' OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, CONTINUING THE EXISTENCE
OF A LOCAL EMERGENCY
WHEREAS, Ordinance No. 2.20 of the City of Palm Springs empowers the Director of
Emergency Services (City Manager) to proclaim the existence or threatened existence of
a local emergency when said city is affected or likely to be affected by a public calamity
and the City Council is not in session, subject to ratification by the City Council within
seven days; and
WHEREAS, conditions of extreme peril to the safety of persons and property have
arisen within this city, caused by excessive rainfall and prolonged flash flooding
commencing on the 28th day of December, 2004, at which time the City Council of the
City of Palm Springs was not in session; and
WHEREAS, said City Council does hereby find that the aforesaid conditions of extreme
peril did warrant and necessitate the proclamation of the existence of a local emergency;
and
WHEREAS, the Director of Emergency Services (City Manager) of the City of Palm
Springs did proclaim the existence of a local emergency within said city on the 29th day
of December, 2004; and
WHEREAS, the City Council of the City of Palm Springs adopted Resolution No. 21175,
on January 5th, 2005 ratifying the existence of a local emergency; and
WHEREAS, Article 14, Section 8630 of the Emergency Services Act requires the
governing body to review the need for continuing the local emergency;
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of
Palm Springs has reviewed the need for continuing the local emergency; and
IT IS HEREBY FURTHER RESOLVED that said local emergency shall be deemed to
continue to exist until its termination is proclaimed by the City Council of the City of Palm
Springs, State of California.
