HomeMy WebLinkAbout21235 - RESOLUTIONS - 4/6/2005 RESOLUTION NO. 21235 ' OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DESIGNATING THE HOME LOCATED AT 272 CAMINO BUENA VISTA, AS A CLASS ONE HISTORIC SITE. WHEREAS, the home located at 272 Camino Buena Vista was constructed in 1924; and WHEREAS, the defining architectural style of the home is Spanish Colonial Revial; and WHERAS, the incorporation unpainted wood finishes, door and window lintels, and multi-paned casement windows were an integral part of the original design and have continued to be maintained; and WHEREAS, Chapter 8.05 of the Palm Springs Municipal Code allows for the designation of historic sites; and WHEREAS, the current property owners, Marty Botwinick and Joey English, filed an application for Historic Site Designation; and WHEREAS, notice of a public hearing of the Historic Site Preservation Board of the City of Palm Springs to consider designation of the home at 272 Camino Buena Vista as a Class One historic site was issued in accordance with applicable law; and WHEREAS, on February 8, 2005, the Historic Site Preservation Board conducted a public hearing in accordance with applicable law to consider designation of the home at 272 Camino Buena Vista as a Class One historic site; and WHEREAS notice of a public hearing of the City Council of the City of Palm Springs to consider designation of the home at 272 Camino Buena Vista as a Class One historic site was issued in accordance with applicable law; and WHEREAS, on April 6, 2005, the City Council conducted a public hearing in accordance with applicable law to consider designation of the home at 272 Camino Buena Vista as a Class One historic site; and WHEREAS, the designation of the home at 272 Camino Buena Vista shall further the purpose and intent of Chapter 8.05; and WHEREAS, the designation of home at 272 Camino Buena Vista shall promote the sensitive preservation of said site; and WHEREAS, in accordance with the California Environmental Quality Act (CEQA), the designation of a historic site is categorically exempt from environmental review pursuant to Section 15331 for the preservation of historical resources; and ' WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the designation, including but not limited to the staff report, all written and oral testimony presented. Resolution 21235 Page 2 THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: ' Section 1: Pursuant to CEQA, the City Council finds that the designation of the home at 272 Camino Buena Vista as a Class One historic site is categorically exempt from environmental review pursuant to Section 15331 whereby this designation is for the preservation of a historical resource. Section 2: The home located at 272 Camino Buena Vista is designated as a Class One Historic Site pursuant to Chapter 8.05 of the Palm Springs Municipal Code. Section 3: No permit for an alteration to the unpainted posts, beams, and exposed rafters shall be issued as they are considered a defining characteristic of the home. Section 4: No permit for the alteration of the carved brackets and door and window lintels shall be issued as they are considered a defining characteristic of the home. Section 5: No permit for the alteration of the multi-paned wood casement windows shall be issued as they are considered a defining characteristic of the home. Section 6: All permitted existing or previously approved alterations are considered ' acceptable. Section 7: All future exterior modifications including but not limited to building, site, landscaping, lighting, walls, and fences shall require Architectural Approval pursuant to Section 94.04.00 of the Palm Springs Zoning Ordinance and Historic Site Preservation Board review. Section 8: To allow for public viewing of the structure:, a public view corridor of the structure from Camino Buena Vista is required. Section 9: The property owner shall permit the City to demark the home at 272 Camino Buena Vista as an historic site with a plaque of the City's choosing. The plaque shall be placed in a location visible from the public right-of-way. Owner shall maintain the plaque in the location installed and pay for the replacement cost if the plaque is lost, stolen, or otherwise removed from the property. Section 10: This resolution, and the historic designation put in place by it, shall not affect title to the property. Section 11: The City Council directs the City Clerk to submit this resolution to the County recorder for recordation within 90 days of the effective date of this resolution. ' Resolution 21235 Page 3 NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council designates the home at 272 Camino Buena Vista as a Class One Historic Site.
