HomeMy WebLinkAbout20598 - RESOLUTIONS - 5/7/2003 RESOLUTION NO. 20598 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,APPROVING A GENERAL PLAN AMENDMENT TO MODIFY CIRCULATION ELEMENT POLICY 7.1.5.AND CASE NO. 5.0344 - PLANNED DEVELOPMENT DISTRICT-164(A) AND ASSOCIATED SITE IMPROVEMENTS, SUBJECT TO THE CONDITIONS STATED, FOR THE CONSTRUCTION OF PALM SPRINGS CONVENTION CENTER EXPANSION AND PARKING FACILITIES LOCATED AT 277 NORTH AVENIDA CABALLEROS ZONE PD164, R-4, R-4-VP AND R-G-A(8), SECTION 14. WHEREAS, the City of Palm Springs (the "Applicant'), has filed a General Plan Amendment to modify Circulation Element Policy 7.1.5 to allow discretionary review of requests for reduced street pavement widths based on specified criteria; and WHEREAS,the"Applicant'has filed an application pursuantto Section 94.02.00 for a General Plan Amendment to amend General Plan Circulation Element Policy 7.1.5 to read as follows: General Plan Policy No. 7.1.5: "Cross-section standards may be modified by the Planning Commission and City Council to take into consideration the need for ' special right-of-way widths, street improvements, or pavement widths where property cannot be feasibly acquired,within the downtown to facilitate traffic calming and public parking facilities,the nature of the terrain through which the street passes to prevent scarring of the landscape,area needed to provide linear parks, bicycle or other alternative transportation facilities,and to achieve an urban design and special street program, or in response to a specific plan or planned development district. In addition, the determination of the Planning Commission and City Council shall conclude thatthere are no significant impact to the health,safety,and welfare of the residents of Palm Springs." WHEREAS,the Planning Commission has determined thatthe proposed General Plan Amendment is consistent with all General Plan objectives and policies; and WHEREAS,the Applicant,has filed a Planned Development application for Case 5.0344-PD164(A) for the expansion of the Palm Spring Convention Centerand associated site improvements located at 277 North Avenida Caballeros, Zone PD164, R-4, R-4-VP, and R-G-A(8); and WHEREAS, said Planned Development application was submitted to appropriate agencies as required bythe Planned Development requirements of the Palm Springs Municipal Code,with the request for their review, comments, and requirements; and WHEREAS, notice of the public hearing of the Planning Commission of the City of Palm Springs to consider the General Plan Amendment and Case No. 5.0344 - PD164(A), was given in ' accordance with applicable law; and ��cwiuuvn L.OJU Page 2 WHEREAS,on April 30,2003,a public hearing on the application for a General Plan Amendment and Case 5.0344-PD1 64(A)was held by the Planning Commission in accordance with applicable law; and WHEREAS, notice of the public hearing of the City Council of the City of Palm Springs to consider the General Plan Amendment and Case No. 5.0344 - PD164(A), was given in accordance with applicable law; and WHEREAS,on May 7,2003,a public hearing on the application fora General Plan Amendment and Case 5.0344-PD164(A)was held by the City Council in accordance with applicable law; and WHEREAS,the proposed project is considered a"project"pursuant to the terms of the California Environmental Quality Act("CEQA'),and an Environmental Assessment has been prepared for this project and has been distributed for public review and comment in accordance with CEQA; and WHEREAS,the City Council has carefully reviewed and considered all of the evidence presented in connection with the meeting on the Project, including but not limited to the staff report, all environmental data including the environmental assessment prepared forthe project and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds that the current environmental assessment for the General Plan Amendment and Case No. 5.0344-PD164(A) , adequately addresses the general environmental setting ofthe proposed Project,its significant environmental impacts, and the mitigation measures related to each significant environmental effect for the proposed project. The City Council further finds that with the incorporation of proposed mitigation measures, potentially significant environmental im pacts resulting from this project will be reduced to a level of insignificance and therefore recommends adoption of a Mitigated Negative Declaration for the project. Section 2: This proposed amendment to the General Plan will the road section on Avenida Caballeros directly east of the Convention Center to be constructed with the following modifications:1)extension of curb and gutter approximately eight(8')feet and removal of parking lane the west side of Avenida Caballeros between Amado Road and Andreas Road; and 2) maintain current number of travel lanes. Section 3: The proposed amendments to the General Plan are necessary and proper at this time, and are not likely to be detrimental to the adjacent property or residents. Section 4: Pursuant to Section 94.03.00 of the Palm Springs Zoning Ordinance, the City Council finds that with the incorporation of those conditions as amended by the response to comments and changes requested for clarification by the City Engineer and Convention Center General Manager as set forth in and attached in Exhibit-A: a. The use applied for at the location set forth in the application is properly one for which a ' Planned Development District is authorized by the City's Zoning Ordinance. ��G.lV1YL V • LV.1lV Page 3 ' The PD in-lieu of a change of zone may be approved by the City Council where a zone changeappears valid for specific uses,and onlythose uses, proposed byan applicant and where the applicant agrees to comply with all conditions imposed on the project. In this case, the City is proposing the use of land which is currently designated as the Planned Development District Number 164 for the expansion of existing Convention Center. The proposed amendmentwould includethe expansion of the existing Convention Centeras well as, the inclusion of additional parking on the north and future parking on the southwest boundaries. The PD in-lieu of a change of zone is an appropriate mechanism for consideration of the project because it encompasses flexibility in property development standards while also allowing a specific use in a zone where it would otherwise not be permitted. b. The use is necessaryor desirable forthe developmentof the community,is in harmonywith the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. Included with the project is a proposed revision to General Plan Policy 7.1.5 to allow the Planning Commission and City Council to