HomeMy WebLinkAbout1/3/2001 - STAFF REPORTS (9) Date: January 3, 2001 To: City Council From: Assistant City Manager SUBJECT: CORRECT PROVISIONS OF AND RESCIND RESOLUTION 19802 BY ADOPTING A REVISED RESOLUTION RECOMMENDATION: It is recommended that City Council rescind Resolution 19802 and adopt the attached Resolution which corrects and amends the action necessary to implement provisions of agreements reached during the Year 2000 Meet and Confer Process. SUMMARY: City Council adopted Resolution 19802 on June 7, 2000, which commenced paying and reporting the value of Employer Paid Member Contributions for all employees in the Management Units (MAPS), Exempt and Optional Members, except for the Police and Fire Chiefs in the Exempt Group. PERS has requested a correction to the language in the original Resolution, which we have made, and we are adding the Police Chief and Fire Chief to the EX Group PERS benefit. By rescinding the original Resolution and adopting a corrected one, these errors will be corrected to PERS' satisfaction. BACKGROUND: The original Resolution adopted by Council on June 7, 2000, stated "This benefit shall apply to all employees including EX, MAPS, and Optional Members in the Miscellaneous Group". This infers that all City employees through the City were to have Employer Paid Employee Share of PERS contributions, which is not the case. Also, negotiations with the Police and Fire Chiefs were not concluded until later and, thus, were not reported in the original Resolution, which PERS now wants clarified by adoption of a new Resolution by the City Council. The attached proposed Resolution corrects the record for PERS to be able to correctly implement changes in PERS benefits for the groups identified. Other groups will have changes to their PERS plans effective during future periods, which will be presented to City Council for approval at those times. WHEREAS, the City Council of the City of Palm Springs has the authority to implement Government Code Section 20636(c) (4) pursuant to Section 20691; and WHEREAS, the City Council of the City of Palm Springs has a written labor policy or agreement which specifically provides for the normal member contributions to be paid by the employer, and reported as additional compensation; and WHEREAS, one of the steps in the procedures to implement Section 20691 is the adoption by the City Council of the City of Palm Springs of a Resolution to commence paying and reporting the value of said Employer Paid Member Contributions(EPMC); and WHEREAS, the City Council had previously adopted Resolution 19802 effective June 25, 2000, providing the above benefits, but omitting therefrom the City's Police Chief and Fire Chief; and WHEREAS, the City Council desires to correct information in Resolution 19802; and WHEREAS, the City Council of the City of Palm Springs has reviewed and identified the following conditions for the purpose of its election to pay EPMC: a) This benefit shall apply to all employees in the following Groups: EX (including the Police Chief and Fire Chief), MAPS, and Optional Members in the Miscellaneous Group. b) This benefit shall consist of paying 7% (seven percent), and 9% (nine percent) for the Police and Fire Chiefs, of the normal contributions as EPMC, and reporting the same 7% (seven percent) and 9% (nine percent), as applicable, of compensation earnable {excluding Government Code Section 20636(c) (4)1 as additional compensation. c) The effective date of this resolution shall be June 25, 2000, BOB Resolution# 19967 Pagetwo NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Palm Springs, California, as follows: 1. That it elects to pay and report the value of EPMC, asset forth above. 2. That Resolution 19802 is hereby rescinded. ADOPTED this 3rd day of January, 2001.
