The Palm Springs Economic Development Corporation is in full support of moving the Smoke
Tree Commons Project forward. We believe this project brings quality economic development
to the City of Palm Springs brings much needed services to our community and assists in our
focus for positive revitalization.
The developer has listened to the concerns of our city. Appropriate changes have been made
and approved by both the Architectural Advisory Committee and the Planning Commission.
Please allow this project to move Forward for the betterment ot'the City of Palm Springs and its
residents.

SUMMARY
The City Council will consider the revisions to the final architectural plans for a proposed
shopping center project consisting of up to fourteen buildings ranging in size from M
approximately 2,800 square feet to 28,000 square feet, and totaling approximately Z
'170,000 square feet.

RECOMMENDATION:
1. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE

PLANS FOR CASE NUMBER 5.1050 AND PD-312 ALLOWING FOR THE _

STAFF ANALYSIS:

On June 7, 2006, the City Council conducted a public hearing to review the application
for the development of an approximately 170,265 square feet shopping center on an 18-
acre site. At that meeting, the Final Environmental Impact Report prepared for the
project was certified, and the proposed use was approved by the Council. However, the
Council directed that revisions be made to the site plan and the architectural designs;

the Council further directed that the project return to the Architectural Advisory
Committee and Planning Commission for additional review.
The applicant has revised the project and the Architectural Advisory Committee
reviewed the project at its meeting on October 9, 2006, and by a vote of 5-0-2 (Jim
Cioffi and Chris Sahlin abstained) recommended approval to the Planning Commission.
The revised project will be reviewed by the Planning Commission at its regular meeting
on October 25, 2006, immediately prior to the Council meeting. Staff is recommending
approval to both the Commission and Council, and will provide an oral report of the
Commission's actions at the October 25, 2006, City Council meeting.
ENVIRONMENTAL ASSESSMENT:
A Final Environmental Impact Report was previously adopted by the City Council on
June 7, 2006. Pursuant to Section 15162 of the California Environmental Quality Act
(CEQA), the preparation of further documentation is not necessary since the
circumstances surrounding the project have not changed. The present project could not,
therefore, result in any new environmental impacts beyond those already identified and
assessed in the certified Environmental Impact Report.
FISCAL IMPACT: IFinance Director Review:
No fiscal impact.

Craig Ewing, Director of Planning Services, provided background information
as outlined in the staff report dated June 7, 2006.
City Attorney Holland provided the City Council with a revised Resolution for
consideration by the City Council.
Mayor Oden opened the public hearing and the following speakers
addressed the City Council.
JEFF CHAMBERS, Representing Applicant, stated he was available for
questions.
MICHAEL LIEBERMAN, Representing Applicant, provided background
information with respect to the development.
CHRIS ELLIOTT, Representing Applicant, provided the City Council with an
update on the proposed tenants.
EMERSON SCHARTZKOPT, Palm Springs, stated the homeowners
association is not opposed to the project, but they are opposed to the
extension of La Reina Way.
JOHN MORRIS, Palm Springs, President of Garden Villas, stated he is
opposed to the site plan, and recommended the City Council follow the
recommendation of the Planning Commission.
LYNDA KERNEY, Palm Springs, stated she is in favor of the project, but
opposed to the third traffic signal and requested the main entrance on
Farrell.

JOY MEREDITH, Palm Springs, spoke in support of the project.
No further speakers coming forward, the public hearing was closed.
Mayor Oden requested staff address the noticing process.
Councilmember McCulloch requested staff respond to the extension of the
roadway.
Councilmember McCulloch requested staff address the discussion of
architecture and the site plan at the Planning Commission and Architectural
Advisory Committee meetings.
Councilmember Mills noted the sequential numbering on page 3 of the
Conditions of approval, noted Condition No. 11 does not apply to this project
and the condition should be deleted from the Conditions; and Condition No.
15 does not pertain to commercial properties and should be deleted in the
conditions.
Councilmember Mills commented on and requested staff address several
components of the site plan and proposed several alternatives.
Mayor Pro Tem Foat commented on several elements of the project, and
noted her concerns with excessive traffic lights; requested staff address
components of the site plan.
Councilmember Poupnet commented on the mix of retailers, noted his
agreement with previous co nts made b ouncil with respect to

