A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS SEEKING FEDERAL AVIATION ADMINISTRATION
RELEASE OF LAND FOR SALE OF APPROXIMATELY4.67 ACRES
OF AIRPORT PROPERTY ALSO KNOWN AS THE PALM SPRINGS
UNIFIED SCHOOL DISTRICT OPERATIONS & MAINTENANCE
FACILITY AND ESTABLISHING A REINVESTMENT PLAN,
WHEREAS Palm Springs International Airport is currently in the midst of a Master Planning
process for the Airport; and
WHEREAS a majorfocus of the Master Planning effort is to evaluate long-term uses of Airport
property; and
WHEREAS the Master Planning effort has found that "There is also property leased to the
School District in the west GA area that is blocked from Airfield access. This property may
be suitable for sale with the proceeds used for needed airport improvements."; and
WHEREAS the Palm Springs Unified School District has leased the approximate 4.67 acres
of Airport property for its Operations and Maintenance Facility for over forty (40) years and
has formally asked that the Airport consider a sale of the property to the District; and
WHEREAS in its review of the Master Plan, the Airport Commission has determined that the
subject parcel is excess and available for sale subject to FAA authorization and has
developed a "Reinvestment Plan,"
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs does
hereby request the following:
Section 1. That the Federal Aviation Administration authorize release from all terms,
conditions, reservations or restrictions for sale of the following described
parcel (see Exhibit "A" attached for plat):
LEGAL DESCRIPTION
That portion of the Northeast 1/4 Section 13, Township 4 South, Range 4
East, San Bernardino Base and Meridian, in the City of Palm Springs, County
of Riverside, State of California, being more particularly described as follows:
A portion of Lots 1 and 2, Palm Valley Colony Lands, commencing at the
Northeast Corner of said Section 13,thence along the Northerly line of Section
13, South 89 Degrees 48' 00" West a distance of 1,175.99 feet;
Thence South 00 Degrees 06'44"West a distance of 40 feet to a point on the
' Southerly Right-of-Way of Alejo Road, said point also being the TRUE POINT
OF BEGINNING:
Thence South 00 Degrees 06' 44" West a distance of 320.00 feet;
Thence.North 89 Degrees 48' 00" East a distance of 636.00 feet;

Thence North 00 Degrees 06'44" East a distance of 320.00 feet;
Thence South 89 Degrees 48' 00"West along the Southerly Right-of-Way of
Alejo Road a distance of 636.00 feet to the TRUE POINT OF BEGINNING,
said parcel containing 4.67 acres, more or less.
Section 2: That upon receipt of said Federal Aviation Administration Instrument of
Release, the City shall sell the parcel for fair market value of $671,000 as
determined by an appraisal dated August 26, 2002, and all proceeds of the
sale shall be utilized exclusively for developing, improving, or maintaining the
Airport as more specifically described as follows:
REINVESTMENT PLAN
a) Eligible items of airport development set forth in the current Airport
Improvement Program (AIP) and reflected in the Airport's Capital
Improvement Program.
b) Anyaeronautical itemsof airport development ineligible under the Al P.
c) Retirement of airport bonds which are secured by pledges of airport
revenue, including repayment of loans from other federal agencies for
such development.
d) Development of common use facilities, utilities, and other
improvements on dedicated revenue production property that clearly
enhances the revenue production capabilities of the property.
Section 3. That the City will also ensure that the conveyance deed contains"public right
of flight" easements above the parcel and restrictions on height of structures
on the parcel to "not more than 500 feet above sea level."
Section 4. That the Executive Director-Airports is hereby designated as the "authorized
official of the public agency that owns the Airport"for purposes of seeking the
above referenced release and is responsible for management and
administration of the Airport's real property.
