HomeMy WebLinkAbout10/18/2000 - STAFF REPORTS (16) T Date: October 18, 2000 To: City Council From: Director of Planning and Building TENTATIVE PARCEL MAP 29631 - APPLICATION BY CS3F PARTNERSHIP FOR A TENTATIVE PARCEL MAP TO SUBDIVIDE 41.58 ACRES INTO TWENTY-THREE (23) INDUSTRIAL LOTS RANGING IN SIZE FROM 0.91 ACRES TO 4.4 ACRES LOCATED ON THE EAST SIDE OF GENE AUTRY TRAIL, SOUTH OF PALM SPRINGS CLASSIC PROJECT, M-1-P ZONE, SECTION 18. RECOMMENDATION: The Planning Commission recommends that the City Council adopt a Mitigated Negative Declaration and approve Tentative Parcel Map 29631 to create twenty-three(23) parcels as described above subject to conditions in the attached resolution. The applicant is John Sanborn of Sanborn Architecture and Engineering, representing CS3F Partnership. The Officers of that partnership are Roy C. Dolley, President, Marleen Martin, Secretary and Chief Financial Officer, and Coetta Wright, Treasurer. BACKGROUND: The project consists of a 23-lot tentative parcel map which is a modification to Tentative Parcel Map 27939, previously approved by the City Council on September 20, 1995.That map was not recorded within the 2 year period and no time extensions were requested by the applicant and has thus expired. The originally approved parcel map consisted of 15 parcels ranging in size from 1.53 acres to 7.07 acres. The revised map consists of 23 parcels which range in size from 0.91 acres to 4.4 acres. Additionally, the interior access to the project has been reconfigured with addition of a segment of public street to provide access to the lots at the interior portion of the project. Access to all of the parcels proposed by this subdivision is by public streets with a right of way width of 66 feet. The project site is located in the M-1-P ( Planned Research and Development ) Zoning District along the east side of Gene Autry Trail, south of the Palm Springs Classic project, north of Ramon Road and west of the Dream Homes in Cathedral City. The subdivision has been designed to comply with the criteria of that zone district relative to minimum lot area,width and depth. The site has a General Plan land use designation of Industrial. All future uses proposed on parcels created by this parcel map will be required to comply with the applicable requirements of the M-1-P zone district and the Industrial Land Use category of the General Plan. No development of the proposed lots is contemplated at this time. Vehicular access is proposed from two locations off Gene Autry Trail. The two access points off Gene Autry Trail are the same as proposed on the originally approved map. The northern access is located directly across from the Sky West access and is approximately 1,200 feet south of the Palm Springs Classic main entry. The southern access is located directly across from the Million Air access and is approximately 850 feet north of Mission Drive. A traffic study dated September, 1994 was prepared for the Palm Springs Classic project �� and identified the two subject entry points. According to the study, the proposed northern access into the subject property should be signalized and the southern access should not be signalized since it will not meet traffic warrants. In addition, the study indicated that the Gene Autry Trail and Mission Drive intersection will need to be signalized. However, due to the length of time that has passed since the above-referenced traffic study was prepared, it is the recommendation of the City Engineer and Caltrans that signalization for access to Gene Autry Trail be updated prior to the issuance of any permits within the subdivision. This mitigation measure is included within the attached Environmental Assessment for the project. Staff has reviewed the tentative map and has provided comments and conditions. Again, the subdivision has been designed to comply with all applicable property development standards for the M-1-P zone. The conditions of approval for the tentative map are almost identical to those conditions which were previously applied to Tentative Parcel Map 27939, which is proposed by the applicant to be superseded by the map currently under consideration. SURROUNDING ZONING / USES North: PD-232 (Palm Springs Classic) /Vacant South: M-1-P /Vacant East: A/ Palm Springs International Airport West: R-1 / Single Family Residential (Cathedral City) ENVIRONMENTAL ASSESSMENT AND NOTIFICATION : An Environmental Assessment dated July 24,2000 was prepared forthis project, pursuant to the provisions of the California Environmental Quality Act (CEQA). Studies that were completed in the immediate area of the subject property include the Palm Springs Classic Environmental Impact Report and the Palm Springs Regional Airport Master Plan Environmental Impact Report. The Environmental Assessment indicates that there could be a potentially significant impact in certain areas, such as traffic, drainage and noise, but through compliance with the recommended mitigation measures identified in the assessment, potential impacts will be reduced to a level of insignificance. If the City Council concurs, then adoption of a Mitigated Negative Declaration would be in order. A copy of the tentative map was also sent to Caltrans and the City of Cathedral City due to the location of the project site. All correspondence from Caltrans has been incorporated as an attachment to the Environmental Assessment and all applicable comments from Cathedral City have also been incorporated into the Environmental Assessment and the recommended Conditions of Approval for the subdivision. All property owners within 400 feet of the subject site were notified of the Planning Commission public hearing. To date, no comments other than those attached to the Environmental Assessment have been received from the public. PLANNING COMMISSION ACTION: On August 23,2000 and continued to