OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, OVERRULING THE PLANNING
COMMISSION DENIAL OF A SIGN AT THE PLAZA
THEATER, LOCATED AT 128 SOUTH PALM CANYON
DRIVE, CBD ZONE, SECTION 15,
WHEREAS,The Fabulous Palm Springs Follies, (the"Applicant")filed an application with the
City pursuantto section 93.20.00 of the Zoning Ordinance to allow a sign at the historic theater;
and
WHEREAS, on October 0&, 2003, the Planning Commission carefully reviewed and
considered all of the evidence presented in connection with the project,including but not limited
to the staff report, and all written and oral testimony presented in accordance with applicable
law; and
WHEREAS, the Planning Commission denied the proposed sign permit; and
WHEREAS, on October 08, 2003,the applicant filed an appeal of the Planning Commission
denial and waived notification rights regarding the action; and
WHEREAS, the City Council has carefully reviewed, considered, and debated all of the
evidence presented in connection the project,including, but not limited to the staff report, and
all written and oral testimony presented:
' THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds that this project is categorically
exempt from California Environmental Quality Guidelines (CEQA).
Section 2: Pursuant to Zoning Ordinance Section 93,20,00, the City Council finds that:
1. That the proposed sign, its shape, and location do not affect the historic character of
the Plaza Theater.
2. That the proposed sign includes appropriate materials and graphics.
3. Thatthe proposed sign lighting,including television monitor,will not impactthe public's
health, safety, and welfare and will not be extensively bright or obtrusive.
4. That the television monitor sound levels will not affect adjacent businesses including
outdoor dining.
5. That the proposed sign is the same size,configuration, and location as existing and is

of appropriate scale to provide messages to pedestrians.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
hereby approves the sign permit, subject to the conditions set forth in the attached Exhibit A.
ADOPTED this 161h day of October, 2003.

' SIGN PERMIT

The Plaza Theater
October 15, 2003
CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the Director of Planning and Zoning.
1. The subject sign shall meet all other applicable regulations of the Palm Springs Zoning
Ordinance,Municipal Code,or any other City Codes,ordinances and resolutions which
supplement the zoning district regulations
2. That the materials and finish shall match the existing sign.
3. That the rear of the sign be fully enclosed and that the fans and vents be completely
shielded on the top and bottom of the sign structure.
4. That the video screen is approved and that audio is shall not be audible to patrons at
the adjacent outdoor dining establishment.
