Fp AI.M SA c V N k n �oReOenieo °' k CITY COUNCIL STAFF REPORT DATE: September 6, 2006 CONSENT CALENDAR SUBJECT: REPAIR OF THE GENE AUTRY MEDIAN SCULPTURE SAIL AND MOUNTAIN FROM THE PUBLIC ARTS MAINTENANCE FUND IN AN AMOUNT NOT TO EXCEED $8,000. Ready, City Manager BY: Community & Economic Development SUMMARY The Gene Autry Trail and Ramon Road Median landscaping project was initially funded by a Federal TEA Grant obtained through the Public Works Department, the total amount of the grant was $521,571. This grant paid for the installation and design of the median landscaping and irrigation. The "Sail and Mountain" sculptures were purchased through Measure A funds for a total cost of $107,500. The pieces were designed by Landscape Architect Ronald Gregory and fabricated by Palm Springs Welding. The Public Arts Commission approved the design concept and median landscaping on August 17, 2001. The sculptures were installed in October 2004. On February 14, 2005 a "Mountain" sculpture, located on the Gene Autry Trail median, was damaged by a hit-and-run accident. No police report was filed regarding the incident and the Police Department did not have any additional information or suspect(s) leads. A repair estimate was obtained from Palm Springs Welding, the total cost for repair is $8,000. The Public Works and Parks and Recreation Departments have requested that the Public Arts Maintenance Fund incur the cost of the repair. Staff presented this request to the Public Arts Commission at the November 10, 2005 Commission meeting. The Commission voted 5/0 not to approve the repair of the damaged "Mountain" sculpture located on Gene Autry Trail because they felt that the "Sail and Mountain" sculptures are decorative pieces, designed by a landscape architect and do not qualify as Public Art. Risk Management does not want to file a claim to repair the sculpture because the deductible exceeds the cost of repair. Adopt Minute Order No-� Approving the repair of the Gene Autry Median Sculpture Sail and Mountain with Palm Springs Welding in an amount not-to- exceed $8,000 from the Public Art Maintenance Fund. STAFF ANALYSIS: The "Sail and Mountain" sculptures were purchased through Measure A funds for a total cost of $107,500. The Public Arts Commission approved the design concept and median landscaping on August 17, 2001 with no impact to the Public Arts Fund. The sculptures were installed in October 2004. Each artwork consists of perforated metal mesh with a tubular steel frame. The concept for the median sculptures borrows from the panoramic backdrop offered by the airport terminal and surrounding mountains. On February 14, 2005 a "Mountain" sculpture, located on the Gene Autry Trail median, was damaged by a hit-and-run accident. No police report was filed regarding the incident and the Police Department did not have any additional information or suspect(s) leads; therefore, the City cannot reasonably anticipate payment from the driver's insurance company. A repair estimate was obtained from Palm Springs Welding; the total cost for repair is $8,000. Engineering and Parks and Recreation have requested that the Public Arts Maintenance Fund incur the cost of the repair. Because this project was funded through federally obtained grants a "sculpture maintenance" budget was not created by either Engineering or Parks and Recreation nor was additional funding provided by the grant for maintenance or damage to the sculptures. Staff presented this request to the Public Arts Commission at the November 10, 2005 Commission meeting. The Public Arts Commission voted 5/0 not to approve the repair of the damaged sculpture. Risk Management does not want to file a claim to repair the sculpture because the deductible exceeds the cost of repair. This request to repair "Mountain" sculpture is consistent with Public Arts Ordinance No. 1479, Chapter 3.37.100 "Maintenance of Artwork on Public and Private Property". Staff recommends that the repair of the sculpture(s) that have been damaged be paid for through the Public Arts Fund. 7 fl FISCAL IMPACT: Finance Director Review: There is no impact to the General Fund.