consider special street sections throughout the City in response to urban design programs,specific plans,or planned development districts. The policy revision would allow the expansion of the curb and gutter towards the street by eightfeet,essentially removing the parking lane on the west side of Avenida Caballeros while ' keeping the same number of travel lanes. The policy revision will allow the Planning Commission and City Council greater flexibility in considering special streets, alternative transportation facilities, linear parks,and other public amenities.The special street section will facilitate traffic calming and enhance the Avenida Caballeros streetscape by providing additional landscaped area,which is necessary because the exhibit hall is being expanded up to the property line on Avenida Caballeros. Additional landscaping will soften the appearance of the building while the pull out lane, created as a result of the extended curb and gutter, will function as a passenger drop-off area. The delineated drop-off area will allow for the smooth flow of traffic on existing travel lanes. The proposed special street section is a reasonable request and will not have a significant impact on the health,safety, and welfare of the residents of Palm Springs. In addition, the expansion to the Convention Center is necessary in order to remain competitive and to retain existing events. The expansion has been analyzed to take into consideration surrounding land uses. The site area is limited but the expansion is appropriate due to existing hotels and other resort uses in the area. The Convention Center expansion project is in harmony with the General Plan and will be compatible with the surrounding resort community. C. The site is adequate in size and shape to accommodate said use, including yards, setbacks,walls orfences, landscaping, and otherfeatures required in orderto adjust said use to those existing or permitted future uses of land in the neighborhood. ' The Convention Center currently totals approximately 159,000 square feet. Theproposed expansion will add up to approximately 105,000 square feet of public spaces(exhibit space, meeting rooms and pre-function areas)and up to 25,000 square feet of administrative and //0 Page 4 service areas(including administrative offices,food service,service areas and restrooms) ' for a total of up to 289,000 square feet at build out. Ancillary construction will include a landscaped wall treatment on the northern project boundary,to screen loading areas from public view and reduce noise to surrounding residences. A vehicular service entrance will be located approximately 150 feet south of the intersection of Amado Road and Avenida Caballeros. A vehicular "drop off" area is proposed along the building facade on Calle Alvarado.Extensive landscaping is planned along the Calle Alvarado,Avenida Caballeros and Amado Road frontages. These landscaped treatments will include meandering walkways and public furniture, such as benches, shade:structures and trash receptacles. The walkways will provide pedestrian connections to the downtown Palm Springs area. Modifications to the property development standards have been requested as part of the Planned Development District including: setbacks, open space, building height, and off- street parking. The building setbacks are being reduced to allow the expansion to take maximum advantage of the property and to also allow the expansion to the exhibit hall. In order to accommodate the reduced setback,a landscape program and pedestrian arcades and walkways have been made a fundamental part of the project. Setback reductions are necessary to accommodate the project on the existing site. With regards to the open space requirements, lot coverage is approximately 52% leaving 48%hardscape/landscape space. Actual landscaped areas make up 29%of the site area. The portion of the building which will require the mostsignificant reduction in setbacks is the new entry on Calle Alvarado. The highest section of the entry canopy is up to 45 feet with ' a proposed setback which ranges from 0'to 60'. Refer to Attachment 6. Also illustrated on Attachment 6 is the minimum setback on Avenida Caballeros which is 2 feet where the curved buildingwall is closestto the propertyline. According to the high riseordinance,the canopy is required to have a height to setback ratio of 1.5:1, equivalent to a setback of 68 feet. As proposed, the canopy has a height to horizontal setback ratio of 0.8:1. For comparison purposes, the canopy is approximately 90 feet from the property line of the adjacent western multi-family residential development for a ratio of 2:1. Since the multi- family development will be most impacted bythe canopyfeature,the modification to the high rise requirements is reasonable because of the 2:1 height to setback ratio.With regards to the open space requirements, lot coverage is approximately 52% leaving 48% hard scape/landscape space. Actual landscaped areas make up 29% of the site area. d. That the site for the proposed use relates to streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. Access to parking lots proposed in conjunction with the Palm Springs Convention Center expansion are adequate. Traffic associated with the proposed expansion will travel to the parking lots proposed for the project including future lot on Andreas Road. Threedriveways would serve the north parking lot and two the west parking lot. Project traffic would be distributed among these driveways. The traffic signal analysis conducted for this project indicates that none of the key ' intersections in the project study area meet peak hourslignal warrants with year 2020 peak hour traffic volumes. l�� y Page 5 ' As previously discussed,a proposed one-way extension of Calle Alvarado between Tahquitz Canyon Way and Andreas Road is being considered to facilitate circulation for the largest events in the future. This extension would not be a public street, but a controlled-access driveway for use in conjunction with a traffic management plan to facilitate, as warranted, west lot ingress or egress. Use of this route may serve to reduce potential congestion on adjacent roadways. There is currently a median break on Tahquitz Canyon Way at Calle Alvarado. The use of this median break for left turns either in or out of the driveway would significantly impact traffic movements on Tahquitz Canyon Way. A mitigation measure has been included which would restrict project access to northbound right turns from Tahquitz Canyon Way onto this route and westbound right turns off of this drive onto Tahquitz Canyon Way. Potential may exist for the intersections of Calle El Segundo and Amado Road, and