Hodges to serve a liaison committee to develop recommendation regarding a possible committee concerning ( 103 the Sign Ordinance be confirmed. 038) RECESS - For the purpose of reconvening for Council goal settling, at 5:30 p.m. , in the Palo Verde Room, Convention Center.
