HomeMy WebLinkAbout11/1/2000 - STAFF REPORTS (3) DATE: November 1, 2000 TO: City Council FROM: Fire Chief APPROVE A PERSONAL SERVICE AGREEMENT WITH RYAN HAROLD FOR PROFESSIONAL SERVICES RELATING TO MAINTAINING ADVANCED LIFE SUPPORT (ALS) QUALITY REVIEW, ASSURANCE, AND IMPROVEMENT OBJECTIVES, RECOMMENDATION: It is recommended that the City Council approve a personal service agreement with Ryan Harold, "Contractor", for professional services related to Paramedic Program quality assurance and improvement objectives. The role of the independent "contractor" is to perform numerous independent administrative and field audits of the Paramedic Program to assure compliance to all pertinent state and county emergency medical service (EMS) protocols, policies, procedures, and manuals. BACKGROUND: Mr. Ryan Harold has served as the Department's EMS Coordinator during the start up of the Paramedic Program until the present time. The ALS operating agreement with Riverside County EMS Agency requires an EMS Coordinator and Medical Advisor for the Program. We have fulfilled the EMS Coordinator role through the services of Mr. Harold. Mr. Harold has been compensated for his services at the rate of $25 per hour. Dr. Grayman's services are far less time demanding and consequently he has agreed to perform his role as a volunteer, as long as he has an indemnification agreement. The City Council endorsed the indemnification agreement with Dr. Grayman during the October 18, 2000 City Council meeting. Mr. Harold is a licensed paramedic in the State of California and certified by Riverside County. He has worked for AMR Ambulance in Western Riverside County as a Field Training Supervisor. Through his professional knowledge, skills and abilities as well as his reputation throughout the EMS professions in Riverside County, we feel that we have retained the best professional services available. He came highly recommended by the AMR Director of Operations for Riverside County and the Riverside County EMS Director. Ryan worked with each of our Fire Department paramedics to assure that their skill levels met or exceeded the Riverside County requirements before the Paramedic Program started, by providing remedial training and skills assessment counseling. During last fiscal year (FY-99/00), Mr. Harold was compensated $4,700 for his services (started in January, 2000). Funds have been programmed in account 121-3523-43200 (Fire Safety Augmentation - Contractual Services) for all consulting services for the Paramedic Program. Most of the programmed funds were scheduled for the type of service that Mr. Harold will be providing. November 1, 2000 Page 2 The proposed Personal Service Agreement with Mr. Harold will terminate on June 30, 2006. Mr. Harold would be compensated at the rate of $25 per hour. The hourly rate could be annually adjusted for the CPI. The agreement permits a ceiling of $15,000 compensation to Mr. Harold for his services during a fiscal year. Under the terms of the agreement, Mr. Harold will secure the appropriate permits and insurance. The standard Personal Service Agreement form was provided by the City Attorney (Fred Galante, ESQ.). The Agreement has been reviewed by the Risk Manager as to form and content. Fire Chief City Manager ATTACHMENTS: Minute Mum By DEn OF FINANCE Agreementent �✓ , . 34 2 CITY OF PALM SPRINGS CONTRACT SERVICES AGREEMENT FOR EMERGENCY MEDICAL SERVICE COORDINATOR- (ALS) THIS CONTRACT SERVICES AGREEMENT (herein "Agreement") is made and entered into this 1 st day of November, 2000 by and between the CITY OF PALM SPRINGS, a municipal corporation, (herein "City") and RYAN HAROLD (herein "Contractor"). NOW, THEREFORE, the parties hereto agree as follows: 1.0 SERVICES OF CONTRACTOR 1.1 Scope of Services. In compliance with all of the terms and conditions of this Agreement, the Contractor shall perform the work or services set forth in the "Scope of Services" attached hereto as Exhibit "A" and incorporated herein by reference. Contractor warrants that all work and services set forth in the Scope of Services will be performed in a competent, professional and satisfactory manner. 1.2 Compliance With Law. All work and services rendered hereunder shall be provided in accordance with all ordinances, resolutions, statutes, rules, and regulations of the City and any Federal, State or local governmental agency of competent jurisdiction. 1.3 Licenses, Permits, Fees and Assessments Contractor shall obtain at its sole cost and expense such licenses, permits and approvals as may be required by law for the performance of the services required by this Agreement. 2.0 COMPENSATION 2.1 Contract Sum. For the services rendered pursuant to this Agreement, Contractor shall be compensated in accordance with the "Schedule of Compensation" attached hereto as Exhibit "B" and incorporated herein by this reference, but not exceeding the maximum contract amount of Fifteen Thousand Dollars ($15,000) ("Contract Sum")per fiscal year. 2.2 Method of Payment. Provided that Contractor is not in default under the terms of this Agreement, Contractor shall be paid monthly by check. 276/099999-8000 CONTRACT SVCS AGR 63674.01 AMOO -1 of 10- WITH RYAN HAROLD U3 The insurance required by this Agreement shall be satisfactory only if issued by companies qualified to do business in California, rated "A" or better in the most recent edition of Best Rating Guide, The Key Rating Guide or in the Federal Register, and only if they are of a financial category Class VII or better, unless such requirements are waived by the Risk Manager of the City due to unique circumstances. 