Calle El Segundo and Andreas Road, to require ultimate signalization. However, no other substantial capacity or operational impacts were identified relative to the proposed Palm Springs Convention Center expansion project. The proposed project will not adversely impact site access or circulation within or around the Palm Springs Convention Center. Therefore, other than improvements proposed in conjunction with the project, no other improvements are required to achieve the City performance standard of LOS D operation during peak hours in the peak season at the six key intersections evaluated. e. That the conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety, and general welfare and may include minor modifications of the zone's property development standards. All proposed conditions of approval are necessary to ensure public health and safety including, but not limited to, the application of the Uniform Building Code Seismic Safety Standards, Palm Springs Municipal Code, and the City of Palm Springs Fugitive Dust Control Ordinance. ACo S Page 6 NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council orders ' filing of a Mitigated Negative Declaration and approves the General Plan Amendment,as shown in Exhibits B and C, and Case 5.0344-PD164(A), subject to those conditions as set forth in the attached Exhibit A,which are to be satisfied prior to issuance of a Certificate of Occupancy unless otherwise specified, or modified by the City Council. Any agreements,easements or covenants required to be entered into shall be in a form approved by the City Attorney. 1. Pursuant to Fish and Game Code Section 711.4 a filing fee of$64.00 is required. This project has a de minimus impact on fish and wildlife, and a Certificate of Fee Exemption shall be completed by the City and two copies filed with the County Clerk. This application shall not be final until such fee is paid and the Certificate of Fee Exemption is filed. Fee ' shall in the form of a money order or cashier's check payable to Riverside County. 2. The mitigation measures of the environmental assessment shall apply and are incorporated by reference into the conditions of approval. Mitigation measures are as follows: a. AESTHETICS (EA Page III-7): Landscaped treatments, including meandering walkways, will be incorporated along Calle Alvarado, Avenida Caballeros, and Amado Road street frontages. b. Loading areas shall be screened from public view by a landscaped wall treatment on the northern project boundary. C. The proposed project will be consistent with surrounding development trends,and will be limited to buildings with desert architectural elements and colors. The exterior of the entire Convention Center, including the existing building, will be refinished. d. All development plans, including grading and site plans, building elevations and landscape plans,shall be submitted to the City for review. Building architecture will be reviewed under standards set forth in the City's Architectural Review Ordinance and the Section 14 Master Plan. ' e. Roof-top mechanical equipment shall be screened with walls or other appropriate treatment to match building architecture and to preserve scenic viewsheds and limit visual clutter. 1(,,eC7 ��c�uwuun wdru Page 10 f. All outdoor lighting shall be in compliance with City lighting standards. Outdoor ' lighting shall be architecturally integrated with the character of the associated structures, site design and landscape; directed downward and shielded, or specifically directed towalls,landscape elements or similar features,so that light is confined within the boundaries of the subject parcel; and appropriate in height, intensity and scale to the uses and the site they are serving. g. AIR QUALITY(EA Page III-22):The City's Fugitive Dust Control Ordinance(Chapter 8.5 of the Municipal Code)requires a Dust Control plan which shall be submitted to the Director of Building and Safety for approval and which shall include but not be limited to the following: i. Adequate watering techniques shall be employed to partially mitigate the impact of construction generated dust particulates. Portions of the project sitethatare undergoing earth moving operations shall be watered such that a crust will be formed on the ground surface and then watered again at the end of the day. ii. The wheels and lower portions of transport trucks shall be sprayed with water before the leave the construction area. iii. Any vegetative ground cover to be utilized on-site shall be planted as soon as possible to reduce the amount of open space subject to wind erosion. Irrigation systems needed to water these plants shall be installed as soon , as possible to maintain the ground cover and minimize blowsand. iv. Grading activity shall be suspended when local winds exceed 25 miles per hour and during first and second stage smog alerts. V. , Construction access roads shall be paved as soon as possible and cleaned after each work day. vi. All trucks hauling dirt,sand,soil or other loose dirt material shall be covered or have 2 feet of freeboard. vii. A short term stabilization plan shall be included in the plan for after hours and weekends.The City Engineer shall forward the plan to SCAQMD after approval. h. The project proponent shall notify the City and SCAQMD 24 hours prior to the initiation of earth moving activities. j. The Cityshall notifythe SCAQMDwithin 10 days of the completion of earth moving activities. k. Construction signage in conformance with City standards shall be posted on Amado Road, Avenida Caballeros, and Calle Alvarado regarding the reporting of blowing dust on the site. I. Earth moving operations shall include a water application system while earth moving is active. M. During the construction period rideshare and transit incentives shall be provided for construction personnel to reduce emissions from the vehicles of the construction workers in a mannerthat is approved bythe Directorof the Departmentof Planning and Zoning. n. Prior to issuance of grading permits, develop a traffic plan to minimize traffic flow interference from construction activities. The plan may include advance public notice of routing, use of public transportation and satellite parking areas with a shuttle service. o. Any construction equipment using diesel drive internal combustion engines shall use a diesel fuel with a maximum of 0.05%sulfur and a four degree retard,shall be fitted with the most modern emission control devices, and shall be properly tuned and maintained to reduce emissions. The Construction Manager(s)shall monitor compliance with this and is subject to periodic inspections by City Staff. P. The preferential use of diesel-powered construction equipment