September 13,2000,the Planning Commission held a duly noticed public hearing on this application and recommended adoption of a Mitigated Negative Declaration and approval of the application 5-0 (1 absent, 1 abstention) subject to the conditions contained in the attached Resolution. The primary focus of discussion involved the timing of installation of common area landscape improvements and the future maintenance thereof. The Planning Commission recommended that landscaping be installed consistent with the previously approved Design Guidelines for the site approved by the City Council in conjunction with Tentative Parcel Map 27939 in 1995. The Planning Commission also recommended that the perimeter landscape areas be maintained by the Owner's Association and that maintenance criteria be incorporated into the CC&R'sforthe subdivision. �' � Director of tanning and Building _._............ ..._ City Manager ATTACHMENTS: 1. Page of 12 (� Planning Commission Minutes nV September 13, 2000 // IIIJJJ Principal Planner Hayes reported that the City Council approved this application on September 20, 1995; however, the applicant has revised the design, changed the street configurations, and the lots are smaller than originally approved. He also reported that this Public Hearing was noticed in the newspaper and to all property owners within 400 feet of the subject property; however, staff received no comments. He also reported that the Caltrans requirements have been incorporated into the recommended mitigation measures. He stated that development would be on a lot-by-lot basis and that there is no master plan. He stated that the Design Review process would keep landscaping continuous. He reported that direct access onto San Joaquin Drive is prohibited — all access is provided internally. Director reported that the Gene Autry Trail landscape easement front yard requirement is 25 feet and all landscape is consistent with what exists on North Gene Autry Trail (e.g. near Federal Express building). He stated that the main access is opposite from Gene Autry Trail with a 25 foot setback. Associate Civil Engineer Fuller reported that the City has received grant approval for landscaping in this area (including design and construction) which would relieve the developer from participating on this portion of the landscaping. Chairman Mills opened the Public Hearing. Mr. John Sanborn, Sanborn A & E, addressed the Planning Commission to state that he agrees with staff on the conditions as modified as of this date. He also stated that the landscaping will be consistent with the current style and the CC&R's will assure compliance. Mr. Jim Schlecht, Schlecht Shevlin & Shoenberger, addressed the Planning Commission to- also state that the CC&R's will manage the master landscaping plan for the Gene Autry Trail and that this is the primary reason the CC&R's were developed. There being no further appearances, the Planning Commission was closed. Mr. Sanborn was called to the podium to answer questions. He reported that the center line of San Joaquin Drive is the dividing line between Cathedral City and Palm Springs and that it is a combination curb and gutter— not a rolled curb. He reported that the curb to property line block wall is seven to 22 feet and that landscaping is maintained by the property owners. He stated that this project will help improve this area of the City. He stated that the design guidelines prepared by Sanborn A & E/Tom Dozci (January 1995) go beyond City code requirements. Commissioner Raya expressed his concern that this area of landscaping is not accessible for maintenance purposes. Mr. Jim Schlecht was called to the podium. He clarified that the Association will not maintain the landscaping on San Joaquin Drive —that this will be an individual developer's responsibility as is the case in the majority of subdivisions in the City. 13 Page 7 of 12 Planning Commission Minutes September 13, 2000 M/S/C (Klatchko/Raya 5-0, 1 abstain, 1 absent) to recommend approval to the City Council with the following additions and/or modifications: A. That the landscaping be developed as per the January of 1995 Design Guidelines by Tom Doczi and to the approval of the Director of Planning & Building — if conflicts arise between Design Guidelines and City Codes occur; City Codes take precedence and; B. That the landscaping and irrigation strip along Gene Autry Trail, San Joaquin, and Mission Drive be maintained by the Owner's Association and maintenance parameters be included in the CC&R's for development at the time of sale of individual lots and; C. The Mission Road connector be landscaped consistent with above-referenced Design Guidelines and; D. Planning Division Condition No. 11: Change the word "development" in second line to "buildings" and; E. Engineering Division Condition No.22: "Developer shall apply for the vacation of the west 15 feet of the existing 40 foot wide right-of-way easement on SAN JOAQUIN DRIVE from MISSION DRIVE to THE NORTH PROPERTY LINE OF APN 677-270-011, exclusive of a property line - corner cut back at the SOUTHEAST corner of the subject property in accordance with the City of Palm Springs Standard Drawing No. 105. Through the development review process, the City will insure that building and site design are sensitive to the established single family residential area (Example: orientation of buildings and screening of loading and storage activities ). The subdivision of land in and of itself does not constitute a significant impact to the residential area. There are no known unstable earth conditions associated with the project site based on review of the Seismic Safety Element of the City of Palm Springs General Plan; additionally, the nature of the project is such that there is no possibility of creating an unstable situation. Future development projects will be designed to comply