CASE NO. 20.147 (COUNTY REFERRAL) FOR AN AMENDMENT TO RIVERSIDE
COUNTY ORDINANCE NO. 348 (LAND USE AND ZONING) REGARDING SCENIC
RESOURCE PROTECTION AND INITIAL STUDY PURSUANT TO EA NO. 38147.
RECOMMENDATION:
That the City Council support the proposed zoning Text Amendment by adopting the
attached resolution and authorize the Mayor to transmit it to the Riverside County Board of
Supervisors.
BACKGROUND:
Riverside County is proposing to amend Ordinance No. 348 (Land Use and Zoning) to
increase the areas where wind energy projects would be prohibited. The expanded area
is located south of 1-10 and Highway 111 in the Snow Creek area. The attached map
shows the location effected by this change. This proposed amendment is consistent with
the General Plan and the Settlement Agreement with the County of Riverside dated
February2, 1983.///7

RELATING TO ZONING

5 Section 1. Subsections d. (3) a. and b. of Section 18.41 of Ordinance No. 348 are amended to
read as follows:

7 "(3) Scenic Resource Protection.
8 a. No commercial WECS or WECS array shall be located easterly of Indian Avenue
9 or northerly of Pierson Boulevard and its extension westerly of Highway 62.
10 b. No commercial WECS or WECS array shall be located southerly of Interstate

10 or southerly of Highway I I I within Sections 8, 9, 15, 16, 17, 19, 20 and 21,

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, SUPPORTING AN AMENDMENT TO
RIVERSIDE COUNTY ORDINANCE NO. 348 (LAND USE AND
ZONING) REGARDING SCENIC RESOURCE PROTECTION
AND INITIAL STUDY PURSUANT TO EA NO. 38147.
WHEREAS, Riverside County is proposing to amend Ordinance No. 348 (Land Use and
Zoning) to increase the areas where wind energy projects would be prohibited; and
WHEREAS, the proposed amendment is consistent with the General Plan; and
WHEREAS,the proposed amendment is consistent with the Settlement Agreement with the
County of Riverside dated February 2, 1983; and
WHEREAS, the Planning Commission of the City of Palm Springs has considered the
subject of the proposed amendment at its regular meeting of February 14, 2001 and
recommended approval; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the request, including but not limited to the staff report, and
all written and oral testimony presented.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
hereby determines that the proposed ordinance amendment is not in conflict with the City's
General Plan and recommending approval of the proposed amendments to Riverside
County Ordinance 348.
ADOPTED this 7 day of March 2001.
