FUNDING APPROVAL FOR ABATEMENT WARRANT CLEAN-UP OF 1000 E. PALM
CANYON DRIVE (BILTMORE HOTEL)
RECOMMENDATION:
That the City Council approve the attached Minute Order retroactively approving the
expenditure for an emergency abatement for 1000 E. Palm Canyon Drive, known as the
Biltmore Hotel.
SUMMARY:
The contract was awarded to Allright Services in the amount of$15,000. Work will include
board-up and securing of all existing openings, removal and disposal of all dead trees,
plants, shrubs, and trash, and trimming up all living vegetation. The Nuisance Abatement
account (43260) is sufficiently funded for this expenditure.
BACKGROUND:
Community Preservation staff initiated a code enforcement case on this property in February
2000. A Notice of Violation was issued to the property owner to secure the property and
clean-up all trash, junk and debris. The property owner was advised to remove all dead
vegetation and trim-up vegetation that is still living, along with draining the pool. The pool
was drained in June 2000. No further work was completed.
Owner has failed to comply with City requirements and therefore the case was sent to the
City Attorney for criminal complaint filing. The property owner has also failed to show up to
the Indio court and address the complaint filing by the City and now has a Failure to Appear
Warrant for her arrest.
On November 17, 2000, Community Preservation Officers obtained an Abatement Warrant
from the Palm Springs Superior Court to allow the City to clean-up and secure the property.
Abatement Warrant allows three weeks for the work to be completed. Work is to beginon
December 1, 2000. All work must be completed by December 18, 2000. The contractor
estimates that it will take 10-12 working days. The contractor is on the City's Abatement
Contractors list and has a history of completing projects on time. Due to the emergency
abatement and court-ordered time limits, alternate bids were not solicited.

I HEREBY CERTIFY that this Minute Order, ratifying the expenditure of $15,000 to be
awarded for the emergency summary abatement of 1000 E. Palm Canyon Drive was
adopted by the City Council of the City of Palm Springs,California, in a meeting thereof held
on December 6, 2000.
