OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, '
CALIFORNIA, APPROVING AMENDMENTS TO THE GENERAL
PLAN CIRCULATION ELEMENT AS FOLLOWS:
A) 5.0986 GPA - A REQUEST BY NEXUS RESIDENTIAL
COMMUNITIES, INC. FOR AN AMENDMENT TO THE GENERAL
PLAN TO RELOCATE A NON-CONSTRUCTED 450 FOOT
PORTION OF CAMINO REAL ON THE GENERAL PLAN
CIRCULATION MAP, WEST 340 FEET TO INTERCEPT INDIAN
TRAIL, PROCEED NORTH AND INTERCEPT CAMINO REAL
B) 5.0982 GPA - A REQUEST BY CATHTON HOLDINGS, INC.,
MCCOMIC CONSOLIDATED AND TRANSWEST HOUSING,
FOR AN AMENDMENT TO THE GENERAL PLAN TO DELETE
TRAMVIEW ROAD/AVENIDA CABALLEROS BETWEEN SAN
RAFAEL ROAD AND INDIAN CANYON DRIVE FROM THE
GENERAL PLAN CIRCULATION ELEMENT, CREATE GENERAL
PLAN POLICY AND TEXT OF THE GENERAL PLAN OF THE
CITY OF PALM SPRINGS, TO CREATE POLICY 7.1.5b -
SUNRISE PARKWAY SPECIAL SECONDARY
THOROUGHFARE STREET SECTION AND THE ADDITION OF
SUNRISE PARKWAY TO THE GENERAL PLAN CIRCULATION
DIAGRAM, CONNECTING SUNRISE WAY TO HIGHWAY 111, '
RECLASSIFY INDIAN CANYON DRIVE ON THE GENERAL
PLAN CIRCULATION ELEMENT, FROM A 154 FOOT RIGHT OF
WAY MAJOR THOROUGHFARE TO A 100 FOOT RIGHT OF
WAY, THROUGH THE DELETION OF FRONTAGE ROAD,
NORTH OF SAN RAFAEL ROAD, DELETE TWO ELEMENTARY
SCHOOL SITES FROM THE LAND USE MAP, RELOCATE ONE
PARK SITE AND DELETE ONE PARK SITE FROM THE
GENERAL PLAN LAND USE MAP.
WHEREAS, Nexus Residential Communities, Inc. (the "applicant') has filed an application with
the City pursuant to Section 9403.00 for a General Plan Amendment to the Circulation Element
and has paid the required filing fees; and
WHEREAS, the applicant has requested a General Plan Amendment to the Circulation Map in
order to relocate a non-constructed 450 foot portion of Camino Real on the General Plan
Circulation Map, west 340 feet to intercept Indian Trail, thereby proceeding north 165 feet to
intercept the existing collector roadway Camino Real, as it proceeds north, Section 23; and
WHEREAS, Cathton Holdings, Inc., McCormic Consolidated, and Transwest Housing, ("the
applicant'), has filed an application with the City pursuant to Section 9403.00 for a General Plan
Amendment with the City and has paid the required filing fees; and

WHEREAS, the applicant has requested a General Plan Amendment with five elements: '
1) The deletion of Tramview Road/Avenida Caballeros extension, between San Rafael
and Indian Canyon Drive, from the General Plan Circulation diagram; and

