Planning Commission Staff Report August 9, 2006
Case 5.1069-CUP Page 2 of 5
PRIOR ACTIONS:
On June 12, 2006, the application was brought before the Architectural Advisory
Committee (AAC). The AAC recommended (4-0) approval of the project subject to the
following conditions being met:
• Vary height of live palms (minimum of twenty feet tall and at least two at thirty
feet tall); and,
• Provide landscaping around exterior of equipment shelter.
The plans have been revised to address these conditions and are presented before the
Planning Commission as the date hereof.
On July 18, 2006, the application was brought before the Tribal Council (TC) of the
Agua Caliente Band of Cahuilla Indians. The TC reviewed and recommended approval
as proposed to the City.
BACKGROUND:
Alcoa Wireless Services ("the applicant"), agent for the Methodist Church of Palm
Springs ("owner"), has submitted an application for a Type II Conditional Use Permit.
The applicant has secured a Letter of Authorization with the owner to proceed with the
Type II Conditional Use Permit application.
The project site is a flat lot, located on the southeast corner of East Alejo Road and
North Calle Rolph within Section 14. The Methodist Church of Palm Springs is
presently operating primarily on the northerly half of the parcel. The wireless facility is
proposed towards a southerly portion of the site.
The proposed wireless communication antenna is designed as a monopalm with
artificial palm fronds and a textured trunk. The proposal includes five live palm
(Washington Robusta) trees and the construction of a twelve foot high, 750 square foot
(thirty feet by twenty-five feet) enclosed shelter attached to the south wall of an exising
garage. Landscaping is also proposed on the east and west sides of the shelter.
The shelter is divided in half by a wall. The western half of the shelter (375 square feet)
will be used by Sprint Nextel for the equipment storage and the eastern half is a
proposed storage area for the landlord.
The lease area is 615 square feet, which includes the Sprint Nextel's equipment storage
area (375 square feet) and the wireless communication monopalm.

General Zoning Existing Land Uses
Plan
North L4 R-1-C Single Family Residential

ANALYSIS:
The General Plan designation of the subject site is M8 (Medium Density Residential) /
H43/30 (High Density Residential). While the General Plan does not specifically
regulate the installation and operation of wireless communication facilities, staff believes
the use as proposed is compatible with this designation. The zoning designation is
MBR (Medium-Buffer Residential) / HR (High Density Residential), and the use is
permitted with the approval of a Conditional Use Permit, pursuant to Section 93,08 of
the Palm Springs Zoning Orndinance (PSZO).
Pursuant to Section 93.08.03(A)(2)(c)(iii) of the PSZO, "No part of the antenna structure
shall extend to a height of more than twenty-five (25) feet above the highest point of the
roof of the principal building on the property." The height of the sanctuary is thirty feet
and the height of the chapel is twenty-five feet. Therefore, the maximum height of fifty-
five feet would be in conformance. The applicant has proposed a monopalm height of
forty-five feet and is in conformance.
Table 2: Antenna development standards:
93.08.03(A)(2)(c)(iii) and Proposed Project
H43/30 / MBR Requirements (approx.)

55 maximum
Side East Yard Setback 20 feet 31 feet
Side West Yard Setback 30 feet 266 feet
Rear Yard Setback 20 feet 84 feet
The applicant has submitted photographs of the existing site as well as photographic-
simulation elevations of the proposed monopalm and how it would appear in the current
visual environment surrounding the site (see attacment A-3). These elevations depict
the proposed monopalm at forty-five feet and two palms at approximately thirty feet.

Planning Commission Staff Report August 9, 2006
Case 5.1069-CUP Page 4 of 5
Based on visits to the site and review of the elevations, staff believes that the proposed
monopalm together with the proposed live palms will have a minimal visual impact.
Airport staff was consulted regarding the proposed project and project location. Airport
staff anticipates that the proposed commercial communications antenna structure will
not be an obstruction (i.e., the structure does penetrate air space around the airport)
and the proposed antenna would not have direct and/or indirect impacts on operations
at Palm Springs International Airport. As a condition of approval, the applicant would be
required to obtain all necessary approvals from the Federal Aviation Administration prior
to issuance of building permits.
ENVIRONMENTAL DETERMINATION:
This project is categorically exempt from environmental review pursuant to Section
15301(e) (Class 1 - Existing Facilities) of the California Environmental Quality Act
(CEQA) and the Telecommunications Act.
(NOTIFICATION:
A notice was mailed to all property owners within a four hundred (400) foot radius in
accordance with state law.
CONCLUSION:
Staff recommends the Planning Commission recommend approval to City Council to
approve Conditional Use Permit No. 5.1069, subject to the conditions set forth in Exhibit
A of the resolution.