with the Uniform Building Code which mandates requirements for seismic safety construction. The developer will be required to submit a precise grading plan along with a soils report for review and approval of the City prior to the issuance of any permits The soils report will address subsidence of the land and the possibility of expansive soils on the property, and the grading plan will be required to be in compliance with the soils report. The developer will be required to submit a drainage study(or equivalent)as determined by the City Engineer and Caltrans, identifying potential impacts in these areas and how site drainage will be dealt with,including how adjacent properties will be protected from site run-off from this project. Mitigation Measures: 1. Prior to the issuance of a grading permit, the applicant shall submit a grading plan for each lot for City approval prior to the issuance of building permits. On-site retention shall be an integral design component of the grading plans. The grading plans shall depict existing and proposed contours(graphically differentiated)in addition to specific spot elevations, adjacent lands and facilities, as per the attached correspondence from Caltrans District 8 office dated June 26, 2000 2 The applicant shall submit additional hydrological information,as required by the City Engineer and Caltrans,for review and approval prior to commencement of construction on the property or recordation of the Final Map,whichever occurs first. Drainage plans shall depict existing and proposed drainage features and structures on the property or adjacent properties, including any Caltrans facilities that are present or adjacent to the proposal, as per the attached correspondence from Caltrans District 8 office dated June 26, 2000. 4. b - j. NO IMPACT. Although the site was located entirely within the Whitewater River wash, recent drainage infrastructure improvements have improved the status of the site to being outside the 500 year floodplam. Based upon the review of the City's General Plan and the knowledge of the Department of Planning and Building and the City Engineer,due to the nature of the project and it's location, the project will not create a change in the course or direction of water movements,affect the quantity of ground waters,alter the flow of ground water and there are no wells on the subject site The proposed project will require water service as provided by the Desert Water Agency. The agency draws groundwater from local wells in the area. Thus, the proposed project will use groundwater resources in the area. The project is generally consistent with the General Plan and Zoning Ordinance. With the adoption of the General Plan update in 1993, the City Council adopted a Statement of Overriding Considerations regarding air quality. Also, the proposed project will be required to comply with the South Coast Air Quality Management District(SCAQMD)CEQA Air Quality Handbook. However, due to future grading activities on the individual lots which will be created by this subdivision,short term impacts to air quality could occur. Therefore, the project will need to comply with the City's Fugitive Dust and Erosion Control Ordinance It is not anticipated that any significant long-term impacts relative to regional air quality will occur as a result of the subdivision. Site specific industrial users that may impact the air quality of the region will be required to be accessed consistent with the provisions of the California Environmental Quality Act, as determined by the Director of Planning and Building. 5. b)-d) NO IMPACT. The project will be located on a site that has vacant land to the north and south, single family residences to the east and airport-related uses to the west. The size and nature of the proposed subdivision is such that sensitive receptors will not be exposed to additional pollutants or objectionable odors and no changes in climate will occur Therefore, no impacts will occur as a result of this project to sensitive receptor and the current climate. Mitigation Measures: Short Term Impacts: 1. The applicant shall be required to submit a Fugitive Dust Mitigation Plan,prepared in accordance with Chapter 8 50 of the Palm Springs Municipal Code regarding Fugitive Dust and Erosion Control, which shall be submitted for review and approval by the Building Official prior to the issuance of a grading permit. 2 The proposed project will comply with the provisions of Chapter 8.50 of the Palm Springs Municipal Code which establishes minimum requirements for construction activities to reduce fugitive dust and PM10 emissions. A plan to control fugitive dust through implementation of reasonably available dust control dust measures shall be prepared and submitted to the City of Palm Springs for approval prior to the issuance of any grading permits associated with the project. The plan shall specify the fugitive dust control measures to be employed. 3. The project proponent shall comply with all applicable SCAQMD Rules and Regulations In particular, SCAQMD Rule 403 shall be adhered to, insuring the clean-up of grading related soils on approach routes to the site. Rule 403 prohibits the release of fugitive dust emissions from any active storage, open storage pile, or disturbed surface area beyond the property line of the emission source. Particulate matter deposits on public roadways are also prohibited. 4. A suitable dust control deposit will be required and made prior to grading permit issuance. 