rather than gasoline- powered equipment, to affect exhaust emission reductions and evaporative and crankcase HC emission reductions. q. Construction equipment shall be properly maintained and serviced to minimize exhaust emissions. ' r. Construction access roads shall be paved as soon as possible and cleared after each workday. If the second phase parking lot at Andreas and Calle Alvarado is used as overflow ' parking prior to its being paved,the City shall assure that PM10 management plan is in place which addresses dust generation during its use to meet the standards of SCAQMD. t. CULTURAL RESOURCES (EA Page III-27): A native American Monitor shall be presentduring all ground disturbing activities on the parking lot expansion on Amado Road. Should any buried deposits be encountered, the Monitor shall have the authority to halt destructuve construction and notify a qualified archaeologist to envestigate, and if necessary prepare a mitigation plan for submission to the State Historic Preservation Officer and the Agua Caliente Cultural Resource Coordinator for approval. U. Should cultural resources be encountered during site construction in any portion of the site, work shall immediately cease and a qualified archaeologist shall be contacted to evaluate the significance of the materials. Any significant findings shall be documented and presented to the State Historic Preservation Office (SHPO), BIA, the Tribe and the City, and resolved to their satisfaction. V. GEOLOGY AND SOILS (EA Page III-29): A site specific soil analysis shall be prepared and submitted with all grading and building plans, and approved by an independent engineer prior to the issuance of building permits. W. The project will comply with City Department of Building and Safety construction standards, City building codes, and seismic engineering requirements of the Uniform Building Code (UBC). X. HYDROLOGYAND WATER QUALITY(EA Page lll-32):The use oflow-flush toilets and water-conserving faucets shall be required in conformance with Section 17921.3 of the Health and Safety Code, Title 20, California Code of Regulations Section 1601(b),and applicable sections of Title 24 of the State Government Code. Y. Care should be exercised in the positioning and selection of sprinklers so that they are correctly spaced and so as not to spray over upon sidewalks, roads or other paved areas. Z. Irrigation systems shall be equipped with a master valve which will automatically shutoff the system if excessive flows(especially due to damaged sprinklers)occur. Catchment areas should be incorporated into landscape design to accommodate overflows from occasional irrigation system malfunctions. aa. Drip irrigation systems and/or flow-compensated stream bubblers shall be used where applicable. bb. Planter beds and lawns shall be recessed below adjoining sidewalks and other hardscape so as to contain irrigation water. Mounds shall be designed so as to prevent sheet-flow across hardscape areas. cc. The use of mulch and proper topsoil preparation in planter beds shall be , encouraged, to increase the water absorption capacity of the soil. dd. Water pressure within irrigation systems shall be controlled so as to prevent drifting onto sidewalks, roads or bike paths during wind conditions. ee. Irrigation systems shall be controlled to respectthe irrigation zones(based on water use characteristics)they serve and to compensate for differences in exposure to sun and wind. Plantings should also be grouped according to their water use characteristics. ff. Landscape materials and irrigation system design shall consider the long term needs for maintenance, especially in regard to the design of small and irregularly- shaped areas. gg. Turf areas shall be located only in areas of maximum human contact, such as in recreation and sports areas or areas of heavy foot traffic, to conserve water used for irrigation and therefore groundwater supplies. Large, nonfunctional turf areas, such as those fronting roadways, should be discouraged. hh. The project shall construct additional storm drain improvements at the northwest corner of Amado Road and Avenida Caballeros necessary to accept and convey increased stormwater runoff generated by the project, consistent with the City's Master Plan of Drainage. ii. The Cityshall complywith all requirements for NPIDES and Regional Water Quality Control permitting, including stormwater quality controls. jj. NOISE (EA Page III-46): Construction activities on-site shall generally take place between 7:00 a.m. and 8:00 p.m., as specified by the Palm Springs Noise Ordinance(11.74.041),to reduce noise impacts during more sensitive time periods. However, if the proposed project requires certain construction tasks to be initiated prior to 7:00 a.m., the Convention Center shall apply for early work permits, as required under Chapter8.04.220 of the Palm Springs Municipal Code.Furthermore, if early morning(2:00 a.m.)concrete pours are required,every effort shall be made to limit such pours to 2 per week. The City shall also establish a noise complaint response program for this project during construction.A noise complaint phone number shall be prominently posted at the site on all sides of the project. If noise complaints are received,the City shall immediately meet with the complainant and identify actions to reduce the impacts to the greatest extent possible,including the installation of temporary noise barriers. kk. Ali construction equipment, fixed or mobile, shall be equipped with properly operating and maintained mufflers and the engines shall be equipped with shrouds. II. All construction equipment shall be in proper working order and maintained in a proper state of tune to reduce backfires. ' mm. Stockpiling and vehicle staging areas shall be located as far as practical from noise sensitive receptors. The southeast comer of the existing convention center site is preferred. /& Ca It rayc t nn. Parking, refueling and servicing operations for all heavy equipment and on-site ' construction vehicles shall be located as far as practical from existing homes.The southeast corner of the existing convention center site is preferred. oo. Every effort shall be made during construction activities to create the greatest distance between noise sources and noise sensitive receptors located west and north of the project site. pp. Stationary equipment shall be placed such that emitted noise is directedawayfrom noise sensitive receptors. qq. Future on-site development shall complywith all relevant noise policies set forth in the Noise Element of the General Plan and conform to the noise limitations outlined in the Palm Springs Noise Ordinance. rr. When truck intensive