APPEAL:
The applicant, Desert Shadows 3 LP, has appealed the Planning Commission's recommendation
that the City Council not approve an amendment to an application for a Planned Development by
Desert Shadows 3 LP to include a private pedestrian bridge spanning Indian Canyon Drive North
(to be located approximately 341 feet south of Vista Chino) for the purpose of connecting the
proposed 17-unit condominium project and recreation building on a vacant 1.85 acre parcel at the
northwest corner of Indian Canyon Drive and Stevens Road (100 East Stevens Road), R-3/C-1
Zone, Section 10 to the existing Desert Shadows resort. The applicant is Desert Shadows 3 LP,
and the officers/owners are Mr. Ray Lovato and Mr. Stephen Payne. The City Council can
approve, modify or overrule the recommendation of the Planning Commission. Based upon City
Council direction, staff will prepare the necessary appeal resolution for City Council consideration
at its next meeting.
SUMMARY:
On February 28, 2001, the Planning Commission conducted a public hearing to consider the
proposal and received correspondence and oral testimony both in support of and in opposition to
the project (copies of correspondence attached). The Planning Commission voted 5-1-1 (Raya
dissenting, Mills abstaining), to recommend that the City Council not approve an amendment to an
application to include a private pedestrian bridge spanning Indian Canyon Drive North citing
concerns regarding the need for such a structure, visual impact, compatibility of an urban type use
in a village environment and suggesting that a tunnel may be a more appropriate connection
between the private properties.
BACKGROUND:
On January 24, 2001, the Planning Commission voted 6-0-1 (Mills abstaining)to recommend that
the City Council approve Case No. 5.0853(Planned Development District 264 and Tentative Tract
Map 29988) for the development of a 17-unit condominium project and recreation building on a
vacant 1.85 acre parcel located at the northwest corner of Indian Canyon Drive North and Stevens
Road (100 East Stevens Road), R-3/C-1 zone, Section 10, through adoption of a Resolution of
Approval with Conditions. The applicant is Desert Shadows 3 LP, and the officers/owners are Mr.

On February 28, 2001, the Planning Commission voted 5-1-1 (Raya dissenting, Mills abstaining)
to recommend that the City Council not approve an amendment to the application to include a
private pedestrian bridge spanning Indian Canyon Drive North (to be located approximately 341
feet south of Vista Chino)forthe purpose of connecting the proposed 17-unit condominium project
and recreation building to the existing Desert Shadows Resort. The applicant emphasizes that the
bridge will be designed to serve as a decorative gateway to the community and serve as a
promotional tool for the City and businesses in the Uptown area, as well as serving as a connection
between the two private properties to provide guests at 100 East Stevens Road with access to the
various amenities at the existing resort.
The applicant has submitted a conceptual site plan which depicts stairways on either side of Indian
Canyon Drive North, both located entirely within the applicant's private property. On the west side
of the street, the stairwell will be located behind the proposed eight-foot high masonry walls which
are included as part of the application for the 100 East Stevens Road project,thus restricting public
view.
On the east side of Indian Canyon Drive North, the stairway would be located inside the existing
resort parking lot immediately north of the driveway. To restrict public view, the applicant proposes
to convert the existing parking spaces on the west side of the lot to compact parking spaces in
order to provide space to extend the existing eight-foot high masonry wall further to the south. A
solid eight-foot high security gate would extend across the parking lot and connect to another
proposed eight-foot high masonry wall which would then connect to the existing private entry onto
the resort grounds. The gate would be set back far enough to allow misdirected vehicles to turn
around.
The applicant indicates that the parking lot on the east side of Indian Canyon Drive North serves
as overflow parking for resort patrons only, and parking counts conducted by staff confirm that the
lot is not fully utilized. The addition of the proposed stairway on the east side of North Indian
Canyon Drive would create a net loss of three parking spaces. It should be noted that the Planned
Development District for the existing resort (PD 240) included approval of a 10% reduction in the
number of required parking spaces.
The applicant notes that the stairways will be partially enclosed and will be ADA compliant via
utilization of an inclined wheelchair lift which has the ability to turn corners as it maneuvers up a
staircase. The lift has also has a pull down seat which provides the added function of
accommodating ambulatory persons who have difficulty climbing stairs. The City's ADA
Coordinator has reviewed the proposed chairlift and deemed it acceptable.
The conceptual site plan depicts a 100-foot clear span structure. The applicant indicates that the
bridge will have a minimum 16-foot clearance from the crown of the street, and the maximum
height will be approximately 22 feet. The bridge will be symmetrical in that the stairwells will be
approximately equidistant from the centerline of Indian Canyon Drive North. The columns will be
cast in place concrete. The applicant has submitted a conceptual design depicting a steel truss
design with awning-type fabric panels stretched between the steel frames. The Public Works
Department recommends that the bridge have a 17-foot clearance from the crown of the street.

