OF THE CITY OF PALM SPRINGS,CALIFORNIA,APPROVING
A STIPULATION FOR ENTRY OF INTERLOCUTORY
JUDGEMENT IN CONDEMNATION AND (PROPOSED) '
INTERLOCUTORY JUDGEMENT IN CONDEMNATION WITH
THOMAS A. ADAMO & EILEEN C. ADAMO, HUSBAND AND
WIFE AS COMMUNITY PROPERTY; AS TRUSTOR OF THE
$172,500 DEED OF TRUST RECORDED AUGUST 25, 1997
AS INSTRUMENT NO. 306923; AND, AS TRUSTOR OF THE
$100,000 DEED OF TRUST RECORDED AUGUST 25, 1997
AS INSTRUMENT NO. 306796, FOR THE ACQUISITION OF A
PROPERTY KNOWN AS255SOUTH INDIAN CANYON DRIVE
(APN 513154007) FOR THE PURPOSE OF CONSTRUCTING
A DOWNTOWN PARKING STRUCTURE A04504
WHEREAS the City of Palm Springs has endeavored for the past thirty years to increase the
supply of public parking in the downtown area; and
WHEREAS the City is proceeding with the construction of a downtown parking structure atthe
northwest corner of Baristo Road and Indian Canyon Drive; and
WHEREAS,the City had investigated the acquisition of various interests in property, including
fee interest, located along the west side of South Indian Canyon Drive between Baristo Road
and Arenas Road, including a parcel identified as Assessors Parcel N-Imner 513-154-007 for
the purposes of constructing the parking structure; and
WHEREAS on March 6, 2002 the City Council approved Resolution 20289 commencing the '
eminent domain process against said property, and subsequently filed actions in Riverside
County Superior Court; and
WHEREAS subsequent to receiving an Order of Immediate Possession from the Riverside
County Superior Court on March 14, 2002, the City, property owner and tenant reached
agreement on price and terms of said property.
NOW THEREFORE 8E IT RESOLVED by the City Council of the City of Palm Springs, that
a Stipulation For Entry of Interlocutory Judgement in Condemnation and (Proposed)
Interlocutory Judgement in Condemnation with Thomas A. Adamo and Eileen C. Adamo,
husband and wife as community property; as Trustors of the$172,500 Deed of Trust recorded
August 25, 1997 as instrument no. 306923, and, as Trustcrs of the $100.000 Deed of Trust
recorded August 25, 1997 as instrument no. 306796, in a form approved by the City Attorney,
is hereby approved.
ADOPTED this 15th day of Mao _, 2002.
