HomeMy WebLinkAbout10/18/2000 - STAFF REPORTS (14) DATE: OCTOBER 18, 2000 TO: CITY COUNCIL FROM: DIRECTOR OF PLANNING & BUILDING TTM 29825: AN APPLICATION FOR TENTATIVE TRACT MAP APPROVAL FOR TIMESHARE PURPOSES LOCATED AT2330 NORTH PALM CANYON DRIVE, C1 AND R2 ZONE. RECOMMENDATION: The Planning Commission recommends approval of a Tentative Tract Map fortime share purposes so as to allow for a 21 unit timeshare ownership located at 2330 North Palm Canyon Drive. The owner is Lawrence Sofonio. BACKGROUND: The applicant, Mr.Sofonio,acquired this property in May 1997. Atthe time of acquisition,the City had spent three years pursuing public nuisance abatement on the property. In April 1997,the City obtained Court permission to demolish the existing structure on the property. Demolition never occurred as Mr. Sofonio, in August 1997, entered into a Settlement Agreementwith the City of Palm Springs. As part ofthe Settlement Agreement, Mr.Sofonio agreed to rehabilitate the property and the City agreed to not proceed with demolition,thus allowing Mr.Sofonio to rehabilitate the property. In April 2000,the City's Director of Planning and Building found that Mr. Sofonio had complied with the requirements of the agreement. At the time Mr. Sofonio acquired the subject property, he also owned the adjacent property to the south,the Adriatic Villa. Mr. Sofonio continues to own the Adriatic Villa and operates it as a time share. The 1997 Settlement Agreement between Mr. Sofonio and the City of Palm Springs states, in part,that"Sofoio anticipates rehabilitating the Propertyto be much more compatible with the Adriatic Villa and thereafter to operate the two properties jointly." At its meeting of July 9, 1997,the Palm Springs Planning Commission passed a resolution and associated conditions of approval for architectural approval and time extension of non- conforming property development standards forthe subject property. The staff reportto the Planning Commission states"The applicant proposes to add an exterior facade including archways, Spanish style roof tile elements and wooden decorative shutters to match the adjacent Adriatic Villa property:the applicant has stated that he eventually intends to operate the properties jointly." During its meeting of August 23, 2000, the Planning Commission approved a Conditional Use Permit to allow for a Time Share Use on this property. PHYSICAL CHARACTERISTICS OF THE PROPERTY: The 1.24 acre site is improved with the hotel (proposed timeshare) structure, a pool, a restaurant, a 33 space parking lot, and a residential unit. Access to the parking area from Via Olivera is via an access easement that crosses the Adriatic Villa property. i1A TTM 29825 Report to City Council October 18, 2000 Page 2 The applicant proposes to retain the residential unitforuse by staff of both the Adriatic Villa and the subject property. This will allow for an "on call" handy man to be on the premises. It is the intention of the applicant to upgrade the appearance of the residential unitwithin the next six months. Improvement of this residential unit is the only physical improvement proposed. The existing structure has non-conforming front and side yard setbacks. The required front setback is 30 feet and existing is 28 feet. The required side setback is 19.5 feet and the existing is 11 feet on the north side and 16 feet on the south side. The existing structures also are nonconforming with respectto the existing building separation requirements. Note these structures were originally constructed in the 1950s. The applicant proposes a total of 21 timeshare units, of which sixwill be studios and 15 will be one bedroom units. The applicant also proposes to begin operation of the restaurant on the site. In accordance with the resolution and conditions of approval adopted by Planning Commission on July 9, 1997,the restaurant use shall include no more than 75 seats unless an agreementfor additional off-site parking spaces is obtained or additional on-site parking spaces are provided. In the staff report presented to the Planning Commission on July 9, 1997, the issue of parking is reviewed. In this staff analysis,the number of hotel units anticipated was37. The parking standard applied the restaurant was one parking space for every five seats. Itwas based on this parking analysis that the Planning Commission condition regarding limiting seating at the restaurant to 75 seats was established. Using the parking formula applied in the 1997 staff report on the subject property, 36 on-site parking spaces are required. The applicant proposes to provide 37 on-site parking spaces. The parking formula utilized in 1997 applied the Resort Hotel parking standard to the Restaurant Use. A Resort Hotel is a hotel with at least 100 units. The proposed timeshare has 21 units and the Adriatic Villas has 20 units. Combined this is41 units. The application of the Resort Hotel parking standard resulted in fewer required parking spaces than if the Restaurant standard was applied. A seventy five seat restaurant will likely cater to diners who are not staying at the time share. Consequently, additional parking may be needed. In approving a Conditional Use Permit for the Time Share Use, the Planning Commission established a condition that states that should the Director of Planning and Building deem a parking problem exists,the property owner is responsible for demolition of the residential unit located on the site in the vicinity of the parking lot and for the construction of adequate parking, designed in accordance with the City's parking standards, at this location. USE OR OCCUPANCY OF LAND ON A "TIME-SHARE" BASIS In accordance with Section 9315.00 of the Zoning Ordinance, a Time Share Use is permitted in this zoning district subject to the issuance of a Conditional Use Permit issued by the Planning Commission. Section 9315.E.2 identifies the following items that may be considered in determining whether, and under what conditions, to issue any such Conditional Use Permit. During its meeting of August23, 2000,the Planning Commission made the following findings and voted to issue the Conditional Use Permit. t �� I TTM 29825 Report to City Council October 18, 2000 Page 3 a. The impact of the time-sharing project on transient or permanent rental stock; The subject property has been unoccupied for nearly four years. It has not supplied housing to either permanent residents nor to transients. Issuance of a Conditional Use Permit will not impact the transient or permanent rental stock. b. The impact of time-sharing on present and future City services; The proposed time share is not anticipated to adversely impact on or create excessive demands of City services. C. Nonconformity with currentzoning regulations and the General Plan, and reasonable conditions to eliminate the same; The nonconformities on this site are associated with the existing structure. No nonconformities are proposed to be intensified. Typically,sites with nonconformities are not issued Conditional Use Permits for the operation of a Time Share. However,this situation is different in that the applicant,who is the property owner, owns the adjacent property and operates it as a time share. The issuance of the Conditional Use Permit will allow the existing time share use to be more competitive as it is necessary to have a large inventory of units to be successful in the time share industry. The reason the proposed time share will strengthen the existing one is that they are proposed to be operated as an integrated business with the same management company. Therefore, as there are no plans to intensify the nonconformity and as the proposed use will operate in coordination with an existing time share located adjacent to this site, the staff does not consider the existing nonconformities to be cause for denial of the request. The General Plan designation forthis area is High Density Residential. This designation is for both hotels and high density apartments. The proposed use is consistent with General Plan designation. d. Nonconformity with existing uniform building and fire codes and reasonable conditions to eliminate same; Improvements to the property as a result of the 1997 Settlement Agreement resulted in compliance with uniform building and fire codes. e. The sign program proposed for the project; The applicant has not yet submitted a proposed sign program. f. The landscaping proposed for the project: Both the interior and the perimeter of the site is landscaped. As part of the Conditional Use Permit approved by the Planning Commission, additional landscaping is required to be installed in the parking areas. g. Traffic circulation and parking; I' The applicant proposes to use existing driveways. Therefore, traffic patterns are not TTM 29825 Report to City Council October 18, 2000 Page 4 anticipated to change. The applicant proposes compliance with the required parking. h. The applicant's description of the methods proposed to be employed to guarantee the future adequacy, stability and continuity of a satisfactory level of management and maintenance of the time-share project; The applicant has submitted to the City the Final Subdivision Public Report on the Adriatic Villa, the Articles of Incorporation of the Adriatic Vacation Club, Inc., The Adriatic Vacation Club, Inc. Rules and Regulations, Bylaws, and Covenants, Conditions, and Restrictions. The applicant proposes to operate the subject property as part of The Adriatic Vacation Club, Inc. Currently, the Adriatic Villa has 20 units. With the addition of 21 units for a total of 41 units, the property will be more competitive and economically sound. i. The desirability of requiring an office of the managing agent or agency be located locally or on-site, as appropriate. The applicant proposes to house staff in the residence on site to allow for on-site management. j. Any otherfactors deemed relevant and any other information which the Commission or the applicant considers necessary or desirable to an appropriate and proper consideration of the application. PLANNING COMMISSION ACTION AND VOTE During its meeting ofAugust23,2000,the Planning Commission voted unanimously to grant a Conditional Use Permit for a Time Share Use on this property. WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited tothe staff report, and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: //dw The project is categorically exempt from the requirements of CEQA pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines. Section 2: Pursuant to Government Code Section 66474, the Planning Commission finds that with the incorporation of these conditions attached in Exhibit A: a. The site is physically suitable for the type of development contemplated by the proposed project. d. The site is physically suitable for the proposed density of development contemplated by the proposed project. e. The design of the project is not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or the habitat. f. The design of the project is not likely to cause serious public health problems. g. The design of the project will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivisions. h. The time sharing project will not have a significant impact on transient or permanent rental stock. i.