The walkway would have a minimum width of three feet and a maximum width of four feet. The
City's ADA advises that a minimum four-foot width would be required. The side walls would be
approximately 54"high, although the applicant points out that the walls can be higher if necessary.
Although the stairwells will be built on site, the bridge will be built off site, and it is anticipated that
installation can be accomplished within a matter of hours, thereby requiring street closure for a
limited period of time.
At the Planning Commission's February 7,2001 study session,the applicant was questioned about
the choice of a bridge as opposed to a tunnel. The applicant explained that a tunnel was initially
considered, but deemed difficult due to existing underground utilities, particularly the sewer. The
applicant notes that the costs associated with a tunnel would be approximately the same as those
for a bridge, and the applicant chose to pursue the bridge concept due to the added benefit of
providing a gateway statement and promotional tool for the City and businesses in the Uptown
area.
The Planning Commission expressed concern regarding visibility of the traffic signal at the
intersection of Indian Canyon Drive and Vista Chino. Planning staff visited the site with the
applicant and determined that visibility of the signal would not be impaired.
The Commission was also concerned about the concept of a private bridge for the limited use of
17 units. The applicant emphasizes that the bridge will be designed to serve as a gateway to the
Uptown area in addition to providing guests at 100 East Stevens Road with access to the vast array
of amenities at the existing resort which include the check-in lobby with gift shop, full service
restaurant and bar, disco, three pools, two spas, tennis court, outdoor BBQs, work out room, full
service spa and beauty salon, sculpture garden with meandering creeks and waterfalls and
administrative offices.
Although only conceptual designs are being presented at this time, the applicant emphasizes that
the structure will be designed as a gateway to the Uptown area and incorporate design elements
and spaces for promotion of the City and Uptown area events. As such, the Uptown Business
Association is supportive of the proposal and believes it will serve as a catalyst to further
improvement to the Uptown area.
A meeting was held on February 26, 2001 for the purpose of obtaining resident input. The meeting
was attended byseveral members of the various neighborhood groups,the applicant and Planning
staff. Concerns expressed by the residents included: whether or not a private bridge should be
allowed in the public right-of-way(airspace)and related concerns about setting a precedent in that
regard; whether or not the structure would benefit the community; whether such a structure is
appropriate for a village environment; whether or not the structure would create visual blight; how
the structure could be designed to ensure safety, i.e., prevent users from throwing objects off; and
whether or not a tunnel would be a more appropriate connection between the private properties.

Due to the fact that the applicant is seeking conceptual approval only of the proposed use, the
project would be required to go before the Planning Commission for final approval. at which time
staff would recommend additional conditions of approval based on fully dimensioned plans. At this
time, the Planning and Engineering Departments have prepared conditions of approval based on
the conceptual site plan submitted (attached).
CONCLUSION:
The Planning Commission recommends that the City Council not approve an amendment to an
application for a Planned Development by Desert Shadows 3 LP to include a private pedestrian
bridge spanning Indian Canyon Drive North (to be located approximately 341 feet south of Vista
Chino) for the purpose of connecting the proposed 17-unit condominium project and recreation

To Whom It May Concern;
I want to take this opportunity to express my support for Desert Shadows' continued
endeavor to redevelop the uptown area. of Palm Springs. This unique and eclectic area
has seen a tremendous facelift since the development of Desert Shadows Inn.
Hirst and foremost, as a citizen of Palm Springs, it is my belief that the redevelopment of
this area has only enhanced the charm and beauty of the city. Secondly, as a business
person, I believe that this development has played a vital role in the recent success of the
hospitality industry as it has added another unique niche market, one of the most
important factors that differentiates our resort destination from others.
I believe it is in the best interests of all citizens of the city to endorse this redevelopment
project and to approve the bridge, as long as the city has final approvals on all design and
architectural plans,
1 am sorry that I cannot attend this evening's meeting, as 1 have a previous commitment.
I am there in spirit, however. 1 reiterate my support of this project and believe the real
winners will be the citizens of Palm Springs.

