DATE: March 21, 2001 TO: City Council FROM: City Engineer LED LAMP RETROFIT INSTALLATION PROJECT RECOMMENDATION: That the City Council award contract to S & K Electric, Inc., in the amount of $64,000.00, for the LED Lamp Retrofit Installation project, City Project No. 01-02. SUMMARY: This item provides an award of a construction contract for the installation of the LED Traffic Signal Lamps on miscellaneous traffic signals throughout the City. The project is funded by the previously approved California Energy Commission grant and loan. BACKGROUND: On December 20, 2000, City Council approved Resolution No. 19963 authorizing the City to apply for grant funding, and a loan from the California Energy Commission to pay for installation of energy-efficient LED traffic signal lights. The California Energy Commission has approved a grant to the City in the amount of$192,000, as well as a loan in the amount of $226,480 to purchase and install these lights. On February 7, 2001, Council approved the first step in this program, which was the purchase of the energy-efficient LED light fixtures. The final step in this program is the installation of the fixtures. S Plans and specifications were prepared by Engineering staff. On March 4 and 10, 2001, the project was advertised for bids, and at 2:00 p.m. on March 20, 2001, the Procurement Division received bids from the following contractors; 1. S & K Electric, Inc., Lakeside, CA $ 64,000.00 2. Sutherlin Contracting, Inc., El Cajon, CA $ 81,300.00 3. L.A. Signal, Inc., Industry, CA $ 82,150.00 4. DBX, Inc., Temecula, CA $101,020.00 The Engineer's estimate was $104,500 The low bidder is S & K Electric, Inc., from Lakeside, CA. Despite our effort to clearly specify to them the requirement to submit the necessary information, in every project that has been awarded since imposing this obligation, contractors have failed to provide the information. On two occasions now, we have been referred by attorneys to an Appellate Court's ruling on the Murietta case. That October 31, 2000, ruling revised the original findings of the Murrieta decision. According to the bulletin released by the California Surety Federation, the Court's ruling can be found at 84 Cal. App. 4ch 605,101 Cal. Rptr. 2d48, 2000 D.A.R. 11,652. The most important clarification of the Court's ruling is its statement that a City can determine the sufficiency of a surety "by obtaining a certificate directly from the county clerk, or otherwise verifying that the surety was an admitted surety insurer' (page 625), and further, stating that the Insurance Commissioner's"Internet web page allows anyone to determine whether a company is an admitted surety insurer or not' (page 623). Please determine if the Appellate Court's ruling has an affect on our specifications that require submission of all the documents referred to in §995.660, if it is possible to simply refer to the State of California Department of Insurance website to verify whether a surety is an admitted surety carrier, and if that demonstrates the City's verification of the sufficiency of the surety. N-2 DESCRIPTION OF THE WORK: The Work comprises removing existing incandescent lamp modules and installing City-procured LED retrofit modules in signal heads and pedestrian heads of various City traffic signals, and all appurtenant work. N-3 AWARD OF CONTRACT: (a) The City reserves the right after opening bids to reject any or all bids, to waive any informality (non-responsiveness) in a bid, or to make award to the lowest responsive, responsible bidder and reject all other bids, as it may best serve the interest of the City. (b) As a condition of award, the successful bidder will be required to submit payment and performance bonds and insurance. N-4 BID SECURITY: each bid shall be accompanied by a certified or cashier' s check or Bid Bond in the amount of 10 percent of the total bid price, payable to the City of Palm Springs . N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of 60 calendar days from the date of bid opening. N-6 CONTRACTOR' S LICENSE CLASSIFICATION: The Contractor shall possess a valid Class A or C-10 Contractor license at the time of submitting bids . N-7 CALIFORNIA WAGE RATE REQUIREMENTS: The Contractor shall pay the general prevailing rate of per diem wages as determined by the Director of the Department of Industrial Relations of the State of California for the locality where the work is to be performed. A copy of said wage rates is on file at the office of the City Engineer. The Contractor and any subcontractors shall pay not less than said specified rates and shall post a copy of said wage rates at the project site.