events are scheduled the:Convention Center shall establish a remote truck marshaling yard where thetrucks can queue while awaiting available space at the loading docks(to avoid truck idling noise in the surrounding community and traffic congestion during the morning peak.hours on the streets located in the study area). This yard may be located on the Palm Springs airport property, or at the City's Corporate Yard,orother location notadjacentto residential development. SS. Events which include music,eitheron the grounds of the convention center building or in the special event tent, shall be conducted in accordance with the City's noise ordinance. tt. Loud speakers used either on the grounds of the convention centerbuilding or in the special event tent shall comply with the City Noise Ordinance, unless special events are approved by the City Council. uu. TRANSPORTATIONITRAFFIC (EA Page III-68): The final design of the internal circulation network and site access plans shall be subject to the review and approval of the City Engineer during the development review process to ensure compliance with the City of Palm Springs access and design standards. vv. Facilities for buses, bicycles and shuttles shall be incorporated into the plans for access and parking facilities. ww. Features that make walking safe, convenient and pleasant shall be provided in conjunction with the proposed Convention Center expansion. Features would include wide sidewalks, decorative furniture, landscaping and shade trees, street lighting, and crosswalks. xx. The management of the Palm Springs Convention Center shall develop parking management plans and agreements that address utilization of off-site parking resources to meet the needs of scheduled events that are expected to generate more parked vehicles than can be accommodated in the north and west parking lots. /10 Page 15 yy. The Convention Center shall contribute on a "fair share' basis to the cost of signalizing Calle El Segundo and Amado,and/or Calle El Sugundo and Andreas,to insure that LOS D or better operation is maintained at these key intersections. zz. Should the proposed Calle Alvarado extension be constructed, the following is recommended during special events that may utilize this extension: The extension of Calle Alvarado shall only be utilized if traffic management staff are present to control traffic at its intersection with Tahquitz Canyon Way.The median break that occurs at Tahquitz Canyon Way and Calle Alvarado shall be closed during special events which utilize this driveway, to ensure safe traffic movement through this area. Project access would thus be restricted to northbound right turns from Tahquitz Canyon Way onto this route and westbound right turns off of this temporary drive. aaa. A pedestrian plan shall be developed which addresses the adequacy of lighting on Amado Road, the relationship of the parking lot to project entrances, and the location of a mid-block crossing.Other strategies,including crosswalks,pedestrian signals, pedestrian bollards, in-ground pavement lighting or overhead lighting, textured pavement and safety zones should be considered. 4. Thefinal development plans shall be submitted in accordance with Section 94.03.00 of the Zoning Ordinance. Final development plans shall include site plans, building elevations, floor plans, roof plans, grading plans, landscape plans, irrigation plans, exterior lighting plans, sign program, mitigation monitoring program, site cross sections, property development standards and other such documents as required by the Planning Commission. Final development plans shall be submitted within two (2)years of the City Council approval of the preliminary planned development district. 5. Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for approval by the Department of Planning and Zoning prior to issuance of a building permit. Landscape plans shall be approved by the Riverside County Agricultural Commissioner's Office prior to submittal. 6. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance shall be shown and all disturbed areas shall be fully restored or landscaped. 7. Separate architectural approval and permits shall be required for all signs. A detailed sign program shall be submitted for review and approval by the Planning Commission prior to issuance of building permits. 8. All materials on the flat portions of the roof shall be earth tone in color. 9. All roof mounted mechanical equipment shall be screened from all possible vantage points both existing and future perSection 93.03.00 of the Zoning Ord inance. The screening shall be considered as an element of the overall design and must blend with the architectural ' design of the building(s). The exterior elevations and roof plans of the buildings shall indicate anyfixtures or equipment to be located on the roof of the building,the equipment heights, and type of screening. Parapets shall be at least 6"above the equipment for the purpose of screening. 10. No exterior downspouts shall be permitted on any facade on the proposed building(s)which , are visible from adjacent streets or residential and commercial areas. 11. Perimeter walls shall be designed, installed and maintained in compliance with corner cutback requirements as required in Section 93.02.00.D. 12. The design, height,texture and color of building(s),fences and walls shall be submitted for review and approval prior to issuance of building permits. 13, An exterior lighting plan in accordance with Zoning Ordinance Section 93.21.00, Outdoor Lighting Standards,shall be submitted for review and approval by the Director of Planning and Zoning prior to the issuance of building permits. Manufacturer's cut sheets of all exterior lighting on the building, in the landscaping,and in the parking lotshall be submitted for approval prior to issuance of a building permit. If lights are proposed to be mounted on buildings,down-lights shall be utilized.A photometric study shall be required for all parking areas, driveways, entries, and landscape areas. 14. Parking lot light fixtures shall align with stall striping and shall be located two to three feet from curb face. 15. No sirens, outside paging or any type of signalization will be permitted, except approved alarm systems. 16. No outside storage of any kind shall be permitted except as approved as a part of the proposed plan. 17. Vehicles associated with the operation of the proposed development including company vehicles or employees vehicles shall not be permitted to park offthe proposed building site unless a parking management plan has been approved per Section 93.06.00. 