5. Adequate watering techniques shall be employed to partially mitigate the impact of grading-generated dust particulates Portions of the project site that are undergoing earth moving operations shall be watered such that a crust will be formed on the ground surface and then watered again at the end of the day. 6. Grading operations shall be suspended during first and second stage ozone episodes or when winds exceed 25 miles per hour, per the PM10 SIP. 6. The proposed project is projected to create approximately 2,179 weekday trips at buildout for light industrial uses,which could increase traffic levels on Gene Autry Trail to the point where signalized traffic control will be necessary to control access and traffic flow on this major thoroughfare. Gene Autry Trail is designated as State Highway 111,therefore consulted with Caltrans early in the review process. Cal Trans has general guidelines requiring minimum one-quarter mile spacing between signalized intersections A signal master plan was prepared for Gene Autry Trail between Vista Chino and Ramon Road in conjunction with the Palm Springs Airport Master Plan. According to the traffic study, traffic signals are required at the Gene Autry Trail and northernmost property entry intersection and at the Gene Autry Trail/Mission Drive intersection The study also indicated that the southernmost access into the subject property does not meet warrants for a traffic signal. Staff has also corresponded with the City of Cathedral City to determine if either entity would be impacted by the subdivision. As a result of these consultations, a review of the General Plan and consultation with the City Engineer, the following mitigation measures are recommended to reduce traffic and circulation impacts to a level of insignificance: 1 A traffic study shall be provided in accordance with Caltrans guidelines to determine if traffic signals will be required on streets that provide access to Gene Autry Trail,in accordance with the attached correspondence from the Caltrans District 8 office dated June 26, 2000. 2. Street improvement plans depicting existing and proposed features including striping, signage, pavement markings, lighting and signalization shall be depicted and labeled on said plans, in accordance with the attached correspondence from the Caltrans District 8 office dated June 26, 2000. Thus, no potential for significant impact on the environment would result from inadequate parking on site. Circulation within the project site will be adequate based upon the judgement of the City Engineer and the Department of Planning and Building. Therefore, there is no potential for a significant effect on the environment due to circulation within the project site. The project site is located in a generalized urban area of the City,away from water or railways. Finally,the vehicular traffic on the surrounding streets will not change as a result of the proposed project. Some short-term circulation impacts may result from future construction activities, but are not considered significant over the long term. 6. h) POTENTIALLY SIGNIFICANT UNLESS MITIGATION INCORPORATED. The project is located immediately east (across Gene Autry Trail)from the Palm Springs International Airport. The subdivision,which contemplates the subdivision of land for the purpose of future light industrial development, is consistent with the General Plan and with the applicable components of the F.A.R. Part 150 Noise Compatibility Study for the Palm Springs International Airport, last updated in 1995 However, due to the speculative nature of the industrial subdivision and the proximity of the two airport runways to the site,the following mitigation measures shall be imposed at such time development of individual parcels is contemplated Mitigation Measures: 1. Development proposals shall be submitted to the Riverside County Airport Land Use Commission for a consistency determination. 2. Each development shall be subject to a consistency determination with the City of Palm Springs F.A.R. The only officially listed species found in the area was the Coachella Valley Fringe-Toed Lizard. Since the project site is located adjacenttothe Palm Springs Classic and has the same natural characteristics,and is within the fringe- toed lizard habitat area as the Classic project is, a payment of$100 per acre habitat replacement fee is required for land to be developed Thus,the project would not result in a potential for a significant effect on the environment from a loss of animal habitat or the reduction of rare, unique or endangered animals. Based upon a site inspection by the Department of Planning and Building,which has working knowledge of wildlife habitats within Palm Springs,it was determined that no other potentially significant wildlife habitat is present on the site. Therefore, there is no potential for a significant effect on wildlife habitat. A majority of the area surrounding the project site is generally urbanized. Animal life in the area is limited to common bird, reptile and mammal species. No rare or endangered species live near or on the subject site other than the site being located within the Fringe-toed Lizard Habitat Area. Finally, the project site is generally surrounded by development which has significantly altered the animal community in the area. Although the project is located in a noise corridor and adjacent to a major thoroughfare, industrial and related office uses are clearly acceptable at this location. Therefore,there is no potential for a significant effect on the project due to noise impacts. Industrial uses are identified as being compatible with the Palm Springs Airport F.A.R. Part 150 Noise Compatibility Study. The noise that the project is expected to generate would be typical for industrial development. An evaluation by the Department of Planning and Building has concluded that the noise level the project may generate would not exceed the noise levels stated within the Palm Springs Municipal Code, Chapter 11.74 Thus, no potentially significant impacts to the environment would result from excess noise. In the opinion of the Department of Planning and Building,the project will not require noise abatement measures other than short term impacts during construction activities. The Dream Homes are located directly east in Cathedral City,which may be impacted somewhat during construction activities. During construction activities on-site, the following short-term mitigation measures shall be complied with: Mitigation Measures: 1. Construction activities shall take place only between 7:00 a.m. and 8:00 p.m to reduce noise impacts per the Palm Springs noise ordinance section 11.74 .041. 