HomeMy WebLinkAbout21684 - RESOLUTIONS - 7/19/2006 RESOLUTION NO. 21684 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A, ONE-YEAR TIME EXTENSION FROM MAY 19, 2006 TO MAY 19, 2007 FOR TENTATIVE TRACT MAP 32263 TO SUBDIVIDE APPROXIMATELY 2.30 ACRES FOR CONDOMINIUM PURPORSES LOCATED AT 1301 MONTALVO WAY, ZONE M-1-P, SECTION 7. WHEREAS, the RSM Arbours, LP, (the "Applicant") filed an application with the City pursuant to Section 9.60 of the Municipal Code for Tentative Tract Map 32263 to subdivide approximately 2.30 acres for condominium purposes located at 1301 Montalvo Way, Zones M-1-P, Section 7; and WHEREAS, on April 24, 2004, the Planning Commission voted to recommend that the City Council approve Tentative Tract Map 32263, subject to the conditions of approval; and WHEREAS, on May 19, 2004, the City Council voted to approve Tentative Tract Map 32263 subject to the conditions of approval; and WHEREAS, the Applicant has filed a request for a one-year time extension from May 19, 2006 to May 19, 2007 for Tentative Tracl Map 32263 with the City and has paid the required filing fees; and WHEREAS, on June 28, 2006, the Planning Commission held a public meeting and voted 6-0 to recommend that the City Council approve a one-year time extension of Tentative Tract Map 32263; and WHEREAS, on July 19, 2006, the City Council held a public meeting to consider the applicant's request for a one-year time extension of Tentative Tract Map 32263; and WHEREAS, the proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act (CEQA); and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1: The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined Resolution 21684 Page 2 to be Categorically Exempt pursuant to Section 15061(b)(3)(General Rule) ' of the CEQA Guidelines. Section 2: Approve a one year time extension from May 19, 2006 to May 19, 2007 for Tentative Tract Map 32263. ADOPTED THIS 19th day of July, 2006. David H.
