HomeMy WebLinkAbout20550 - RESOLUTIONS - 2/19/2003 RESOLUTION NO. 20550 ' OF THE CITY COUNCIL OF THE CITY 01= PALM SPRINGS, CALIFORNIA, APPROVING AMENDMENTS TO THE GENERAL PLAN LAND USE AND CIRCULATION ELEMENTS SO AS TO: (A) REDESIGNATE 5.11 ACRES OF LAND FROM MEDIUM DENSITY RESIDENTIAL 12-15 UNITS/ACRE (M15) TO GENERAL COMMERCIAL (GC) AND CONSERVATION (C) FOR THE PROPERTY LOCATED AT 4155 EAST MATTHEW DRIVE, ZONE R-2 AND R-1-AH, SECTION 30; (B) REDESIGNATE 3.27 ACRES OF LAND FROM MEDIUM DENSITY RESIDENTIAL 12-15 UNITS/ACRE (M15) TO MEDIUM-HIGH DENSITY RESIDENTIAL 21-30 UNITS/ACRE (H30) FOR THE PROPERTY LOCATED AT THE NORTHEAST CORNER OF MURRAY CANYON DRIVE AND SIERRA MADRE,ZONE R-2 AND 0,SECTION 35;(C)DELETE AN UNIMPROVED PORTION OF ARENAS ROAD BETWEEN SUNRISE WAY AND HERMOSA DRIVE FROM THE CIRCULATION PLAN. WHEREAS, Matthew Dragicevich Charitable Remainder Truest (the "applicant') has filed Case 5.0916 with the City for a General Plan Map Amendment to redesignate 5.11 acres of land from Medium Density Residential 12-15 units/acre(M15)to General Commercial(GC)and Conservation ' (C)for the property located at 4155 East Matthew Drive, Zone R-2 and R-1-AH, Section 30; and WHEREAS, Laguna Pacific, LP for Canyon Vista, LP (the "applicant") has filed Case 5.0938 with the City for a General Plan Map Amendment to redesignate: 3.27 acres of land from Medium Density Residential 12-15 units/acre (M15) to Medium-High Density Residential 21-30 units/acre (H30)for the property located at the northeast corner of Murray Canyon Drive and Sierra Madre, Zone R-2 and O, Section 35; and WHEREAS, Palm Springs Modern Homes II, LLC(the "applicant') has filed Case 6.0941 with the City for an amendment to the General Plan Circulation Plan to delete an unimproved portion of Arenas Road between Sunrise Way and Hermosa Drive in conjunction with the project located at 1460 and 1550 East Baristo Road; and WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements was given in accordance with applicable law; and WHEREAS, on January 22, 2003 a public hearing to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements,was held by the Planning Commission in accordance with applicable law; and WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and ' Circulation Elements was given in accordance with applicable law; and Kesoli0tion 20550 Page 2 WHEREAS, on February 19, 2003 a public hearing to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements,was held by the City Council in accordance with applicable law; and WHEREAS, in accordance with Section 15063 of the California Environmental Quality Act, an Environmental Assessment was prepared and staff found that with the incorporation of proposed mitigation measures, the proposed project could not have a significant effect on the environment; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds that the current environmental assessment for Case Nos. 5.0916, 5.0938, and 5.0941 adequately addresses the general environmental setting of the proposed Project, its significant environmental impacts, and the mitigation measures related to each significant environmental effect for the proposed project. The City Council further finds that with the incorporation of proposed mitigation measures,potentially significant environmental impacts resulting from this project will be reduced to a level of insignificance and therefore recommends adoption of a Mitigated Negative Declaration for the project. Section 2: Given the use and location of the site located at 4155 East Matthew Drive, the existing commercial uses of the site more closely associates with the commercial uses to the west and northwest than the apartments to the north and residential use and vacant land to the east. The property located at 4155 East Matthew Drive is suitable for the uses intended in the General Plan designation and the uses permitted in the proposed zone, in terms of access, size of parcel, relationship to similar or related uses, and other considerations deemed relevant by the Commission. Section 3: The property at the northeast corner of Murray Canyon Drive and Sierra Madre is currently vacant, but was formerly developed as a tennis club. The re-designation of the property located at the northeast corner of Murray Canyon Drive and Sierra Madre to H30 is appropriate due to surrounding multiple family land use designations. The project site is suitable for the use of land on a timeshare basis due to the density and resort character of the development in the surrounding vicinity. The project will be accessed from Murray Canyon Drive, a secondary thoroughfare, and Sierra Madre, a collector street. Both Murray Canyon Drive and Sierra Madre have already been improved to secondary and collector street standards,respectively.The project site abuts the Canyon Country Club golf course and is sensitive to single family residential development to the north. The building height for the project decreases to fifteen feet and one-story 200 feet from the R-1 C zoning to the north.The 200 foot setback is required by Section 92.04.03.D.2,which ' limits building heights to 15 feet or one-story when R-3 zoned property abuts R-1 zoned property. /4)'*4c od-) .- Kesowuon zu:)5u Page 3 Section 4: The deletion of a portion of Arenas Road between Sunrise Way and Hermosa Drive , is consistent with the Draft Section 14 Master Plan's Land Use and Circulation Plan and will allow the General Plan to remain internally consistent. The portion of Arenas proposed to be removed is currently unimproved with no plans for future improvements.The proposed amendment to the General Plan Circulation Element is necessary and proper at this time, and is not likely to be detrimental to the adjacent property or residents. Section 5: The proposed amendments to the General Plan are necessary and proper at this time, and are not likely to be detrimental to the adjacent property or residents. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the amendments to the General Plan Land Use and Circulation Elements as shown in Exhibits A, B, and C.