2. The subject site is located adjacent to Gene Autry Trail,which is a City designated scenic corridor pursuant to the General Plan. The traffic study should use a 2020 year projection and should include average daily traffic (ADT) volumes, traffic generation (including peak hour), traffic distribution, analysis of peak hour demand and capacity using delay methodology for intersections along with current and projected capacities of local roads, and State Route 111. The following plans will also be required when an encroachment permit is applied for: • Grading Plans depicting existing and Proposed contours (graphically differentiated) in addition to specific spot elevations, adjacent lands and facilities. • Drainage Plans depicting existing and proposed drainage features and structures on this property and adjacent properties, including any Caltrans facilities that are present or adjacent to this proposal. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. PLANNING DIVISION: 1. The proposed subdivision and the future development thereof shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City codes, ordinances and resolutions which supplement the zoning district regulations. 2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Tentative Parcel Map 29631. The City of Palm Springs will promptly notify the applicant of any such claim, action or proceeding against the City of Palm Springs, and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgement or failure to appeal, shall not cause a waiver of the indemnification rights herein. 3. Pursuant to Fish and Game Code Section 711.4 a filing fee of $78.00 is required. This project has a de minimus impact on fish and wildlife, and a Certificate of Fee Exemption shall be completed by the City and two copies filed with the County Clerk. This application shall not be final until such fee is paid and the Certificate of Fee Exemption is filed. Fee shall in the form of a money order or cashier's check payable to Riverside County. 4. The mitigation measures of the environmental assessment shall apply and are incorporated into these conditions by reference. ) 34ep 5. Prior to issuance of a grading plan, a fugitive dust and erosion control plan shall be submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal code for specific requirements. 6. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance hall be shown and all disturbed areas shall be fully restored or landscaped. 7. Drainage swales shall be provided adjacent to all curbs and sidewalks - 3 ft. wide and 6 inches deep. The irrigation system shall be field tested prior to final approval of the project. Section 14.24.020 of the Municipal Code prohibits nuisance water from entering the public streets, roadways or gutters. 8. Prior to issuance of a building permit, Fringe Toed Lizard Mitigation fees shall be submitted. 9. The applicant prior to issuance of any building permits within the subdivision shall submit a draft declaration of covenants, conditions and restrictions ("CC&R's") to the Director of Planning and Building for approval in a form to be approved by the City Attorney,to be recorded prior to issuance of occupancy permits. The CC&R's shall be enforceable by the City, shall not be amended without City approval, shall require maintenance of all property in a good condition and in accordance with all ordinances, and shall include provisions for maintenance of any private storm drain and/or sewer appurtenances, as applicable. The landscape strips and irrigation along San Joaquin Drive, Mission Drive and Gene Autry Trail shall be maintained by the Owners Association. Parameters for maintenance of perimeter landscaping and irrigation shall be specified in the CC&R's for the Parcel Map, to the satisfaction of the City Attorney and the Director of Planning and Building. The applicant shall submit to the City of Palm Springs, a deposit in the amount of $ 2,000.00, for the review of the CC&R's by the City Attorney. 10. No direct vehicular access shall be allowed on to San Joaquin Drive; all vehicular access to the subdivision shall be from the internal street system, to the satisfaction of the Director of Planning and Building and the City Engineer. 11. A decorative masonry wall shall be constructed and landscaping provided along San Joaquin Drive in conjunction with any buildings within the subdivision. The final design of the decorative wall and landscaped areas shall be reviewed and approved by the Planning Commission as part of the applicable architectural approval application for development of the site. The referenced wall and landscaping shall be maintained by the property owners within the industrial subdivision, with maintenance provisions specified in the C,C&R's for the project, in a form acceptable to the City Attorney, and shall be installed in conjunction with Phase One development of the subdivision. 12. In an effort to minimize any potential short-term environmental impacts related to construction of the subdivision to downwind residents in the Dream Homes subdivision, the developer shall implement all necessary blowsand and dust control measures throughout all phases of development of the property, as specified in the Environmental Assessment for the subdivision, as well as constructing the east property line decorative wall with the initial phase of construction, as specified above. 