HomeMy WebLinkAbout21086 - RESOLUTIONS - 9/1/2004 RESOLUTION NO. 21086 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, OPPOSING PASSAGE OF PROPOSITION 68, THE GAMBLING REVENUE ACT OF 2004, TO BE VOTED ON IN THE NOVEMBER 2, 2004 ELECTION. A04953 Whereas, the Gambling Revenue Act of 2004 is a proposition that would amend the State Constitution to require all 64 Tribal Governments currently operating under Tribal/State Compacts to agree with a specified list of requirements within 90 days of passage of this proposition; and; Whereas, if any of these Tribes fail to agree with these requirement, the proposition would allow eleven privately owned card clubs and five privately owned horseracing tracks to build and operate large gambling casinos with a total of 30,000 slot machines at their existing facilities, and; Whereas, promoters of this proposition are deceptively trying to break the existing Tribal/State Compacts by claiming that these tribes are not paying their fair share to the state, and; ' Whereas, according to independent Legislative Analyst, the proposition will not provide any additional funding to the state because all of its funds are specifically earmarked and are to be deposited in a separate special fund, not in the state's General Fund, and; Whereas, the proposition drains millions of dollars a year away from education by requiring County Offices of Education to administer proposition funds for non-education programs that pass-through them, but does not authorize use of any of these monies to reimburse the associated administrative costs, and; Whereas, the proposition would allow organized gambling interests to build Vegas-style casinos in city and suburban neighborhoods in close proximity to hundreds of our state's schools including some casinos that would be less than one-half mile from elementary schools, and; Whereas, the California Police Chiefs Association and other law enforcement organizations strongly oppose the proposition because they are alarmed by the public safety threats created by the measure including increased crime such as prostitution, loan-sharking and burglary, and; Whereas, the Sierra Club and local government officials oppose the proposition because it exempts the 16 private gambling establishments promoting the proposition from complying with the California Environmental Quality Act and local zoning laws, and; ' Whereas, the proposition would guarantee a monopoly on commercial casino gambling to the out-of-state racing owners along with selected card club owners, who are backing it. Resolution 21086 Page 2 NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Palm Springs, California, does hereby oppose passage of Proposition 68, the Gambling ' Revenue Act of 2004, which is on the November 2, 2004 Election.