Mayor Oden commented on the grouping of certain stores in the retail
center, stated his agreement with Councilmember McCulloch regarding the
traffic signal and his agreement with Councilmember Pougnet on
the Frontage Road, commented on the setbacks, and stated he would
request the City Council have the final approval on the architectural review.
Councilmember Mills commented on the planning and development of
retention basins, and stated that the City Council is only approving one
drive-thru restaurant.
ACTION: 1) Adopt Resolution No. 21609, "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, FINDING
THAT THE FINAL ENVIRONMENTAL IMPACT REPORT FOR CASE
5.1050 PD-312 IS ADEQUATE AND COMPLETE, CERTIFYING THAT
REPORT, ADOPTING A STATEMENT OF OVERRIDING
CONSIDERATIONS, AND DIRECTING STAFF TO FILE THE ASSOCIATED
NOTICE OF DETERMINATION, AMENDING THE GENERAL PLAN TEXT
TO ALLOW A SPECIALTY MARKET WITHIN THE SMOKE TREE AREA
PLAN; AMENDING THE GENERAL PLAN CIRCULATION MAP TO
RECLASSIFY THE SECTION OF EAST PALM CANYON DRIVE
ADJACENT TO THE PROJECT SITE AS A "MAJOR THOROUGHFARE" IN
ORDER TO FACILITATE THE ELIMINATION OF THE FRONTAGE ROAD,
AND ADOPTING PLANNED DEVELOPMENT DISTRICT 312, APPROVING
THE SITE DEVELOPMENT PLAN, ON AN APPROXIMATE 17.99-ACRE
SITE LOCATED ON THE SOUTHWEST CORNER OF EAST PALM

amended by correctly numbering the Conditions of Approval, deleting

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, APPROVING THE FINAL
ARCHITECTURAL PLANS FOR CASE NUMBER 5.1050
AND PD-312 ALLOWING FOR THE DEVELOPMENT OF
AN APPROXIMATELY 170,000 SQUARE FEET SHOPPING
CENTER ON AN APPROXIMATELY 18-ACRE. SITE
LOCATED ON THE SOUTHWEST CORNER OF EAST
PALM CANYON DRIVE AND FARRELL DRIVE, ZONE CS-
C, SECTION 36
WHEREAS, on June 7, 2006, the City Council voted to approve Case No 5.1050-PD-
312 for a Planned Development District (PD-312); and
WHEREAS, the Final Environmental Impact Report (FEIR), for the project was
previously adopted by the City Council on June 7, 2006, in conjunction with the approval
of Case No 5.0984-PD-291, Planned Development District (PD-291); and
WHEREAS, on June 7, 2006, the City Council directed the applicant to make changes
to the site plan design and project architecture; and
WHEREAS, on June 7, 2006, the City Council directed the applicant to take the revised
plans back to the Architectural Advisory Committee and the Planning Commission for
addition review: and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the meeting on the project, including but not limited to the
staff reports, all written and oral testimony submitted by the applicant, and all written
and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1: Pursuant to CEQA, The City Council finds that the Final Environmental
Impact Report (FEIR) adequately addresses the general setting of the
project, its potentially significant impacts, and the mitigated measures
related to each significant effect for the proposed project. The City Council
further finds with the certification of the Final Environmental Impact Report
(FEIR), potentially significant environmental impacts resulting from this
project will be reduced to a level of insignificance.
Section 2: The City Council approves the final design and architectural plans for
Case Number 5,1050 PD-312.
ADOPTED this 251h day of October, 2006.
