APPROVE CONSTRUCTION CHANGE ORDER NO. 2 TO ENVIRONMENTAL
CONTROL SYSTEMS
RECOMMENDATION:
That the City Council approve Construction Change Order No.2 to Environmental
Control Systems, decreasing their contract by $18,800 for the deletion of Bid
Schedule C, (Desert Moon) to the Asbestos Abatement and Demolition project,
City Project No. 98-05.
SUMMARY:
The Desert Moon building located at 2150 N. Palm Canyon Drive was to be
demolished as part of City Project# 98-05 Asbestos Abatement and Demolition
(various locations). At the time of this project, the City could not obtain the
Court's approval to demolish this building as planned. The Bid Item for this work
is being deleted from the contract with Environmental Control Systems.
BACKGROUND:
City Project# 98-05 Asbestos Abatement and Demolition (various locations), was
awarded to Environmental Control Systems and began in September of 1999.
Initially, there were a total of 5 locations that were to be demolished, one of which
was the Desert Moon located at 2150 N. Palm Canyon Drive. Although the City
had received an order from the Court allowing for the demolition, the owner
successfully appealed to the Court to stop the demolition. Eventually,
Environmental Control Systems completed the demolition of all remaining
locations and one additional location that was added per Change Order#1. At
the completion of the project on April 10, 2000, Environmental Control Systems
was asked if they would be interested in keeping the contract open while the City
pursued the Court's permission to demolish the building. The Contractor agreed
and the contract was held open. The City was unable to obtain permission to
demolish this location and in September of 2000 Environmental Control Systems
requested that the contract be closed. The appeal was heard in December 2000
and, according to Rutan &Tucker, it is not known when a decision on the appeal
will be issued.
This deletion is being made as a balancing change order to the project. Funds
will be returned to account number 4151-43260 (Asbestos Abatement).

C. REASONS FOR CHANGES:
The City could not obtain Court approval to demolish the Desert Moon (located at 2150 N. Palm
Canyon), at the time of this project. Therefore, this bid item was removed from the contract.
The originally estimated completion date for this project was January 11, 2000. Due to delays caused
by legal issues surrounding the Desert Moon, and the addition of 3709 El Dorado per change order #1,
project time was deferred. The actual completion date for the project (less 'the Desert Moon), was
April 10, 2000. Environmental Control Systems had 11 working days remaining at the completion of
the original contract work (less Desert Moon). 71 working days will be added to this change order
which will reflect the contract time deferred per change order#1 and prov.Je the 11 working days that
ECS had on the books prior to deferment of time.
" Note: No additional mark ups will be added to any item on this Change Order. All cost per each
item are final.

I HEREBY CERTIFY that this Minute Order, approving Construction Change
Order No. 2 to Environmental Control Systems, decreasing their contract by
$18,000 for the deletion of Bid Schedule C (Desert Moon) to the Asbestos
Abatement and Demolition Project, City Project No. 98-05, was adopted by the
City Council of the City of Palm Springs, California, in a meeting thereof held on
the 21 s`day of February, 2001.