Dear Members,
I want to show my support for the petitioner of the proposed Desert Shadows
Development that you are reviewing today. Specifically, I want to lend my support to the
building of the entranceway bridge to Uptown Palm Springs. As some of you may know,
back in the early 1990s I was General Manager of the Riviera Resort. The corner of Vista
Chino and Indian was the worst looking corner of undeveloped land in the city of Palm
Springs. The vision of the Desert Shadows developer has transformed this corner into an
attractive piece of property, which has led the way for the recovery of this part of town.
The bridge is certainly a unique solution to what the developer needs to solve the tying
together of his properties. What Uptown Palm Springs gets is an entranceway bridge that
could be a spectacular feature if designed carefully and thoughtfully. As a property owner
in Uptown Palm Springs, I completely support this development and the entranceway
bridge.
I have heard continents that this could set a precedent for another developer wishing to
build another bridge in another part of the city. I am hard pushed to think of a developer
who would invest over$400,000 on a bridge linking two sites. If such a development
exists now or in the future, it should come under separate review apart from this proposed
bridge today. I urge you to 4R�pye this gateway bridgg qq� ply fpr this petitioner but

I am writing on behalf of the Board of Directors of the Palm Springs Hotel&
Hospitality Association to express our support for the expansion project of the Desert
Shadows Inn Resort &Villas. We applaud their dedication to our commtmity,their
continuing efforts to change the face of their neighborhood and positive contributions
over the past eight years to the City of Palm Springs.
Their proposed pedestrian archway, dedicated to Uptown Pahn Springs, will
become an instant landmark and continue to beautify a section of Pahn Springs that has
been ignored for too long. This well thought out project will further enhance the vacation
experience and the ambiance of north Pahn Springs. Their resort has been one of the
leading forces to the revitalization of Palm Springs. Their continuing efforts and
investment in our tourism industry benefits everyone in our village.
We look forward to having this ornamental archway as an addition to our tourism
experience.

As a result of your letter of request dated 20 February 2001, The Board of
Directors of the Palm Springs Chamber of Commerce made the following
decision during the regularly scheduled board meeting today, 22 February
2001.
The motion was made, seconded, and passed unanimously to support and
endorse the private pedestrian bridge across Indian Canyon. This bridge will
be an instant landmark and will establish a "point of entry" to the north end
of our community, and business district.
Understanding that Desert Shadows Inn Resort and Villas will pay in total
for the bridge construction and maintenance of the structure, without having
any identifying signs or logos associating with Desert Shadows Inn Resort
and Villas, is a generous contribution and asset that will be of benefit to our
business community, residents, and visitors for years to come.
Thank you again for inviting the Palm Springs Chamber to be part of your
continuing success, as the expansion of your property is again another
economic development advancement to this world class destination, which is

Subject: Bridge over the Drive Indian Canyon
Dear Mayor and Councilpersons:
was present in a Planning Meeting, Monday, February 26, 2001, in which
a conceptual plan for a proposed private-use pedestrian footbridge was
presented by the owners/operators of the Desert Shadows Resort. I was
pleased to be able to see and hear their ideas regarding this plan. I
do have some concerns regarding their plans. I am NOT in agreement with
their proposed use of public right-of-way. I believe that allowing this
type of construction will create a dangerous precedent in Palm Springs.
I personally enjoy the low-lying skyline provided by the style of
building and development in Palm Springs, one of the characteristics of
the city that has drawn me here. The idea was presented that no one's
view would be interrupted other than the residents at Desert Shadows
Resort. I beg to differ with that analysis, since a roughly 23 foot
high structure of steel and other materials, will impact more than just
the skyline of the residents on one single block.
I appreciate the personal energy given by these gentlemen. I want to
applaud their commitment to the area in which their business lies. I am
keeping in mind (and I am requesting that you do too) that these
gentlemen are real estate/property developers looking to expand their
development. The 'greater good' that they are proposing for the 'city'
would only benefit them and the 17 owners of new condominiums in their
development. Certainly, I do not propose inhibiting their right to
profit from their development, but please consider the cost and expense
to those of us that will be living with aftermath of this construction.
I am cautious in their presentation of this project as a possible piece
of 'artwork' left for the city to design as long as Desert Shadows
residents have 100% exclusive-use of the bridge.
Is there another way that pedestrians could cross this street? We were
told that tunneling was impossible. Somehow a tunnel was dug beneath
the San Francisco Bay. At-grade crossings are looked-down upon by the
city engineers, but can't a crossing of this type be made safe by timing
street lights with the flow-of-traffic and the crossing of these
pedestrians (as few as they might be)? Make the addition of warning
lights and signs for drivers and pedestrians?
In summary, I ask that you give serious consideration in NOT approving
this project. It seems that there are other solutions that won't

