APPROVAL OF AMENDMENT #1 TO AN AGREEMENT WITH DESERT JANITOR CO.
FOR LOT CLEANUP OF A 6.25 ACRE SITE OWNED BYTHE LOW/MOD HOUSING FUND
OF THE COMMUNITY REDEVELOPMENT AGENCY, PARCELS (510-013-001, 515-015-
001, 510-017-001)
RECOMMENDATION:
It is recommended that the Agency approve Amendment#1 to the Contractual
Services Agreement with Desert Janitor Co., in an amount not to exceed$2,785.00 to
perform a lot cleanup on an Agency-owned parcel, bringing the total contract amount
to $7,085.
SUMMARY:
The Agency contracted with Desert Janitor Co. in February,2001 to clean up the Prairie
Schoonerparcel because of the problems with debris,the tamarisk trees,and vagrants.
That cleanup was $4,300 and did have to be approved by the Agency. In March, the
City's Code Enforcement staff notified Agency staff of complaints about trash and debris
on the 6.25 acre Agency-owned parcel between Coyote Run and Sunrise Norte. Code
Enforcement was recently successful in abating problems on a privately owned problem
and asked that the Agency clean up its lot. The quote from Desert Janitor Co. was for
$2,785.
BACKGROUND:
The properties to be abated are near, but not a part of, the land that the Agency
and City are negotiating to sell to Burnett Development. The property was
acquired for the developement of affordable housing, but there is no current
proposal for its use.
Funds are available in 882-83827

FIRST AMENDMENT TO CONTRACT SERVICES AGREEMENT
WITH DESERT JANITOR SERVICE FOR LOT CLEAN UP
THIS FIRST AMENDMENT TO CONTRACT SERVICES AGREEMENT ("Amendment')
is entered into this_day of , 2001 (the "Effective Date") by and between
the COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF PALM SPRINGS,
CALIFORNIA, a public body, corporate and politic, ("Agency") whose offices are located at P.O.
Box 2743, 3200 East Tahquitz Canyon Way, Palm Springs, California 92263 and Desert Janitor
Co., whose offices are located at 100 South Sunrise Way, Palm Springs, California, 92262
("Contractor").
RECITALS
A. On February 22, 2001, Agency and Contractor entered into that certain Contract
Services Agreement ("Original Agreement') pursuant to which Contractor agreed to clean up
the Agency-owned "Prairie Schooner" parcel.
B. Agency and Contractor desire to amend the terms of the Original Agreement as
more particularly described herein.
C. Any capitalized terms not defined herein shall have the meanings ascribed to
them in the Original Agreement. The Original Agreement, as modified by this Amendment, is
hereinafter referred to as the "Agreement."
NOW, THEREFORE, the parties hereto agree as follows:
1. Section 2.1 of the Original Agreement entitled "Contract Sum" shall be amended to read
as follows, the specific amendments shown below as highlighted text:
2.1 Contract Sum. For the services rendered pursuant to this Agreement, the
Contractor shall be compensated in accordance with the "Schedule of Compensation" attached
hereto as Exhibit "C' and incorporated herein by this reference, but not exceeding the maximum
contract amount of SEVEN THOUSAND EIGHTY FIVE DOLLARS ($7 085.00) (herein
"Contract Sum"), except as provided in Section 1.8. The method of compensation may include:
(i) a lump sum payment upon completion, (ii) payment in accordance with the percentage of
completion of the services, (iii) payment for time and materials based upon the Contractor's
rates as specified in the Schedule of Compensation, but not exceeding the Contract Sum or (iv)
such other methods as may be specified in the Schedule of Compensation. Compensation may
include reimbursement for actual and necessary expenditures for reproduction costs, telephone
expense, transportation expense approved by the Contract Officer in advance, and no other
expenses and only if specified in the Schedule of Compensation. The Contract Sum shall
include the attendance of Contractor at all project meetings reasonably deemed necessary by
the Agency; Contractor shall not be entitled to any additional compensation for attending said
meetings.
Exhibit "A", Scope of Services shall be amended to add the following:

The Contractor is additionally engaged to perform a clean up of three parcels owned by
the Community Redevelopment Agency on Sunrise Way, north of San Rafael Road (Parcels
510-013-001, 515-015-001, 510-017-001). The Contractor shall haul away the debris and trash
cleared from the site and properly dispose of such debris at a permitted or other legal disposal
facility.
The Contractor shall be paid in a single payment upon completion of the clean-up of the
above-mentioned parcels.
2. Full Force and Effect. Except as expressly stated herein, all other terms of the Original
Agreement shall remain in full force and effect.
IN WITNESS WHEREOF the Agency and Contractor have executed this Agreement as of the
date first written above.

BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT AGENCY of the City of
Palm Springs, California, that Amendment#1 to a Contract for Services with Desert
Janitor Co., in the amount of$2,785, for the clean up of a vacant Agency-owned
property on North Sunrise Way, bringing the total contract amount to $7,085, is
approved.
