HomeMy WebLinkAbout20482 - RESOLUTIONS - 10/16/2002 RESOLUTION NO. 20482 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, , CALIFORNIA, OVERRULING THE PLANNING COMMISSION APPROVAL AND REFERRING CASE 3.2198 TO CONSTRUCT A 40 X 60 STORAGE BUILDING' BACK TO THE PLANNING COMMISSION FOR FURTHER REVIEW,LOCATEDAT231 OASIS ROAD, ZONE M-1, SECTION 34. WHEREAS, Jim Reinmuth, agent for Bob Cornish (the"Applicant')filed an application with the City to construct a 40 x 60 storage building located at 231 Oasis Road, Zone M-1, Section 34; and WHEREAS, notice of a public meeting of the Planning Commission of the City of Palm Springs to consider an application for Case 3.2198, an application for a 40 x 60 storage building, was issued in accordance with applicable law; and WHEREAS, on August 14, 2002, a public meeting for the request to construct the 40 x 60 storage building was held by the Planning Commission in accordance with applicable law; and WHEREAS,the Planning Commission carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, all written and oral testimony presented; and WHEREAS,on August 14,2002,the Planning Commission voted 7-0 to approve,with conditions,Case ' 3.2198 for the construction of a 40 x 60 storage building; and WHEREAS, on August 28, 2002, a City Councilmember appealed the Planning Commission approval of Case 3,2198; and WHEREAS, notice of a public meeting of the City Council of the City of Palm Springs to consider an appeal of the Planning Commission decision of the application for Case 3.2198 was issued in accordance with applicable law; and WHEREAS, on October 2, 2002, the public meeting on,the appeal of the Planning Commission decision for Case 3.2198 was held by the City Council in accordance with applicable law; and WHEREAS, on October 16, 2002, the public meeting on the appeal of the Planning Commission decision for Case 3.2198 was held by the City Council in accordance with applicable law; and WHEREAS, the City has not previously. approved a pre-fabricated commercial building of the type proposed in Case 3.2198; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project,including but not limited to the staff report,all written and oral testimony presented. Resolution 20482 Pbge 2 THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to Zoning Ordinance Section 94.04.00, the City Council finds that: a. The proposed metal building with cosmetic changes and architectural upgrades is not approved because it is not compatible with other buildings in the surrounding neighborhood. b. The upgrades for the proposed metal building are not consistent with previous design requirements for similar buildings. C. The building design and materials are not sympathetic with desert surroundings nor architecture of surrounding buildings. d. The City Council overrides the Planning Commission's approval of Case 3.2198. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby overrules the Planning Commission and refers Case 3.2198 back to the Planning Commission for review and approval of revised architectural plans to be submitted by the applicant.