4.2 Indeimrification. Contractor agrees to indemnify the City, its officers, agents and employees against, and will hold and save them and each of them harmless from, any and all actions, suits, claims, damages to persons or property, losses, costs, penalties, obligations, errors, omissions or liabilities, including paying any legal costs, attorneys fees, or paying any judgment (herein "claims or liabilities") that may be asserted or claimed by any person, firm or entity arising out of or in connection with the negligent performance of the work or services of Contractor, its agents, employees, subcontractors, or invitees, provided for herein, or arising from the negligent acts or omissions of Contractor hereunder, or arising from Contractor's negligent performance of or failtve to perform any term, provision covenant or condition of this Agreement, but excluding such claims or liabilities to the extent caused by the negligence or willful misconduct of the City. 5.0 TERM 5.1 Term. Unless earlier terminated in accordance with Section 5.3 below, this Agreement shall continue in full force and effect until June 30, 2006. 5.2 Termination Prior to Expiration of Term Either party may terminate this Agreement at any time, with or without cause, upon thirty (30) days' written notice to the other party. Upon receipt of the notice of termination, the Contractor shall immediately cease all work or services hereunder except as may be specifically approved by the Contract Officer. In the event of termination by the City, Contractor shall be entitled to compensation for all services rendered prior to the effectiveness of the notice of termination and for such additional services specifically authorized by the Contract Officer and City shall be entitled to reimbursement for any compensation paid in excess of the services rendered. 6.0 MISCELLANEOUS 6.1 Covenant Against Discrimination Contractor covenants that, by and for itself, its heirs, executors, assigns and all persons claiming under or through them, that there shall be no discrimination against or segregation of, any person or group of persons on account of race, color, creed, religion, sex, marital status, national origin, or ancestry in the performance of this Agreement. Contractor shall take affirmative action to ensure that applicants are employed and that employees are treated during employment without regard to their race, color, creed, religion, sex, marital status, national origin or ancestry. 276/099999-8000 CONTRACT SVCS AGR 63674.01 AMoo -4 of 10- WITH RYAN HAROLD 344 EXHIBIT "A" SCOPE OF SERVICES The EMS Coordinator will provide services including; but not limited to the following: • Complete the orientation and accreditation process for all Fire Department personnel entering the Palm Springs Fire Department first responder Advanced Life Support (ALS) Program. • Provide requested information to the Fire Department Administration regarding the progress of all paramedic personnel involved with the Program. • Maintain separate files on each Fire Department personnel, as it relates to ALS. • Review 100% of the Patient Care Report (PCR) forms for the purpose of maintaining Quality Assurance/Improvement objectives as filed with the Riverside County EMS Agency. • Maintain and audit all forms related to controlled substances (verification, usage, and incident reports). • Upon written request, provide the Riverside County EMS Agency any PCR or patient care data for the purposes of data management, quality improvement, or system issues. Performance of this will be coordinated with the Fire Department Administration. • Work in conjunction with the Pre-Hospital Liaison Nurse, and Clinical Manager for American Medical Response (AMR) to provide field care audits, system changes, and protocol updates for all Fire Department paramedics. • Offer ALS and BLS continuing education classes, structured for Fire Department purposes, but open to any EMS personnel. • Complete semi-annual field observation (ride-a-longs) with Fire Department paramedics. Observations will be documented in writing, and maintained in personnel files. • Provide an annual skills refresher course for all Fire Department paramedics. • When requested, conduct quality assessment reviews as outlined in Policy 42200 of the Riverside County EMS Agency Protocol, Policy, and Procedure manuals. • Perform an annual audit on all sets of the Riverside County EMS Agency Protocol, Policy, and Procedure manuals maintained by the Fire Department. This would include a bi-annual audit of the manuals held by the paramedics. EXHIBIT "B" SCHEDULE OF COMPENSATION • The Contractor shall be compensated for services rendered under Exhibit "A", Scope of Services, at an hourly rate of$25.00 per hour. Such hourly rate shall be reviewed annually by the City and the Contractor. Based upon satisfactory performance by the Contractor, the hourly rate may be adjusted annually, based upon the CPI (National). • Certain fees and premiums are eligible for reimbursement to the Contractor by the City as outlined in Section 4.0. The Contractor must invoice the City separately for reimbursement. Any differential increased cost for such insurance outlined in 4.1(c) to the Contractors base automobile insurance must be documented by the insurance agent and attached to the invoice. • City agrees to reimburse Contractor for supplies, conference registration, travel cost, etc. on a case-by-case basis and with prior written approval by the City.