2) The creation of General Plan Policy 7.1.5b - Sunrise Parkway Special Secondary
Thoroughfare Street Section and the addition of Sunrise Parkway to the General Plan
Circulation Element as a Special Secondary Thoroughfare connecting Sunrise Way
northerly of San Rafael Road to Highway 111; and
General Plan Policy 7.1.5b - Sunrise Parkway Special Street Program - Sunrise Parkway
between Palm Canyon Drive (Highway 111) shall be designated as Special Secondary
Thoroughfare with a right-of-way width of 100'. The parkway shall be designed to
accommodate a future roadway, with a minimum of two lanes to be constructed at the
time of adjacent development. This designation will allow for the roadway to be
designed to provide the necessary right-of-way to implement future roadway capacity in
the event of higher traffic volumes. The street section shall include landscape parkways,
meandering sidewalks and bikeways on both sides of the street. Roadway design shall
include traffic calming and other devices to ensure that traffic flow is compatible with
surrounding land uses and provides for reduced roadway design speeds adjacent to the
public park; and
3) Reclassification of Indian Canyon on the General Plan Circulation Element, from a
154 foot right-of-way Major Thoroughfare to a 100 foot right-of-way for a Major
Thoroughfare through the deletion of the frontage road;
' 4) Deletion of two elementary school sites from the General Plan land use element; and
5) Relocation of a park site and deletion of one park site on the General Plan land use
element adjacent to existing park site designation in order to form larger park site; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs
to consider Case Nos. 5.0986 and t.0982, requests to amend the General Plan Circulation
Element, and the General Plan Land Use Element was given in accordance with applicable law;
and
WHEREAS, on April 7, 2004, a public hearing to consider Case Nos. 5,0986 and 5.0982,
requests to amend the General Plan Circulation Element and Land Use Element, was held by
the Planning Commission in accordance with applicable law; and
WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider
Case Nos. 5.0986 and 5.0982, requests to amend the General Plan Circulation Element and
Land Use Element, was given in accordance with applicable law; and
WHEREAS, in accordance with Section 15063 of the California Environmental Quality Act,
Environmental Assessments have been prepared and distributed for public review and comment
in accordance with CEQA; and
WHEREAS, the City Council has carefully reviewed and considered all fof the evidence
' presented in connection with the hearing on the project, including but not limited to the staff
report, all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:

Section 1: Pursuant to CEQA, the Planning Commission finds that the current
environmental assessment for Case Nos. 5.0986 and 5.0982 adequately
addresses the general environmental setting of the proposed Project, its
significant environmental impacts, and the mitigation measures related to each
significant environmental effect for the proposed projects. The City Council
further finds that with the incorporation of proposed mitigation measures,
potentially significant environmental impacts resulting from this project will be
reduced to a level of insignificance and therefore recommends adoption of a
Mitigated Negative Declaration for the project.
Section 2: With regards to Case 5.0986, the proposed project is to amend the General Plan
- Circulation Element in order to relocated a four hundred and fifty (450) foot
portion of Camino Real, a collector status roadway immediately north and
intersecting East Palm Canyon Drive. This portion of Camino Real is indicated
on the General Plan Circulation Map but has not been constructed. The intent of
the General Plan Amendment would be to relocate said portion of Camino Real
west three hundred and forty (340) feet to intercept Indian Trail, proceeding north
on Indian Trail one hundred and sixty-five (165) feet to intercept the existing
street of Camino Real as it continues in a northerly direction. This amendment
would allow the existing street configuration to be maintained.
The General Plan Circulation Map indicates Camino Real proceeding north, '
bridging the Tahquitz Creek Channel, crossing Sunny Dunes and terminating at
an intersection with Ramon Road. This portion of Camino Real is designated as
a collector street with a right-of-way width of sixty (60) feet. The possibility of a
bridge constructed across Tahquitz Creek is remote at this time. Based upon an
evaluation of existing development, traffic volumes, and development potential
the City Council finds that the proposed General Plan Amendment will result in
adequate circulation to handle future traffic volumes.
Section 3: With regards to Case 5.0982, the proposed project is to delete the Tramview
Road/Avenida Caballeros extension, between San Rafael and Indian Canyon
Drive, from the General Plan Circulation diagram; create General Plan Policy
7.1.5b - Sunrise Parkway Special Secondary Thoroughfare Street Section (Exhibit
C) and the addition of Sunrise Parkway to the General, Plan Circulation Element
as a Special Secondary Thoroughfare connecting Sunrise Way north of San
Rafael Road to Highway 111; reclassify Indian Canyon on the General Plan
Circulation Element, from a 154' foot right-of-way Major Thoroughfare to a 100'
right-of-way for a Major Thoroughfare, through the deletion of the frontage road;
delete of two elementary school sites from the General Plan Land Use Element;
and relocate one park site and delete one park site on the General Plan land use
element adjacent to an existing park site designation, in order to form larger park
site. , 4

Section 4: The proposed amendment to the General Plan Circulation Element is necessary
and proper at this time, and is not likely to be detrimental to the adjacent property
or residents.
Section 5: The proposed amendment to the General Plan Land Use Element is necessary
and proper at this time, and is not likely to be detrimental to the adjacent property
or residents.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
hereby approves the General Plan Circulation Element Amendment and Land Use Element
Amendment as shown in Exhibits A, B, and C.
