HomeMy WebLinkAbout20416 - RESOLUTIONS - 7/17/2002 RESOLUTION NO. 20416 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, ' CALIFORNIA OVERRULING THE PROTEST ON THE SPREAD OF ANNUAL ASSESSMENTS,AND CONFIRMING THE ENGINEER'S REPORT, DIAGRAM AND ASSESSMENT SPREAD FOR PARKWAY MAINTENANCE DISTRICT NO. 9 "FLORA VISTA" TRACT 26364, ALONG SUNRISE WAY (VIA ESCUELA TO RACQUET CLUB), FOR FISCAL YEAR 2002-03. WHEREAS in accordance with the provisions of the Landscaping and Lighting Act of 1972 thatthe Engineer of Work has determined the estimated maintenance costs for the ensuing year in order to prepare the annual spread of assessment; and WHEREAS July 17, 2002, was set as the date to hear protests on the spread of assessment for Parkway Maintenance District No. 9- "Flora Vista" Tract 26363 (77 Properties) ; and WHEREAS notice duly was given by publication and a hearing duly conducted at which all persons interested testified; and WHEREAS written protests have been received representing less than fifty percent (50%) of the area of assessable lands within the maintenance'area; and WHEREAS spread of assessment shall beforwarded tothe County Tax Collectorwho, in turn,shall place this assessment on the County Tax Roll. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. Description of work: To maintain the landscaped parkway (buffer-strip 25' wide by approximately 1250' long) installed by the developer of Tract 26364 "Flora Vista" along the west side'of Sunrise Way (Via Escuela to Racquet Club). Said maintenance work described in detail in the Engineer's Report for FY 02-03. Section2. That all protests,if any,are hereby o verruled for Parkway Maintenance District No.9. Section 3. The improvements, assessment amount,spread of assessment and the diagram as set out in the Engineer's Report are hereby confirmed for fiscal year 2002-03. Assessment in 02-03 is $0.00 due to surplus in account carried from prior years. ($17,762 Surplus, carried forward exceeds $17,196 cost estimate for FY 02-03) Note: Developer has completed the landscaping and irrigation and the City took over maintenance of the district for the first time in May, 2002. Section 4. The City Clerk is hereby ordered and directed to file a certified copy of the diagram and assessment roll with the County Tax Collector, together with a certified copy of this Resolution upon its adoption and the auditor is requested to collect such assessments on the tax roll in the same manner and subject to the same penalties for non-payment as are county property taxes. This project is statutorily exempt from CEQA under Section 15273 of the guidelines as an ongoing maintenance charge.All work is in accordance with the Landscaping and Lighting Act of 1972 (Part 2 of Division 15), Section 22500 of the Streets and Highways Code and Article XIIID, Section 4 of the California Constitution (Proposition 218). A current $17,762 surplus in PMD No. 9 account no. 001-2451-43580 exceeds the $17,196 maintenance cost estimate for FY 02/03, therefore $0.00 was assessed to the property owners in FY 2002/03. Also note that the (Flora Vista) subdivision developer completed the landscaping strip along Sunrise Way (Via Escuela to Racquet Club) in April, 2002. The City contracted with PAC WEST LAND CARE, INC. who took over the landscape maintenance effective May 1 2002, according to Ted Molhoek, of the Parks, Recreation & Facilities Department of the City, who administers the Pac West Land Care.
