Lee Weigel AMENDING THE CONTRACT SERVICES AGREEMENT BETWEEN ROBERT L.TETTE AND THE CITY OF PALM SPRINGS TO INCLUDE PERSONNEL RECRUITMENT, TESTING, BACKGROUND INVESTIGATION, AND TRAINING SERVICES RECOMMENDATION: That the City Council approve an amendment to the contract services agreement between Robert L. Tette and the City of Palm Springs to include personnel recruitment, testing, background investigation, and training services. SUMMARY: The current proposal is to amend Mr. Tette's agreement to include additional services for the overseeing of the police department training program. Our goal is to reassign one sergeant from personnel and training duties,to administrative duties,thatwill include grant research and grant writing to generate more revenue for the city to help defray the large commitment the general fund supports for public safety services. Amending Mr. Tette's contract to include additional services will allow the police department to assign a sergeant administrative duties and allows for flexibility and efficiency with our limited resources. The additional cost to amend Mr. Tette's contract is expected not to exceed $20,000 (twenty thousand dollars). BACKGROUND: Over the past three years the police department has successfully raised over 1.5 million dollars in grantfunding to expand our community policing and technology efforts, city-wide. Presently, grants are handled as a collateral duty of the Support Services Commander. Our goal is to continue to aggressively seek out grant funding opportunities that will surpass our efforts of the past three years. We believe by dedicating more resources to grant research and grant writing, the police department will be able to generate more revenue for the city to help defray the large commitment the general fund supports for public safety services. Our proposal is to reassign one sergeant from personnel and training duties, to administrative duties, that will include grant research and grant writing. The duties previously assigned to the personnel and training sergeant would then be done on a contract basis by an individual we currently have under contract for background investigation services. The contractor, Mr. Robert L. Tette, has worked both as a part-time temporary employee and currently as an independent contractor for the past three years. During Mr. Tette's tenure, the police department has hired fifty (50) employees and 114# conducted over one hundred and forty (140) background investigations. Mr. Tette is a retired police officer with over twenty-seven years of experience and currently serves the City as a volunteer reserve police officer. The current proposal is to amend Mr. Tette's agreement to include additional services for the overseeing of the police department training program. It is anticipated that Mr. Tette's hours of work will increase from twenty-four (24) hours per week to forty (40) hours per week and he will be compensated at twenty (20) dollars per hour. As a contractor, Mr. Tette is not entitled to overtime and does not receive any fringe benefits. The remainder of the agreement will be unchanged and will be in effect through June 30, 2001. The ability to dedicate the necessary staff time to this task is critical to its success. Amending Mr. Tette's contract to include additional services will allow the police department to assign a sergeant administrative duties and allows for flexibility and efficiency with our limited resources. FISCAL IMPACT: Although undetermined at this time, this proposal has the potential to generate significant revenue for the City as evidenced by our recent history of successful grant funding. The additional cost to amend Mr. Tette's contract is expected not to exceed $20,000 (twenty thousand dollars) for the remainder of FY 2000-01 and will be paid from salary savings which are expeeccted,to be between $50,000 and $100,000. Minute Order �� AMENDMENT TO CONTRACT SERVICES AGREEMENT FOR PERSONNEL RECRUITMENT, TESTING, AND INVESTIGATION SERVICES This AMENDMENT TO CONTRACT SERVICES AGREEMENT FOR PERSONNEL RECRUITMENT, TESTING, AND INVESTIGATION SERVICES ("Amendment") is entered this day of January, 2001, by and between the CITY OF PALM SPRINGS, a California municipal corporation ("City"), and ROBERT L. TETTE ("Contractor") RECITALS WHEREAS, on November 3, 1999, City entered into that certain Contract Services Agreement for Personnel Recruitment, Testing, and Investigation Services ("Agreement") with Contractor concerning personnel services provided by Contractor to City, as outlined in Exhibit "A" therein. WHEREAS, .City is desirous of retaining Contractor to be available additional services and for longer time periods per week than those required under the Agreement to address the City's needs in providing recruitment, testing and background investigation services. WHEREAS, Contractor is desirous of providing the additional personnel services to the City to meet the City's needs, in consideration for an adjustment of the compensation and contract sum, as set forth in this Amendment. NOW THEREFORE, in consideration of the mutual covenants hereinafter contained, the parties mutually agree as follows: 1. Exhibit "A" of the Agreement, at the introductory paragraph immediately before Paragraph "A" therein shall be amended in its entirety to read as follows: Contractor shall provide personnel recruitment, testing, background investigation and training services to City in accordance with this agreement and the terms and conditions below: 2. Exhibit "A" of the Agreement, at Paragraph "B" therein shall be amended to add the following new paragraphs 7 through 9, with the existing paragraphs to remain unchanged and in full force and effect: 7. Maintain and update police department employee training records. 8. Ensure compliance with P.O.S.T. standards for continued professional training for police department employees. 9. Schedule and coordinate approved training and training requests for police department employees. 3. Contractor shall generally be available to perform the services required by this Agreement approximately forty (40) hours per week on a schedule approved by the Police Chief. 4. Exhibit "B" of the Agreement, at Paragraph "1" therein shall be amended in its entirety to read as follows: 1. Compensation. Contractor shall be compensated at a rate of Twenty Dollars ($20.00) per hour for services performed pursuant to this Agreement. 5. Exhibit "B" of the Agreement, at Paragraph "3" therein shall be amended in its entirety to read as follows: 3. Contract Sum. The total amount authorized by this Agreement shall not exceed Fifty Thousand Dollars ($50,000.00). 6. Full Force and Effect. Except as expressly amended herein, all terms of the Agreement shall remain unchanged and in full force and effect.