18. Prior to the issuance of building permits, locations of all telephone and electrical boxes must be indicated on the building plans and must be completely screened and located in the interior of the building. Electrical transformers must be located toward the interior of the project maintaining a sufficient distance from the frontage(s) of the project. Said transformer(s) must be adequately and decoratively screened. 19. Islands of not less than 9 feet in width with a minimum of 6 feet of planter shall be provided every 10 parking spaces, except in the area designated for the special event tent at the northeast corner of Am ado Road and Ca Ile Alvarado, Additional islands maybe necessary to comply with shading requirements in #23 below. 20. Shading requirements for parking lot areas as set forth in Section 9306.00 of the Zoning Ordinance shall be met. Details to be provided with final landscape plan. 21. Parking stalls shall be delineated with a 4 to 6 inch double stripe-hairpin or elongated "Ll" design. Individual wheel stops shall be prohibited;a continuous 6"barrier curb shall provide wheel stops. RCSuluLLVII LIN7o Page 17 22. Concrete walks with a minimum width of two (2) feet shall be installed adjacent to end parking spaces or end spaces shall be increased to eleven (11)feet wide. 23. Tree wells shall be provided within the parking lot and shall have a planting area of six feet in diameter/width. 24. Standard parking spaces shall be 17 feet deep by 9 feet wide;compact sized spaces shall be 15 feet deep by 8 feet wide. Handicap parking spaces shall be 18 feet deep by 9 feet wide plus a 5 foot walkway at the right side of the parking space;two(2)handicap spaces can share common walkway. One in every eight(8)handicap accessible spaces,but not less than one (1), shall be served by an 8 foot walkway on the right side and shall be designated as "van accessible". 25. Handicapped accessibility shall be indicated on the site plan to include the location of handicapped parking spaces,the main entrance to the proposed structure and the path of travel to the main entrance. Consideration shall be given to potential difficulties with the handicapped accessibility to the building due to the future grading plans for the property. 26. Compact and handicapped spaces shall be appropriately marked perSection 9306.00C 10. 27. Curbs shall be installed at a minimum of five(5)feet from face of walls, fences, buildings, or other structures. Areas that are not part of the maneuvering area shall have curbs placed at a minimum of two (2) feet from the face of walls, fences or buildings adjoining ' driveways. POLICE DEPARTMENT 1. Developershall comply With Section 11 of Chapter 8.04 of the Palm Springs Municipal Code. BUILDING DEPARTMENT 1. General: This project shall comply with 2001 edition of the California Building Code(Title 24), which adopts the 1997 UBC, 2000 UMC, 2000 UPC and the 1999 NEC. 2. Provide a Building Code Data Legend on the Title Sheet. Building Area:When a building has more than one occupancy,the area shall be such that the sum of the ratios of the actual area divided by the allowable area for each occupancy shall not exceed one. Section 504.3. 10. Occupancy Separation: Show the locations and ratings of any proposed occupancy separations. 11. Types of Construction:There may be more than one type of construction on the site at this time.The expansion may introduce even more.Shown✓here the separations occur on the plan. FIRE 1. Fire Sprinkler Alterations: Plans for alteration of an existing fire sprinkler system shall be ' submitted to the Fire Dept. for review and approval prior to installation. The alteration or modification of an existing Automatic Fire Sprinkler System and its coverage shall be in accordance with the 1999 edition of NFPA standard 13, 13R or 13D, as appropriate. 2. Fire Sprinkler Plan Submittal: The contractor should submit fire sprinkler plans when the building plans are submitted. This allows concurrent review of the fire sprinkler and building plans. (Two sets will be retained by the fire department). Submittal to include manufacturers cutsheets on all material and equipment used. Submittal shall also include hydraulic calculations. A set of approved plan shall be maintained at all times on the job site. 3. Sprinkler Heads: Only new sprinkler heads shall be employed in the installation of the sprinkler system. 4. Approved and Listed Materials:The entire fire sprinklersystem shall onlyemploythe use of approved and currently listed materials, equipment, and devices. 5. Hydrostatic Tests:All system piping shall be hydrostatically tested at200 PSI fortwo hours or at 50 PSI above the system operating pressure, whichever is greater. 6. Required Signs:All fire sprinklervalves shall have a permanently affixed sign indicating the valve function and area served. The address of the building served shall be clearly , indicated on the Fire Department Connection (FDC). 7. Soffit Sprinkler Coverage: All Soffits over 4' require automatic fire sprinkler coverage. I(-P C-c ' 8. C-16 Fire Sprinkler Contractor: Fire sprinkler systems shall only be designed and installed by a Fire Sprinkler Contractor licensed by the California Contractors State License Board. 9. Added Sprinkler Heads: Any sprinkler heads added to an existing system shall be new,and the same brand,style,type and temperature rating as those already installed in the building. Exceptions only with advance approval of the fire inspector. Contractor to provide manufacturers cut sheets for all sprinklers used,with documentation of sprinklers existing in the building. 10. Trash Container Protection: Trash container space is within 5 feet of the building wall. Provide information on the type and size of trash container to be stored there. If it is a dumpster with a capacity of 1.5 cubic yards or greater, then the enclosure must be protected by an approved automatic fire sprinkler. (1103.2.2 CFC) 11. Hood & Duct Fire Protection System Coverage: The automatic fire extinguishing system used to protect ventilating hoods and ducts and cooking appliances shall be installed to include cooking surfaces, deep fat fryers, griddles, upright broilers, charbroilers, range tops,and grills. Protection shall also be provided forthe enclosed plenum space within the hood above filters and exhaust ducts serving the hood. (1005.2.3.1 CFC) 12. Hood & Duct Fire Protection System plan submittal: The contractor should submit fire extinguishing system plans when the building plans are submitted. This allows concurrent review of the fire extinguishing system and building plans. Submittal shall include manufacturers data/cut sheets and listings with expiration dates on all equipment and materials used. 13. Portable Fire Extinguishers For Food Processing Equipment: In addition to the fixed system, a 2-A:1-B:C:K rated portable fire extinguisher shall be installed near the exitfrom the cooking equipment area. Show proposed location on the plans. 