support our proposal for a Gateway Entrance to Palm Springs, via a walkway
between our resort and our new condominium project, we would request an
opportunity to appeal the decision to the Palm Springs City Council.
We understand that we are scheduled to have our project presented on March
21, 2001. We would request that our appeal of the February 28, 2001 Planning
Commission hearing be included in our scheduled project approval hearing on
March 21, 2001.

I am writing you on behalf of Sue Lovato, Linda Payne, Steve Payne, and myself. We,
the owners of Desert Shadows Inn Resort &Villas, are requesting that you give your
approval to our planned construction of 17 town homes located between Indian Canyon,
Palm Canyon and Stevens Road.
These condominiums will further enhance our resort, further beautify our Uptown
area by eliminating a blighted property that has been vacant for over two decades,
provide additional tax revenue for the city of Palm Springs, and continue the
revitalization of Palm Springs. These town homes will sell for approximately$350,000
dollars each. This project has been reviewed and recommended by the City of Palm
Springs Planning Department.
We are also requesting that you approve the plan for an aerial walkway that will be
used to join these two pieces of property into one contiguous resort experience. This
aerial walkway will be used exclusively by the homeowners and by resort guests on
special occasions. The aerial walkway will begin and end inside each property and be
locked with special key access only.
This aerial walkway will also serve as a decorative arch denoting Uptown Palm
Springs. Uptown Palm Springs has been without any public artwork, recognition, or
ornamental enhancement for too long. We would ask the City Council to allow the Public
Arts Commission or local artists to design the archway. It could also be designed in a
style similar to the decorative arch across Alejo and Palm Canyon to create a common
theme. The four of see this as a way of combining our resort needs with a contribution
back to the city and to the area that we will have invested over $ 15 million dollars in.
And to quote Frank Tyson from his comments at the City Council meeting of March 7,
2001, "The City Council cannot forsake the people who have put their money in this
town." We feel that this will allow us to contribute something of value to our city. The
Uptown Archway will become an instant landmark, a unique welcome to Palm Springs.
This walkway arch would be constructed, paid for and maintained by the new Home
Owners Association consisting of the 17 condominiums. We propose that no signage or
banners denoting Desert Shadows Inn would ever be placed on the arch. The use of the

Uptown Arch would belong exclusively to the City of Palm Springs to promote
citywide events, Film Festivals, parades and other civic activities. With the future
plans to improve the Indian Canyon off ramps at I-10, Indian Canyon will become an
even greater gateway to Pahn Springs.
This new project and Uptown Archway has the unanimous support of the Board of
Directors of the Palm Springs Chamber of Commerce, the unanimous support of the
Board of Directors of the Uptown Business Association and the Board of Directors of
the Palm Springs Hotel& Hospitality Association. It has the unanimous support of the
Board of Directors of the Desert Shadows Condominium Association, the
neighborhood group of 115 Pahn Springs homeowners who are directly to the east of the
new town homes and walkway and will be most affected by it.
The project has the full support of the Riviera Resort & Racquet Club, the largest
convention hotel in our city and our neighbors directly to the northeast on Vista Chino
and Indian Carryon. It has the support of Wayne Gottleib, CPA, who owns three parcels
of property along Palm Canyon immediately to the east of the project. It has the support
of Dr. Richard Kraus, who owns the other two parcels of property on Pahn Canyon
immediately to the east of the project. It is supported by Edith De Crinis, who owns the
doctor's office directly to the south west of the project at Stevens Road and Pahn
Canyon. It has written support from people in the apartments south of Stevens Road.
The project has the neighborhood support of. Baker's Square restaurant on the corner of
Vista Chino, Indian and Palm Canyon; Yousef s Mobile Gas Station on the corner of
Vista Chino and Palm Canyon; and The Left Bank restaurant on the corner of Vista
Chino and Indian Canyon. It is supported by Uptown business owner Linda Decker of
Las Palmas Gallery.
We had a neighborhood meeting, which was held at Desert Shadows Inn on December
30, 2000. Notices were sent out to 92 property owners who are in the area of the
proposed project and aerial walkway. The scope and details of the proposed project
were outlined and input was requested of our neighbors. There were no objections
returned to the City by any property owner in our neighborhood.
We hope that the City Council will continue to respect the overwhelming input of
the affected neighborhood and the input of legitimate elected civic groups that have
the best interest of the entire city at heart. We have done everything to involve our
neighborhood in this project.
We ask the City Council to reverse the negative decision proffered by the Planning
Commission and allow us to join the two separate parcels of our resort with an aerial
walkway that will serve as an Uptown Arch Landmark to welcome travelers and promote
our city.