15A36 13. Landscaping of the common areas around the perimeter of the subdivision shall be completed in accordance with the previously prepared and adopted Design Guidelines supplement dated January, 1995, prepared by Tom Doczi and Associates and to the satisfaction of the Director of Planning and Building. If conflicts arise between the parameters of the Design Guidelines supplement and City Codes, then the applicable City Code(s) shall rule, as determined by the Director of Planning and Building. POLICE DEPARTMENT: 14. Developer shall comply with Section II of Chapter 8.04 of the Palm Springs Municipal Code. BUILDING DEPARTMENT: 15. Prior to any grading or construction on - site, all appropriate permits must be secured. FIRE DEPARTMENT: 16. Construction shall be in accordance with the 1998 California Fire Code, 1997 Uniform Fire Code, 1998 California Building Code, 1997 Uniform Building Code, 1996 National Electrical Code,City of Palm Springs Ordinance 1570, Desertwater Agency requirements, NFPA standards including 13, 24, 71,72 760 plus UL and CSFM listings and approvals. 17. Fire Department access roads shall be provided and maintained in accordance with the 1998 California Fire Code, Article 9, Section 902. 18. Fire apparatus access roads shall have an unobstructed width of not less than 20 ft. and an unobstructed vertical clearance of not less than 14 ft. 6 inches in accordance with 1998 California Fire Code, Article 9, Section 902.2.2.1 and the City of Palm Springs Ordinance 1570. 19. Required marking of fire apparatus roads and fire protection equipment shall be in accordance with the 1998 California Fire Code, Article 9, Section 901.4. 20. Fire apparatus access roads shall be designed and constructed as all weather and able to support a fire truck weighing 67,000 pounds in accordance with 1998 California Fire Code, Article 9, Section 902.2.2.2 and City of palm Springs Ordinance 1570. 21. The turning radius of fire apparatus roads shall be at least 43 feet from centerline in accordance with 1998 California Fire Code, Article 9, Section 902, Par. 2.2.3. and City of Palm Springs Ordinance 1570. 22. Access road turn - around requirements for dead end fire apparatus roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of fire apparatus. The approved turn-around provision is a cul-de- sac with a turning radius of 43 feet from centerline. Refer t 1998 California Fire Code Article 9, Section 902.2.4 and City of Palm Springs Ordinance 1570. 23, Cul - de- sac streets shall be designed with a minimum turning radius of 43 feet from centerline. Refer to 1998 California Fire Code Article 9, Section 902.2.2.4 and City of Palm Springs Ordinance 1570. A -31 24. Water supplies and fire hydrants shall be in accordance with 1998 California Fire Code, Article 9, Section 903.4, Appendix III-B and Desert Water Agency Specifications. 25. A commercial fire hydrant shall be installed every 300 feet or portion thereof. H-2 type fire hydrants are required. 26. Submit detailed plans for review as soon as possible. 27. Further comments may be forthcoming as conditions warrant. ENGINEERING DIVISION: The Engineering Division recommends that if this application is approved, such approval is subject to the following conditions being completed in compliance with City standards and ordinances: A. The developer shall submit an updated traffic study to the City Engineer prior to issuance of any permits for the proposed project. The study shall analyze both intersections of LOT A NORTH AND SOUTH @ GENE AUTRY TRAIL to determine if signal(s) are warranted. The recommendations of this study shall be incorporated into these conditions of approval. Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer. STREETS 1. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. Work shall be allowed according to Resolution 17950 - Restricting Street Work on Major and Secondary Thoroughfares. 2. Developer shall obtain State permits and approval of plans for all work done on State Highway 111 prior to the City of Palm Springs issuing any construction permits. 3. Submit street and sewer improvement plans prepared by a Registered Civil Engineer to the Engineering Division. The plan(s) shall be approved by the City Engineer prior to issuance of any grading or building permits. Minimum submittal shall include the following: A. Copy of signed Conditions of Approval from Planning Department. B. All agreements and improvement plans approved by City Engineer, IF applicable. C. Proof of processing dedications of right-of-way, easements, encroachment agreements/licenses, covenants, reimbursement agreements, etc. required by these conditions. 13 A 40 GENE AUTRY TRAIL 4. Dedicate an additional right-of-way of 5 feet to provide the ultimate half street width of 55 feet along the entire Gene Autry Trail frontage of APN 677-270-011 per the City of Palm Springs General Plan in accordance with City of Palm Springs Standard Drawing No. 105. 4A. Dedicate easements for the portions of the sidewalk, bicycle path and bus turn out that leave the public right-of-way. 5. Gene Autry Trail is a limited access highway. Driveway access to lots fronting on Gene Autry Trail shall be from Lot A (Unnamed Street). 5A. The developer shall comply with the Caltrans requirements as set forth in their letter dated June 26, 2000 and attached to the Environmental Assessment for the project. 6. The centerline of Lot A North and Lot A South shall align with the driveway centerlines on the west side of Gene Autry Trail. Developer shall be responsible for all modifications to the existing median cuts. 7. Construct the NORTH AND SOUTH halves of an 8 foot cross gutter and spandrel at the intersection of GENE AUTRY TRAIL and LOT A SOUTH INTERSECTION with a flow line parallel to the centerline of GENE AUTRY TRAIL in accordance with City of Palm Springs Standard Drawing Nos. 206 and 207. 