14. Automatic Power And Fuel Shutoffs: The automatic fire extinguishing system shall be interconnected to the fuel or current supply for cooking equipment. The interconnection shall shut off all cooking equipment and electrical receptacles which are located under the hood when the system is actuated. (1005.2.4.1 CFC) 15. Systems Testing: The hood and duct fire extinguishing system shall be function tested prior to final acceptance. Call the fire prevention secretary at 760-323-8186 for an inspection appointment. 16. Fire Alarm System: Fire Alarm System required. Installation shall comply with the requirements of NFPA 72. 17. Audible water flow alarms: An approved audible sprinkler flow alarm shall be provided on the exterior of the building in an approved location. An approved audible sprinkler flow alarm to alert the occupants shall be provided in the interior of the building in a normally ' occupied location. (904.3.2 CBC) Page 20 18. Alterations and modifications: Alterations and modifications to an existing Fire Alarm System shall be in accordance with the 2001 CFC, 96 NEC and NFPA 72. Fire alarm contractor shall contact the fire department as soon as possible for requirements. 19. Added Fire Alarm components: Any smoke detectors,heat detectors,or audible and visual devices added to the existing system shall be new, and the same brand,style,and type as those already installed in the building. Exceptions only with advance approval of the fire inspector. Contractor to provide manufacturers cut sheets for all alarm devices used,with documentation of devices existing in the building. 20. Plan Submittals: The contractor should submitfire alarm system plans when the building plans are submitted. This allows concurrent review of the fire alarm system and building plans. Submittal shall include manufacturers data/cut sheets and listings with expiration dates on all equipment and materials used. Include battery calculations with submittal. 21. Wiring Installation: The installation of all Fire Alarm Wiring and Equipment shall be in accordance with NFPA 72, 760, NEC. 22. System Acceptance Test: Upon completion of the installation of the Fire Alarm System, a satisfactory test of the entire system shall be made. The test shall be witnessed by the fire inspector. 23. Protective Signaling Service(Central Station Service): A UL listed and certified Protective Signaling Service (Central Station Service) is required. Provide the fire department with ' proof of listing and current certificate.The fire department shall be notified immediately of change in service. (904.3.1 CBC) 24. Fire Dampers: Fire Dampers shall be provided where air ducts penetrate fire-rated walls or ceilings. 25. Dampers and Detectors: Smoke Dampers and Activating Smoke and/or Heat Detectors shall be in accordance with the 2001 CBC and must be:installed separately from the Fire Alarm System. The signals for these devices shall not be included with any fire alarm or water flow signal. These devices may be tied into the Fire Alarm Control Panel for annunciation purposes only. 26. Portable Fire Extinguishers and Standpipes: Extinguishers and standpipes shall be extended Into all expanded areas. Include a plan Indicating where these additional appliances will be located In the expanded areas for approval. ENGINEERING Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer. The following conditions of approval are based on the assumption that construction of a new parking lot will be required on City property located north of the existing Convention Center property, located on Assessor's Parcel Numbers 508-034-012 and 508-034-014. /(a C ' STREETS 1. Submit street improvement plans prepared by a Registered Civil Engineer to the Engineering Department for review and approval.The plan(s)shall be approved bythe City Engineer prior to issuance of any grading or building permits. AVENIDA CABALLEROS 2. Removethe existing curb and gutter located 42feetwestof centerline and construct6 inch curb and gutter 34 feet west of centerline in accordance with City of Palm Springs Standard Drawings No. 200 for the portion of the site where street width is being modified. The existing sidewalk shall be removed and replaced as required in coordination with on-site improvements adjacent to the proposed building expansion. 3.) Construct new curb and gutter and sidewalk to match existing improvements where removals are required for proposed driveway approaches and turn-out for drop-off area. 4. Construct a catch basin and storm drain connector pipe to the existing storm drain line within Avenida Caballeros,at the northwest corner of the intersection of Avenida Caballeros and Amado Road in accordance with City of Palm Springs Standard Drawing No. 700 and applicable standards of the Riverside County Flood Control District. The catch basin width and depth shall be determined by a hydrology study,and all connections shall be approved by the Riverside County Flood Control District. AMADO ROAD 5. The existing curb and gutter and sidewalk shall remain in place. Except where modified by proposed improvements. 6. Remove the existing asphalt concrete berm and construct a 6 inch curb and gutter,32 feet north of centerline along the entire frontage ofAPN 508-034-014,with a 25 foot radius curb return and spandrel at the northeast corner of the intersection of Amado Road and Calle Alvarado in accordance with City of Palm Springs Standard Drawing No. 200 and 206. 7. Construct the east half of an 8 feet wide cross gutter at the northeast corner of the intersection of Amado Road and Calle Alvarado with a flow line parallel with and 32 feet north of the centerline of Amado Road in accordance with City of Palm Springs Standard Drawing No. 200 and 206. 8. Construct a minimum 24 feet wide driveway approach in accordance with City of Palm Springs Standard Drawing No. 205. 9. Construct an 8 feet wide sidewalk behind the curb along the entire frontage of APN 508- 034-014 in accordance with City of Palm Springs Standard Drawing No.210.Alternatively, in accordance with approved site plans or landscape plans,meandering and/or decorative sidewalk shall be constructed to the satisfaction of the City Engineer. 