Dear Members of our City Council;
I would respectfully, but strongly request the Council to approve their proposed bridge
which is critical Connection to ensure the success of their new project.
The owner/developers, through great vision, personal risk, expense and much hard
work, have removed a blighted empty lot and an outdated motel replacing them with
upscale, TOT and increased property tax producing projects. They wish to continue. This
area now looks modern and upscale compared to depressing look it had before they went
to work. But the proven key to their removing yet one more empty lot and increasing the
city's tax base is easy access to their central facilities.
I understand that every business in their area is in full support of the Project and the
bridge. For visitors entering Palm Springs from the high desert, this bridge will represent
the formal "Welcome" to Palm Springs. My understanding is the city will have full use of
the bridge for advertising the city, special events, etc. This area Of Palm Springs sorely
needs improvement and motivation for others to invest and improve this area as Desert
Shadows has so successfully done.
Please approve their bridge. It will be good for the city, for the area and for Desert
Shadows.

ENGINEERING DEPARTMENT:
The Engineering Department recommends that if this application is approved, such approval is
subject to the following conditions being completed in compliancewith City standards and ordinances:
Before final acceptance of the project,all conditions listed belowshall be completed to the satisfaction
of the City Engineer.
STREETS
1. Any improvements within the street right-of-way require a City of Palm Springs
Encroachment Permit. Work shall be allowed according to Resolution 17950 -
Restricting Street Work on Major and Secondary Thoroughfares.
INDIAN CANYON DRIVE NORTH
2. The bridge clearance shall be a minimum of 17 feet from the road surface.The bridge
shall not obstruct the view of the Vista Chino traffic.signal by northbound Indian
Canyon Drive traffic at any point from 500 feet south of Vista Chino to the intersection.
Minimum unobstructed stopping distance on Indian Canyon Drive is 500 feetfrom any
legal intersection or crosswalk.
3. The developer shall obtain a License Encroachment Agreement from the City
Engineerto construct a pedestrian bridge across Indian Canyon Drive North and shall
agree to maintain and/or relocate or remove said structure upon the request of the
City Engineer at such time as deemed necessary. The License Encroachment
Agreement shall be submitted with the structural drawings. The Building Permit will
not be issued until completion of the Agreement.
4. The developer shall enter into an agreement with the City of Palm Springs providing
for the maintenance of the pedestrian bridge or payment of same.

GENERAL
6. Structural plans shall be submitted to the Building Department to assure all
requirements for the pedestrian bridge are met.
7. The bridge railings shall be of sufficient height to preclude dropping of objects onto
the roadway.
PLANNING DEPARTMENT:
9. The proposed bridge shall be subject to all the conditions of approval of Planned
Development District 264.
10. The proposed private pedestrian bridge shall be designed so that pedestrian users are not
visible from any off site private and/or public property. The applicant shall be required to
submit sight study information to validate compliance with this condition.
11. Owners of the property(on both the east and west sides of Indian Canyon Drive North)shall
enter into a maintenance agreement with the City whereby the bridge shall be fully
maintained, at the sole discretion of the City, by either the property owners or the City. All
costs associated with operation, maintenance and repairof said structure shall be born bythe
property owners.
12. Owners of the property(on both the east and west sides of Indian Canyon Drive North)shall
enter into a License Encroachment Agreement from the City and shall agree to construct,
operate, maintain, repair and relocate and/or remove said structure upon request of the City
Council at such time as deemed necessary. The License Encroachment Agreement shall be
submitted with the structural drawings. The Building Permit will not be issued until completion