8. Construct the NORTH AND SOUTH halves of an 8 foot cross gutter and spandrel at the intersection of GENE AUTRY TRAIL and LOT A NORTH INTERSECTION with a flow line parallel to the centerline of GENE AUTRY TRAIL in accordance with City of Palm Springs Standard Drawing Nos. 206 and 207. 9. Construct a 130-foot long by 12-foot wide bus turn out on the northeast corner of the intersection of Gene Autry Trail and the Million Air north driveway. The northeast curb return shall be recessed east 12 feet. The configuration shall be approved by the City Engineer in conjunction with SunLine Transit. Contact SunLine Transit for details regarding bus stop furniture/shelter requirements. Developer shall construct the shelter inclusive of furniture and lighting. 10. Construct a 10 foot wide Class I meandering bicycle path (Caltrans Design Manual, Chapter 1000 - Bikeway Planning and Design) along the entire frontage.The bicycle path shall be constructed of colored Portland cement concrete. The admixture shall be Desert Sand, Palm Springs Tan, or approved equal color by the Engineering Division. The concrete shall receive a broom finish. 11. If the public grant application for landscaping the Gene Autry Trail North median island is not granted during the 2000 calendar year, the developer shall pay his proportionate share of the landscape/irrigation construction of the landscaped, raised median island across the project frontage as specified by the City Engineer and Director of Planning and Building. MISSION DRIVE 14. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 15. Construct a minimum 8 foot wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. 16. Construct a ramp for the physically handicapped, using a 35 foot radius curb return, at the SOUTHWEST corner of the subject property in accordance with City of Palm Springs Standard Drawing No. 212. 17. All broken or off grade CURB, GUTTER, AND AC PAVEMENT shall be repaired or replaced. SAN JOAQUIN DRIVE 18. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 19. Construct a 6 inch curb and gutter, 18 feet WEST of centerline along the entire frontage, with a 25 foot radius curb return at the SOUTHEAST corner of the subject property per City of Palm Springs Standard Drawing No. 200. 20. Construct a ramp for the physically handicapped at the SOUTHEAST corner of the subject property in accordance with City of Palm Springs Standard Drawing No. 212. 21. Construct a minimum pavement section of 2-1/2 inch asphalt concrete pavement over 4 inch Class II aggregate base with a minimum subgrade of 24 inches at 95%relative compaction, OR equal,from edge of proposed gutter to centerline along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 110 AND 300. The pavement section shall be designed, using "R" values, by a licensed Soils Engineer and submitted to the City Engineer for approval. 22. Developer shall apply for the vacation of the west 15 feet of the existing 40 foot wide right-of-way easement on SAN JOAQUIN DRIVE from MISSION DRIVE to the NORTH PROPERTY LINE OF APN 677-270-011, exclusive of a property line - corner cut back at the SOUTHEAST corner of the subject property in accordance with the City of Palm Springs Standard Drawing No. 105. Developer shall be responsible for the final resolution of all utilities, demolition of all existing improvements, reconstruction of affected intersecting streets and coordination of improvements with adjacent property owners, if applicable, for the street vacation. All agreements and improvement plans relative to the above-mentioned items 13A 4�. shall be reviewed and approved by the City Engineer prior to the submittal of the street improvement plans. 23. There shall be no access to San Joaquin Drive from this project. Developer shall dedicate access rights on the Parcel Map to the City of Palm Springs.Said access rights shall be included in the Owner Statement and the City Clerk's Statement. LOT A 24. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 25. Construct a 6 inch curb and gutter, per City of Palm Springs Standard Drawing No. 200A, 25 feet BOTH SIDES of centerline along the entire frontage, with a 35 foot radius curb return at the NORTH AND SOUTH INTERSECTIONS OF LOT A AND GENE AUTRY TRAIL of the subject property. 26. The driveway approaches shall be constructed in accordance with City of Palm Springs Standard Drawing No. 201 and have minimum widths of 24 feet. 27. Construct a minimum 8 foot wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. 34. Construct a minimum pavement section of 3 inch asphalt concrete pavement over 6 inch crushed aggregate base with a minimum subgrade of 24 inches at 95% relative compaction, OR equal,from edge of proposed gutter to edge of proposed gutter in accordance with City of Palm Springs Standard Drawing No. 110 and 310. The pavement section shall be designed, using "R"values, by a licensed Soils Engineer and submitted to the City Engineer for approval. 34A. All curve radii shall be a minimum of 300 feet. SEWER 35. Connect all sanitary facilities to the City sewer system. 36. Construct sewer laterals from existing sewer main to a location in the proximity of the plumbing outlet of said property. Cap all laterals at right-of- way line for future connection to City sewer system. 37. Any utility cuts in the existing off-site pavement made by this development shall receive trench replacement pavement to match existing pavement plus one additional inch. See City of Palm Springs Standard Drawing No 404 modified to require the final 2 feet of subgrade to be compacted in lifts not to exceed 15 inches. Pavement shall be restored to a smooth rideable surface. 