Ready, City Manager Initiated By: Director of Public Works/City Engineer SUMMARY The proposed amendment and accompanying resolution would add one street to the Palm Springs Municipal Code Section which prohibits commercial vehicles from using certain streets. Commercial vehicles over 8 tons will be prohibited from using Livmor Avenue. RECOMMENDATION: 1) Waive the reading of the Ordinance text in its entirety and introduce by title only, 2) Introduce on first reading Ordinance No. "ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA AMENDING SECTION 12.56.042 OF THE PALM SPRINGS MUNICIPAL CODE, ADDING LIVMOR AVENUE TO THE LIST OF STREETS WHERE COMMERCIAL VEHICLES EXCEEDING CERTAIN DESIGNATED WEIGHTS ARE PROHIBITED." STAFF ANALYSIS: Currently, the PSMC designates sixteen streets whose use is prohibited by commercial vehicles in excess of 8 tons gross vehicle weight. Those streets are Chino Canyon Road, Panorama Road, Cielo Drive, Vista Drive, Leonard Road, Tuscan Road Sunny Dunes Road, Calle Palo Fierro, Indian Trail, Vista Oro, Camino Real, Warm Sands Court, Warm Sands Drive, Grenfall Road, Thornhill Road and Calle Amigos. Over the past year residents on Livmor Avenue between Farrell Drive and Civic Drive have expressed increasing concern with commercial truck traffic from the Rental Car yards traversing through the neighborhood on the local streets rather than staying on Civic Drive to Tahquitz Canyon. ITEM NO.-3' A ' City Council Staff Report October 4, 2006 - Page 2 Municipal Code Amendment - Title 12 Citizens have requested the City Manager to sign these local streets such that commercial truck traffic cannot use them as through routes. This would result in commercial vehicles staying on Civic Drive, unless specific deliveries within the local streets in this area are to be made. The California Vehicle Code allows cities by ordinance to prohibit the use of a street by any commercial vehicle exceeding a maximum grass weight limit, except that those vehicles are allowed to use all streets for the purpose of making pickups or delivery of goods from or to buildings located on the restricted street. Airport staff has, over the past year attempted to achieve voluntary compliance by writing to the various car rental companies. This attempt has not been successful. In response to this, staff proposes using signs which restrict this local street for use by any commercial vehicle over 8 tons. The street in question is Livmor Avenue. The adoption of the attached resolution will introduce an ordinance which adds t above mentioned street to the list of streets within the PSMC whereinacm vial vehicles are prohibited. FISCAL IMPACT: I Finance Director Review: Posting of one sign on Livmor at Farrell Drive and one at Civic Drive within this area is estimated to cost between $ 300-$500, which could be partially recovered to an unknown extent depending on the level of enforcement and the amount of citations written in this area. 11 DAVID J. City Attorney's Summary The City of Palm Springs prohibits commercial vehicles from using certain specified streets. This ordinance adds one street to the list of streets where such commercial vehicles are prohibited. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ORDAINS AS FOLLOWS: SECTION 1. Section 12.56.042 of the Palm Springs Municipal Code be amended by adding the following table. The following streets are designated as streets where use is prohibited as to commercial vehicles . The City Clerk is authorized to add the above street following the streets previously designated by the Council and included in Section 12.56.042 of the Palm Springs Municipal Code. SECTION 3. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage. Neighbors are concerned with the practice of these commercial vehicles using Livmore Drive for the ingress and egress to and from the rental company's storage yards. Livmore is clearly a residential street and is too narrow to carry commercial traffic that does not have a destination within the neighborhood. Many times these trucks are exceeding the speed limit. I have personally witnessed more than one of these trucks using Livmore without due care. While we understand that these transport companies are not employed by you, they are working under contract directly for your company. As tenants of Palm Springs International Airport's property we are seeking to solicit your assistance in directing them to use only Civic Drive and Alejo Road as access to your facilities. The City of Palm Springs will be moving forward to formally restrict the use of Livmore for commercial traffic without specific business within the neighborhood, Your immediate assistance with this issue is greatly appreciated.