10. Construct a curb ramp meeting current California State Accessibility standards at the northeast corner of the intersection of Amado Road and CalleAlvarado in accordance with City of Palm Springs Standard Drawing No. 212. /& Q V 11. Remove and replace existing pavement with a minimum pavement section of 3 inch ' asphalt concrete pavement over 6 inch aggregate base with a minimum subgrade of 24 inches at 95% relative compaction, OR equal,from proposed gutter to clean sawcut edge of pavement along the entire frontage of APN 508-034-014 in accordance with City of Palm Springs Standard Drawing No. 110 and 325. The pavement section shall be designed, using "R" values, by a licensed Soils Engineer and submitted to the City Engineer for approval. CALLE ALVARADO 12. The existing curb and gutter and sidewalk shall remain in place except for curb cuts necessary for proposed driveway approaches and turn-out for proposed drop-off area. 13. Construct new curb and gutter and sidewalk to match existing improvements where removals are required for proposed driveway approaches and turn-out for drop-off area. Alternatively, in accordance with approved site plans or landscape plans, meandering and/or decorative sidewalk shall be constructed to the satisfaction of the City Engineer. 14. Construct a 6 inch curb and gutter, 20 feet east of centerline along the entire frontage of APN 508-034-012 and 508-034-014,with a 25 foot radius curb return and spandrel at the northeast corner of the intersection ofAmado Road and Calle Alvarado in accordancewith City of Palm Springs Standard Drawing No. 200 and 2'.06. 15. Construct a minimum 24 feet wide driveway approach in accordance with City of Palm ' Springs Standard Drawing No. 205. 16. Construct an 8 feet wide sidewalk behind the curb along the entire frontage of APN 508- 034-012 and 508-034-014 in accordance with City of Palm Springs Standard Drawing No. 210.Alternatively,in accordance with approved site plans or landscape plans,meandering and/or decorative sidewalk shall be constructed to the satisfaction of the City Engineer. 17. Construct a curb ramp meeting current California State Accessibility standards at the northeast cornerof the intersection ofAmado Road and Calle Alvarado in accordance with City of Palm Springs Standard Drawing No. 212. 18. Remove and replace existing pavement with a minimum pavement section of 3 inch asphalt concrete pavement over 6 inch aggregate base with a minimum subgrade of 24 inches at 95%relative compaction, OR equal,from proposed gutter to clean sawcut edge of pavementalong the entire frontage of APN 508-034-012 and 508-034-014 in accordance with City of Palm Springs Standard Drawing No. 110 and 315.The pavement section shall be designed, using "R" values, by a licensed Soils Engineer and submitted to the City Engineer for approval. GRADING 19. Submit Precise Grading Plan prepared by Registered Civil Engineerto the Engineering ' Department for review and approval.The Precise Grading Plan shall be submitted to the Planning Department for approval to submit for plan check, prior to submittal to the Engineering Department.A PM 10(dust control)Plan shall be submitted to and approved I & ce 50 Page 23V ' by the Building Department prior to approval of the Precise Grading Plan. The Precise Grading Plan shall be approved by the City Engineer prior to issuance of any grading or building permits. 20. Drainage swales shall be provided adjacent to all curbs and sidewalks - 3' wide and 6" deep -to keep nuisance water from entering the public streets, roadways, or gutters. 21. A General Construction Activity Storm Water Permit from the State Water Resources Control Board (Phone No. 760-346-7491)shall be required for this project. A copy of the Permit, when executed, shall be provided to the City Engineer prior to issuance of the grading permit. 22. A soils report prepared by a licensed Geotechnical Engineer shall be required for and incorporated as an integral part of the grading plan for the proposed site.A copy of the soils report shall be submitted to the Building Department and to the Engineering Department along with plans,calculations and other information subjectto approval bythe City Engineer prior to the issuance of the grading permit. DRAINAGE 23. All stormwater runoff passing through and falling onto the site shall be accepted and conducted to an approved drainage structure(if available). On-site retention/detention or otherfacilities approved by the City Engineer shall be required if off-site drainage structures ' are unavailable or cannot contain the increased stormwater runoff generated by the development of the site. Provide a hydrology study to determine if the increased stormwater runoff due to development of the site exceeds the capacity of offsite drainage structures(if any exist), and to determine required stormwater runoff mitigation measures forthis project. Final detention/retention basin sizing and other stormwater runoff mitigation measures shall be determined upon reviewand approval of the hydrology study by the City Engineer and may require redesign or changes to site configurations consistent with the findings of the final hydrology study. ON-SITE 24. The on-site parking lot shall be designed in accordance with City of Palm Springs Zoning Ordinance, Section 9306.00. GENERAL 25. Any utility cuts in the existing off-site pavement made by this development shall receive trench replacement pavement to match existing pavement plus one additional inch. See City of Palm Springs Standard Drawing No. 115. Pavement shall be restored to a smooth rideable surface. 26. All existing utilities shall be shown on the grading/street plans.The existing and proposed service laterals shall be shown from the main line to the property line.The approved original ' grading/street plans shall be as-built and returned to the City of Palm Springs Engineering Department prior to issuance of the certificate of occupancy. 169 C 31 Page 24 27. Nothing shall be constructed or planted in the corner cut-off area of any driveway which ' does orwill exceed the height required to maintain an appropriate sightdistance per City of Palm Springs Zoning Code Section 93.02.00, D. 28. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk and/or curb shall have City approved deep root barriers installed per City of Palm Springs Standard Drawing No. 904. TRAFFIC 29. In accordance with the recommendations of the Traffic Impact Study prepared by Endo Engineering, dated March 14, 2003, a traffic signal at the intersection of Calle El Segundo/Amado Road and Calle El Segundo/Andreas Road shall be installed when warranted as traffic volumes materialize and delay during the peak hour becomes excessive. 30. Separate striping plans are to be prepared and submitted along with street improvement plans for review and approval by the City Engineer. 31. A 36 inch"STOP"sign shall be installed in accordance with City of Palm Springs Standard Drawing No. 620 at locations where vehicles exit the project site(s). 1