49. All existing utilities shall be shown on the street plans. The Planning Commission has previously reviewed and considered and the City Council has independently reviewed and considered the information contained in the Negative Declaration and finds that it adequately discusses the significant environmental effects of the proposed project, and that, on the basis of the initial study and comments received during the public review process, there is no substantial evidence that there will,be any significant adverse environmental effects as a result of the approval of this project. The City Council further finds that the Mitigated Negative Declaration reflects its independent judgement. Section 2: Pursuant to Government Code Section 66473.5,the City Council finds that the proposed subdivision and the provisions for its design and improvement are compatible with the objectives, policies and general land uses and programs provided in the City's General Plan; and Section 3: Pursuant to Government Code Section 65567, the City Council finds that the proposed subdivision and improvements are compatible with the objectives, policies and general land use provided in the City's local open space plan; and Section 4: Pursuant to Government Code Section 66474, the City Council finds that with the incorporation of those conditions attached in Exhibit A: a. The proposed map is consistent with the applicable general and specific plans. I S2 Z This site is designated as Business/Industrial on the General Plan Land Use Map. The proposed parcel map is for the purpose of future industrial development consistent with the General Plan designation and the zoning designation of M-1-P (Planned Research and Development Zone), consistentwith the intent forthe area in the City's General Plan. b. The design or improvements of the proposed subdivision are consistent with the General Plan . The subdivision design, including lot size and public right-of-way width, is consistent with the General Plan and shall comply with all applicable development criteria for the M-1-P Zone. The proposed subdivision map implements design strategies and policies as referenced in the City of Palm Springs General Plan for Business/Industrial development. c. The site is physically suitable for the type of development contemplated by the proposed subdivision. The subject site is generally flat and level, with no significant landforms, and is physically suitable for the type of development which is allowed in the M-1-P zone district. The proposed lots within the subdivision have been designed to comply with all applicable property development criteria specified for the M-1-P zone district. d. The site is physically suitable for the proposed density of development contemplated by the proposed subdivision. The proposed subdivision of land does not contemplate any development at this time. However, any future development on the parcels created by this subdivision will be required to comply with the applicable provisions of the M-1-P Zone District. Again,the proposed lots within the subdivision have been designed to comply with all applicable property development criteria specified for the M-1-P zone district. e. The design of the subdivision or improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. An environmental assessment has been conducted in regards to the proposed subdivision and it was determined,with the recommended mitigations incorporated into the attached Conditions of Approval,the proposed subdivision and associated improvements will not cause substantial environmental damage or substantially and unavoidably injure fish, wildlife or their habitat. f. The design of the subdivision or improvements is not likely to cause serious public health problems. The design of this subdivision and associated improvements will protect the public health, safety and welfare through installation of public improvements such as curbs,sidewalks,drainage improvements and traffic control devices,as applicable. g The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision. 13(�� The proposed subdivision will not conflict with any public easements as none currently exist on the property, nor will the proposed subdivision conflict with the existing traffic flow adjacent to the property on all surrounding streets or access to utilities required to serve the subdivision and the immediate area. h. A nexus and rough proportionality have been established for requirement of dedication of the additional right-of-way to the City and the off-site improvements as related to the tentative parcel map. The right-of-way dedication and off-site improvements, which are required by the Zoning Ordinance, are related to the project since the property owners must use Gene Autry Trail to Mission Drive to access the site. Also, the purpose of the right- of-way dedication for San Joaquin Drive along the eastern property boundary is to concur with the dedication of the subject street along the eastern frontage of the Palm Springs Classic project located to the immediate north. Currently,the subject property is vacant and therefore little or no usage of the roads, sidewalks and utilities is due to the subject property at this time. However, the future property owners will benefit from any improvements made to Gene Autry Trail, Mission Drive and San Joaquin Drive such as dedications of easements, sidewalks/bikepaths,and future widening. The required dedication of right-of-way and improvements will provide safety benefits to the property owners and will aesthetically enhance the neighborhood. Section 5: Pursuant to Government Code Section 66474.6, the City Council has determined thatthe discharge ofwaste from the proposed subdivision into the existing sewer system will not result in a violation of existing requirements prescribed bythe Regional Water Quality Control Board; and NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves Tentative Parcel Map 29631 subject to those conditions set forth in the Attached Exhibit A, which are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified.
