HomeMy WebLinkAbout20741 - RESOLUTIONS - 9/17/2003 RESOLUTION NO. 20741 ' OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, REGARDING CASE 5.0909-CUP, CONSIDERING AN APPEAL BY SHERYL HAMLIN, ELISSA GOFORTH AND BARBARA PROCTOR OF THE PLANNING COMMISSION ACTION, AFFIRMING THE PLANNING COMMISSION ACTION REGARDING BELARDO ROAD NOT TO ALLOW FORTY-FIVE (45) DEGREE ANGLED PARKING, AND DIRECTING STAFF TO WORK WITH THE PROPERTY OWNER AND NEIGHBORHOOD TO DEVELOP A SPECIAL STREET SECTION FOR CAHUILLA ROAD, BETWEEN RAMON ROAD AND TAHQUITZ CANYON WAY, FOR RESTUDY BY THE PLANNING COMMISSION, AT THE: ESTRELLA INN, LOCATED AT 415 S. BELARDO ROAD, R-3 ZONE, SECTION 15. WHEREAS, Sheryl Hamlin, Elissa Goforth and Barbara Proctor, (the "Appellants")are appealing the Planning Commission's June 25, 2003 approval requiring site improvements, including the installation of depressed curb and gutters,sidewalks and connecting pavementand reconsideration of the Planning Commission's denial of a request to install forty-five degree angled parking on Belardo Road, at 415 S. Belardo Road, Zone R-3, Section 15; and ' WHEREAS, the improvements are intended for the convenience of hotel guests, visitors and area residents; and WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider an application for Conditional Use Permit 5.0909 was issued in accordance with applicable law; and WHEREAS,on September 17,2003,a public hearing on the appeal of Case No.5.0909-CUP was held by the City Council in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project,including but not limited to the staff report,all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Pursuant to CEQA, the City Council finds that this project is categorically exempt from California Environmental Quality Guidelines (CEQA). ' NOW,THEREFORE, BE IT RESOLVED that, based upon the foregoing,the City Council upholds the Planning Commission action affirming the recommendation for Belardo Road prohibiting the use of diagonal parking, and directs staff to work with the property owner and neighborhood to develop a special street section for Cahuilla Road,between Ramon Road and Tahquitz Canyon Way,for restudy by the Planning Commission, for Case No. 5.0909-CUP.
